Vessel's ORB Book was not kept in affect with Appendix III by not logging weekly soundings on-board. MARPOL (17 Cons) I/17,1

For any vessel that is equipped with ballast water tanks and bound for ports or places in the United States..... Submit the ballast water report no later than 6 hours after arrival at the port or place of destination, or prior to departure from that port or place of destination, whichever is earlier. Vessel did not submit ballast water report to National Ballast Information Clearinghouse (NBIC) for arrival on 13Aug22. 33 CFR 151.2060(b)(3)

A record shall be kept, to the satisfaction of the Administration and as required by the Radio Regulations of all incidents connected with the radio communication service which appear to be of importance to the safety of life at sea. Vessel performed required tests of the GMDSS equipment, but did not enter this information into their logbook for over a month. Vessel was previously written up for the same deficiency. SOLAS 20 IV/17

Systems and equipment used to meet the requirements of this regulation shall conform to performance standards and functional requirements. not inferior to those adopted by the Organization. Any Shipboard equipment shall be of a type approved by the Administration. LRIT Conformance Test report could not be provided as required per regulation which leads to MSC.1/Circ. 1307 Paragraph 7. 74 SOLAS (20) IV 19-1.6

Each vessel must have the following marine charts of the area to be transited, published by the national ocean Service, U.S. Army Corps of Engineers or a river authority that are currently corrected. PSCO’s observed that vessel does not currently update or correct charts. 33Cfr164.33 (a)(1)(ii)

Arrangements shall be made to ensure immediate availability of a supply of water from the fire main at the required pressure either by permanent pressurization or by suitably placed remote arrangements for the fir pumps. PSCO’s observed that vessel does not have immediate availability of a supply of water as required from their DOC Dangerous Goods. 74 SOLAS (20 Cons.) Ch. II-2 / Reg. 19.3.1.1

The master, owner, operator, agent, or person in charge of a vessel equipped with ballast tanks … must employ one of the following ballast water management methods:. PSCO’s observed that vessel’s does not have a Ballast Water Treatment System, nor does the Ballast Water Management plan specifically state that they will not discharge ballast into the U.S. 33 CFR 151.2025 (a)

For each ship...details of fuel oil for combustion purposes delivered and used on board shall be recorded by means of a bunker delivery note that shall contain at least the information specified in appendix V of this annex. Vessel took on bunkers on 24MAY22 and is missing required information per appendix V. MARPOL (17 Cons.) Annex VI/ Reg. 185. 50bc.

Oil filtering equipment referred to in paragraph 1 of this regulation shall be of a design approved by the administration and shall be such as will ensure that any oily mixture discharged into the sea after passing through the system has an oil content not exceeding 15 ppm. The crew could not demonstrate proper operation of the Oil Discharge Monitoring and Control System. MARPOL (17 CONS) Annex I/Reg. 14.6

The master of every new ship shall be supplied with information to arrange for the loading and ballasting of his ship in such a way as to avoid the creation of any unacceptable stresses in the ship’s structure… The vessel's stability diagrams did not accurately reflect the number and location of ballast tanks. Additionally, ship’s stability information was found to be based off inaccurate ballast tank soundings, thus creating unknown stress on the ship’s structure. ICLL 66 Reg. 10(1)

Such certificates shall be issued by the Administration or by any person or organization duly authorized by it. In every case, the Administration assumes full responsibility for the certificate. The ICLL Certificate was unsigned and the content of the certificate was filled in with an ink pen/marker pen. ICLL 66 Article 16 (3)

Fire extinguishing appliances in new and existing passenger ships and cargo ships shall be kept in good order and available for immediate use at all times during the voyage. The CO2 storage room was secured with a padlock to which the key was missing, preventing the system from being ready for immediate use during the voyage. 60 SOLAS Chapter 2 Reg. 66

All required fire detection systems shall be capable of automatically indicating the presence or indication of fire and also its location. Fire alarm panel on the bridge indicates a fault and maintains a continuous alarm for all engineering spaces of zones 1 and 2 and prevents the notification and location of a fire onboard. SOLAS 60 Chapter 2 Reg. 61(a)

