When operating a vessel on a body of water where the discharge of untreated sewage is prohibited by the Environmental Protection Agency under 40 CFR 140.3, the operator must secure each Type III device in a manner which prevents discharge of sewage. Acceptable methods of securing the device include—(1) Closing each valve leading to an overboard discharge and removing the handle;(2) Padlocking each valve leading to an overboard discharge in the closed position; or(3) Using a non-releasable wire-tie to hold each valve leading to an overboard discharge in the closed position. Vessel's type III MSD did not have the discharged valve locked/secured.33CFR159.7(c)

Vessel is required to carry child life jackets equaling 10% of the total number of persons carried per the vessel COI (138 adult/14child jackets). Vessel only had 12 serviceable child life jackets onboard. vessel is required to replace the 02 serviceable life jackets. No more than 12 passengers under 90lbs until jackets are replaced.

Child life jackets when provided shall be stowed separately. Separate adult and child life jackets and label the containers with number and type of jackets.46CFR180.25-10(c)

Each life ring must be an approved type and be in serviceable condition. The life ring located on the port side of the operating station had a grab line that was worn and broken. Repair line or replace life ring.46CFR180.30-1

The wet exhaust pipe for the starboard engine is leaking water in way of the rubber sleeve clamps located at the aft generator room bulkhead. Tighten or replace clamps.46CFR182.20-20

Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the Great Lakes, must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. Battery for the EPIRB was dead and the EPIRB did not function. Replace battery/EPIRB prior to operating on the high seas. 46CFR180.64

The design of all exhaust systems must ensure minimum risk of injury to personnel. Protection must be provided in compliance with § 177.970 of this chapter at such locations where persons or equipment might come in contact with an exhaust pipe. Lagging on the stdb main engine is damaged/missing. Re-lag the exhaust pipe. 46CFR182.430(a)

Electrical equipment used in the following locations must be drip proof: (1) A machinery space. Light fixture in engine room was missing the protective glass bulb. Replace missing glass bulb for light fixture. 46CFR183.210 (a)(1)

A means of escape which is not readily apparent to a person from both inside and outside the space must be adequately marked in accordance with § 185.606 of this chapter. Port side crew space means of escape was marked on the inside but not on the deck where passengers have the ability to block the escape hatch. Mark the escape hatch on the outside of the space in accordance with 46CFR185.606. 46CFR177.500(h)(i)

Electrical equipment used in the following locations must be drip proof: (1) A machinery space. Electrical panel located in the generator space had large and small holes in the side as well as exposed wires in a junction box. Provide cover for the junction box and make all holes in electrical panel water proof. 46CFR183.210(a)(i)

Escape hatches and other emergency exits shall be marked on both sides using at least 1" letters "Emergency Exit, Keep Clear". Emergency exits on the outside deck were not labeled. 46CFR185.30-15

In damp or wet locations cable entrances shall be watertight. There are several holes that are not watertight in the electrical panel located on the forward bulkhead of the generator room. 46CFR183.10-20(f)(3)

Port main engine wet exhaust had a water leak on the bottom side of the pipe adjacent to the aft engine room bulkhead. Make a permanent repairs to the wet exhaust piping. 46CFR182.20-15

Vessel submitted a electrical one line drawing (Fairhaven Shipyard Dwg No. -, Rev. 2.1, “Generator/Electrical Drawing,” 1 sheet, dated April 20, 2023) to Coast Guard Marine Safety Center for review and approval of a newly installed generator. MSC Letter E2-2301670 returned the electrical one line drawing for revisions. Vessel can not operate with passengers prior to addressing all comments in MSC Letter E2-2301670 and contacting the local OCMI to have a qualified Marine Inspector inspect the final installation to ensure it is in compliance with approved plans.

Vessel must submit a 1 line diagram of electrical system and provide load analysis.

Vessel must provide results of the stability findings prior to carrying passengers.

The watertight integrity of the hull has been compromised due to a water leak in the hull plating in way of the engine room. Permanent repairs must be completed to the satisfaction of the attending Coast Guard Marine Inspector prior to operations. Temporary repairs will be authorized only for transit to the shipyard at which repairs are to be completed. The temporary repair must first be approved by the attending Coast Guard Marine Inspector.