Every oil fuel suction pipe from a storage, settling or daily service tank situated above the double bottom shall be fitted with a cock or valve capable of being closed from the outside of the space in which such tanks are situated. Quick closing valves for main engine and generator fuel oil tanks did not operate. 60 SOLAS Chapter 2 Reg. 69 (C)

Crew members with enclosed space entry responsibilities shall participate in an enclosed space entry and rescue drill to be held on board the ship at least once every two months. Vessel had no records of any confined space entry rescue drills being conducted. SOLAS 20 III/19.3.3

In cargo ships of less than 5,000 tons gross tonnage shall be a self-contained emergency source of power located to the satisfaction of the Administration. PSCOs were unable to verify that the vessel's source of emergency power is a type approved by the administration and is capable of providing emergency power to required essential systems. SOLAS 60 Ch.1 Reg.26

The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. Due to the objective evidence in the above deficiencies, the vessel is not in substantial compliance with relevant conventions, calling into question the adequacy and implementation of the vessel’s SMS under the ISM code. PSCOs collected objective evidence that the vessel’s SMS is not complete. Per the table of contents onboard, numerous sections are either incomplete or absent entirely, calling into question the adequacy and implementation of the vessel’s SMS under the ISM code. The major non-conformities identified include: Gross non-compliance with the Ballast Water Management Plan, an unreported, inoperable fire panel on the bridge, a missing key to open and operate the fixed CO2 system, and excessive fuel and oil accumulation in the engine room. An external audit conducted by the Flag or RO is required to determine whether the ship is operating in accordance with the ISM Code. Provide a copy of the completed audit report to USCG prior to departure from port. 74 SOLAS (14) IX/3.1 ISM Code Part A/10.1

The company should ensure that each ship is manned with qualified, certificated, and medically-fit seafarers in accordance with national and international requirements. Vessel was reflagged and issued Certificate of Registry dated 12/30/2021. CH. Officer arrived onboard on 4/13/22 and CH. Engineer arrived onboard on 4/25/22. Both did not submit applications for flag state endorsements until 5/6/2022. 74 SOLAS (14) IX/3.1 ISM Code Part A/6.2.1

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship will in all respects remain fit to proceed to sea without danger to the ship or persons on board. Anchor hawsepipe is cracked at the deck allowing water to enter the space below the bulkhead deck. SOLAS 60 I/11

All ships of 500 GT and upwards shall have… an automatic tracking aid, or other means, to plot automatically the range and bearing of other targets to determine collision risk. Radar was unable to identify any vessel targets. SOLAS 20 V/19.2.5.5

For any vessel that is equipped with ballast water tanks and bound for ports or places in the United States… Submit the ballast water report no later than 6 hours after arrival at the port or place of destination, or prior to departure from that port or place of destination, whichever is earlier. For each ship… details of fuel oil for combustion purposes delivered and used on board shall be recorded by means of a bunker delivery note that shall contain at least the information specified in appendix V of this Annex. Vessel is missing bunker delivery notes causing ambiguity of the specifications of the fuel therein. MARPOL (17 CONS) Annex VI/Reg. 18.5

All ships over 150 tons gross tonnage, when engaged on international voyages, shall have on board an efficient daylight signaling lamp which shall not be solely dependent on the ship’s main source of electrical power. Daylight signaling lamp does not have a secondary source of power that does not relay on the main source of electrical power. SOLAS 60 Chapter 5 Reg. 11

Efficient guard rails or bulwarks shall be fitted to all exposed parts of the freeboard and superstructure decks. Stern deck railings are significantly wasted. ICLL 66 Reg. 25.2

A record shall be kept, to the satisfaction of the Administration and as required by the Radio Regulations of all incidents connected with the radio communication service which appear to be of importance to the safety of life at sea. Vessel does not maintain a Radio log book. SOLAS 20 IV/17

Each operation described in paragraph 2 of this regulation shall be fully recorded without delay in the Oil Record Book Part I, so that all entries in the book appropriate to that operation are completed. The Oil Record Book has incorrect entries: logging tank soundings in cm not m3, logging fuel tank soundings as bunkering operations and missing sounding tables to determine quantities in measured tanks. MAPOL (17 CONS) Annex I/Reg. 17.4

The master, owner, operator, agent, or person in charge of a vessel bound for a port or place in the United States, must ensure the maintenance of written or digital records that include the information required to be reported by § 151.2060 of this subpart and the sediment information in paragraph (a)(1) of this section. The master, owner, operator, agent, or person in charge of a vessel subject to this section must retain a signed copy of this information onboard the vessel for 2 years. Vessel had zero ballast water log book entries or soundings recorded. 33 CFR 151.2070(a)

From the point of view of safety of life at sea, all ships shall be sufficiently and efficiently manned. Ship's officers had no flag state endorsements to satisfy positions required by Minimum Safe Manning document. 74 SOLAS (20 CONS) V/14.1

An administration which recognizes under regulation I/10: A certificate of competency; shall endorse such certificate to attest to its recognition... Ships officer's could not produce valid flag state endorsements or receipts of application for endorsements.

CARGO PORTS AND OTHER SIMILAR OPENINGS IN THE SIDES OF THE SHIP...SHALL BE FITTED WITH DOORS SO DESIGNED AS TO ENSURE THE SAME WATERTIGHTNESS AND STRUCTURAL INTEGRITY AS THE SURROUNDING SHELL PLATING... PSCO'S DISCOVERED THE SIDESHELL OPENING CABLES SNAPPED, CAUSING THE SIDESHELL OPENING TO BE NON-OPERATIONAL. ICLL 88 REG 21.1

ALL SHIPS OF 300 GROSS TONNAGE AND UPWARDS ENGAGED ON INTERNATIONAL VOYAGES... SHALL BE FITTED WITH AN AUTOMATIC IDENTIFICATION SYSTEM (AIS). AIS DISPLAY WAS REMOVED FROM THE VESSEL FOR REPAIRS; VESSEL DID NOT HAVE AN EXEMPTION FROM FLAG OR CLASS. 74SOLAS(2O2O CONS..) V/19.2.4

EVERY CREW MEMBER WITH ASSIGNED EMERGENCY DUTIES SHALL BE FAMILIAR WITH THESE DUTIES BEFORE THE VOYAGE BEGINS. DURING THE FIRE DRILL, 01 CREWMEMBER OPEN THE SPACE CONTAINING THE FIRE WITH NO FIREFIGHTING EQUIPMENT. NO HOSE WAS FAKED OUT FOR THE FIREFIGHTING MEMBER. 74SOLAS(2020 CONS..)III/19.2.1

EVERY OIL TANKER OF 150 GROSS TONNAGE AND ABOVE AND EVERY SHIP OF 400 GROSS TONNAGE AND ABOVE... SHALL BE PROVIDED WITH AN OIL RECORD BOOK PART 1 (MACHINERY SPACE OPERATIONS). THE OIL RECORD BOOK, WHETHER AS A PART OF THE SHIP'S OFFICIAL LOGBOOK OR OTHERWISE, SHALL BE IN THE FORM SPECIFIED IN APPENDIX III TO THIS ANNEX. THE CHIEF ENGINEER WAS NOT CONDUCTING WEEKLY SOUNDINGS IN THE OIL RECORD BOOK. MARPOL 2017 ANNEX 1/17.1

CREW ACCOMMODATION SHALL BE MAINTAINED IN A CLEAN AND DECENTLY HABITABLE CONDITION... 01 CREW CABIN RESTROOM HAD SEWAGE ON THE FLOOR. ILO 147 PAGE 38

After any survey of the ship under regulations 7, 8, 9, or 10 has been completed, no change shall be made in the structural arrangement, machinery, equipment, etc. Covered by the survey, without the sanction of the administration. Vessel's #1SSDG has an jacket water leakage impairing the service of the equipment. 60 SOLAS I/11

Oil Filtering Equipment referred to in paragraph 1 of this regulation shall be a design approved by the administration and shall be such as will ensure that any oily mixture discharged into the sea after passing through the system has an oil content not exceeding 15 ppm. PSCO's observed an unauthorized testing valve on the overboard line of the oily water separator that does not correlate with any manual of diagram onboard. MARPOL Annex I/14.6