The Master shall conduct sufficient drills to ensure crew familiarity with assigned duties. The crew was not familiar with the equipment or duties for Man-Overboard, demonstrated poor communication, excessive recovery time resulted in failed drill. No evidence of logged drills onboard for 2019 operating season.

Vessel is required to have two 1.5" 50ft fire hoses onboard. Vessel is required to conduct fire drills as realistic as practicable. Both of the vessel's required fire hoses were unserviceable, excessive leaks and detatching from the coupling, would not effectively fight a fire. No fire drills are logged or documented as having been conducted in 2019 season.

All vessels greater than 26ft shall be provided with individual suction lines for each watertight compartment. Repairs to equipment must be approved by the [name withheld] leaks/air ingress was noted in bilge piping, piping for both the crew quarters & aft steering has soft patch repairs. Suction could not be establised for any watertight compartments, air ingress to piping system is suspected cause.

Each item of survival craft equipment must be in good condition. Life float painter lines, grab lines, and light lanyards are not in serviceable condition; Painter lines, lines for required lights & grab lines installed on the life floats are dry-rotted and not serviceable.

A vessel of more than 65ft must carry 03 life ring buoys. The Port bridge wing life ring buoy was not in serviceable condition.

Diesel fuel supply piping material shall comply with applicable regulations. Repairs to machinery systems that affect the safety of the vessel must not be made without approval from the OCMI. The Port side main fuel oil tank piping has a soft patch repair, the generator fuel oil piping is excessively rusted and wasted, & its associated non-metallic hoses are dry-rotted.

All wiring and cables shall be suitable for marine service and for the particular installation used. The shore tie connection in way of generator room is coming apart and has exposed wiring, creating a shock hazard.

At each inspection the bilges and other spaces may be examined to see that there is no excessive accumulation of oil, trash, debris, or other matter that might create a fire hazard. There was excessive oily water in the engine room bilges, crew quarters bilges and aft steering bilges.

At each inspection the marine inspector shall require that all observed unsafe practices & hazardous situtations be corrected. Section of insulation in the engine space were torn/damaged, resulting in cable runs with excessive sag and vertical hanging insulation creating a crew safety hazard.

Exhaust gas must not leak from the piping or any connections. The piping must be properly supported by noncombustible hangers or blocks. Main engine wet exhaust flexible hose is not supported by noncombustible hangers or blocks, and SSDG aft exhaust coupling has evidence of an active exhaust leak.

The Master shall ensure that one or more placards meeting the requirements of this section are displayed and legible in prominent locations. Garbage placard was wasted and illegible.

PERMANENTLY CLOSE WATERTIGHT DOOR BETWEEN ENGINEROOM AND GENERATOR ROOM.

PROVIDE PROPER REACH RODS FOR EMERGENCY FUEL SHUT OFF AND PROVE PROPER OPERATION OF EACH ROD.

REMOVE MURPHY ALARM SYSTEM AND ALL ASSOCIATED "S" TYPE ELECTRICAL CABLE.

REMOVE UNAPPROVED FLOURESCENT LIGHTS AND ASSOCIATED CABLE FROM ENGINE ROOM.

REPLACE PLASTIC WIRE TIES WITH METALLIC.

REWIRE SANITARY PUMP WITH PROPER UL APPROVED CABLE TO A JUNCTION BOX.

REPLACE BROKEN PILOT HOUSE CONTROLS IN PILOT HOUSE.

PROVIDE GLOBES AND GUARDS FOR ENGINE ROOM LIGHTS WHERE MISSING.

PROVIDE COVER FOR ELECTRICAL RECEPTACLE ON ENGINEROOM AFT BULKHEAD.

PROVIDE 2ND MEANS OF ESCAPE FROM ENGINE ROOM.

PROVIDE PLANS FOR CHANGES MADE TO GENERAL PLAN.

PROVIDE STRAINERS FOR AIR BILGE SUCTIONS EQUAL TO 3 TIMES THAT OF BILGE PIPING.

REPAIR SEVEN (7) CRACKED WELDS IN FOREPEAK SPACE. ALL CRACKS MARKED AND INDICATED TO O/O FOR REPAIR.