The company and the ship shall comply with he requirements of the International Safety Management Code. The inspections mentioned in 10.2 as well as the measures referred to 10.3 should be integrated in the ships operational maintenance routine. Vessel has not been able to test their detectors in over a month because the company hasn't provided the appropriate equipment to conduct the testing according to their SMS. 74 SOLAS (14) Ch. IX/Reg. 3.1 ISM Code Part A/10.4

Oil Filtering Equipment referred to in paragraph 1 of this regulation shall be a design approved by the administration and shall be such as will ensure that any oily mixture discharged into the sea after passing through the system has an oil content not exceeding 15 ppm. The OWS pump discharge line has a crack and is spraying oily water when pressurized. MARPOL Annex I/Reg. 14.6

In any...as far as applicable in any cargo ship, there shall be permanently exhibited for the guidance of the ship's officers general arrangement plans showing clearly for each deck.. detecting systems. PSCO noticed discrepancy between 2 posted fire control plans indicating 2 different total smoke detectors onboard. 60 SOLAS Ch. II/ Reg. 70

The construction of all doors and door frames in "A" class divisions...shall provide resistance to fire as well as to the passage of smoke and flame equivalent to that of the bulkheads in which the doors are situated. "A" class division in ECT maintains multiple penetrations in the steel. Additionally a through-hole where the previous locking mechanism was located existed. 60 SOLAS CH II-1/Part D Reg 38(d)

The company and the ship shall comply with the requirements of the International Safety Management Code. The Safety Management System should provide specific measures aimed at promoting the reliability of such equipment or systems. SMS does not include procedures on how to properly test smoke and heat detectors on board. 74 SOLAS (14) CH IX/REG 3.1 ISM Code Part A/10.3

The liferaft shall be stowed as to be readily available in case of emergency. The painter line to port starboard liferafts are connected to the ship instead of the weak link of the hydrostatic release unit. The vessel was issued the same deficiency on 14 NOV 2016. 60 SOLAS/ CH. III Reg. 15 (p). Action taken 30bc.

0899 - Other (accident prevention) - The sides and backs, and where necessary, the fronts of switchboards shall be suitably guarded. The main switchboard has an opening from a previously installed circuit breaker posing a significant electrical hazard to the crew. 60 SOLAS III/15(p) - action taken: 17bc

0999 - Other (Safety in General) There shall be non-conducting mats or gratings front and rear where necessary for switchboards. Non-conducting mating does not cover the entire front of main switchboard. 60 SOLAS III/27(a)(ii) action taken: 17bc

2120 - Garbage - Every ship of 12 m or more in length overall shall display placards which notify the crew and passengers of the disposal requirements of regulations 3 and 5 of Annex V. Placards throughout the vessel and at the garbage storage location are placards for MARPOL Annex V regulations in place prior to 01 January 2013 and have not been updated to the revised regulations. MARPOL (11) Annex V/9.1 action taken 17bc

9900 - Other (clearly not hazardous) - A vessel owner or operator required by 155.1035, 155.1040, or 155.5035 to have a response plan shall conduct exercises as necessary to ensure the plan will function in an emergency. No evidence of QI notification exercise could be provided. 33CFR155.1060(a)(i) action taken: 17c

9900 - Other (Clearly not hazardous) The master or person in charge of any vessel equipped with ballast water tanks that operates in the waters of the US must maintain a ballast water management plan and a strategy that complies with the requirements. Vessel is not completing the ballast water record book in accordance with the ballast water management plan. 33CFR151.2050(a) action taken:50c

9900 - Other (clearly not hazardous) - The vessel owner or operator must ensure that they maintain a copy of the Coast Guard approval letter, onboard the vessel. Vessel could not provide a copy of the NTVRP approval letter. 33CFR155.5030 (g)(1) action taken: 50c

MARPOL 73/78 Annex I/3 REG. 17.2.3 - The Oil Record Book Part 1 shall be completed on each occasion on a tank-to-tank basis if appropriate, whenever collection and disposal of oil residues (sludge) takes place in the ship. Vessel failed to properly record collection of oil residues into sludge tank on multiple occasions.

1620 - Life Saving Appliance - Liferafts shall be fited witha painter and shall have a line securley beckedeted round the outside. Painter line was found improperly rigged to the ship. Solas 60 III/15d
