Muster and embarkation stations shall be adequately illuminated by lighting supplied from the emergency source of electrical power required by regulation II-1/ Reg 43. The embarkation ladder emergency lights on both the port and starboard O3 deck were inoperable. The emergency light on the port side aft bulkhead was extinguished. Cite: SOLAS (2004) III/Reg 11.4

Seafarers shall receive safety familiarization and basic training or instruction in accordance with section AVI/ 1 of the STCW Code and shall meet the appropriate standard of competence specified therein. Where basic training is not included in the qualification for the certificate to be issued, a certificate of proficiency shall be issued, indicating that the holder has attended the course in basic training. The company should ensure that each ship is manned with qualified, certificated and medically-fit seafarers in accordance with national and international requirements. During the USCG review of the crewmember’s Merchant Mariner’s Credentials and Medical Certificates, identified 7 crewmembers without STCW Basic Training (or STCW Basic Training certificates) and the appropriate ship’s personnel were unfamiliar with four crewmembers' medical conditions outlined in the Medical Certificate waivers. Reviewed the SMS T-AKE CIVMAR Credential and Training Competency Matrix and noted STCW – Basic Training is required for all positions noted on the matrix. According to SMS 1.1-001-AKE (Rev 1.9) there is no review by shipboard personnel for the Medical Certificates and/or Medical Waivers. Also, reviewed SMS Form 6.2-002-01-ALL does not list medical certificates, waivers, or review of credentials for position. Conduct an internal safety audit of the SMS capturing the manning procedures, to include required qualifications/ certifications and medically-fit mariners. Provide the results of the internal audit and corrective action to USCG Activities Europe for review, due 28Mar2025. Have the procedures verified by the RO at the next external audit. 74 SOLAS (2009 Cons.) II-1/43.1.1 A self-contained emergency source of electrical power shall be provided. The EDG does not function reliably and has experienced multiple failures.

Means shall be provided whereby normal operation of propulsion machinery can be sustained or restored even though one of the essential auxiliaries becomes inoperative-an air compressor and receiver for starting or control purposes. #1 Start Air Compressor was found dismantled and taken apart on the deck. Compressor dismantled due to failure. Tech service in late AUG during VR period not completed. Correct parts did not arrive for rebuild. Compressor was initially reported (CASREP-2) to the company 24JUN2023. #2 Start Air Compressor has worked independently since JUN. 03 large fans directed at air compressor to mitigate overheating/failure. #2 compressor also found with sensor control box detached and hanging by electrical cables. Excessive amounts of lube oil found on deck and bucket under compressor. Make repairs to both start air compressors. 74 SOLAS ('04 ConsEd) II-1/26.3.9

Oil record book entries shall be made as required. No Oil Record Book (ORB) entries for weekly soundings completed from MAY2023 thru NOV2023. Expanded MARPOL Annex I exam. Incorrect codes used for sludge discharge ashore. C/E corrected entry codes, signed changes and educated on responsibilities as per SMS. MARPOL Annex II Reg 17

Oil fuel pipes, which, if damaged, would allow oil to escape from a storage, settling or daily service tank having a capacity of 500l and above situated above the double bottom, shall be fitted with a cock or valve directly on the tank capable of being closed from a safe position outside the space concerned. Remote shut off valve reach rod to EDG fuel tank broke during testing due to deterioration/lack of maintenance. SOLAS 74am ('04 ConsEd) II-1/4.2.2.3.4

Periodic Safety Tests (PSTP) must be conducted annually to demonstrate the proper operation of automation systems. Approved PSTP's must be retained aboard the vessel. Documents must be in a step-by-step or checkoff list format. PSTP's shall specify equipment status, apparatus necessary to perform the tests, safety precautions, safety control and alarm set points, the procedure to the followed, and the expected test result. PSTP's are to be witnessed by the surveyor. C/E provided PSTP records for 2020, but '21-'23 records were not found at time of inspection. '20 records were not fully complete/signed for each test. Equipment needed to perform tests for shut-downs of the MDG's was out-of-calibration or inoperable. C/E provided '22 ABS survey report to indicate testing should have been completed. Complete all PSTP testing with proper equipment and properly record tests with surveyors/technicians. U.S. Supplement to ABS Rules 2003/Section I-7 & ABS Rules 4-9-1/7

The C/E shall be responsible for E/R sanitary condition. Unknown chemicals spilled in machinery room port side. Plastic 5-gallon packages marked as toxic and corrosive in vicinity. Provide proper PPE and properly clean. 46CFR 97.15-10

After any survey of the ship no change shall be made in the machinery, equipment and other items covered by the survey. During inspection observed sludge transfer pump, machinery bilge pump and cargo hold bilge pump removed or disassembled and replaced with pneumatic diaphragm pumps. Short lengths of flexible hoses clamped into existing piping. Portable air hoses tied into pumps from ship service air to transfer water/sludge. Request ABS approval for modifications. Each lifeboat shall be equipped with an operational illuminated compass at the steering position. Lifeboat #4 compass is inoperable. SOLAS 74am ('20 ConsEd) III/31.1.1 -LSA Code 4.4.5

Fire protection systems shall be maintained and ready for use. The M-1 E/R supply fan damper failed to close during testing. The fuel supply quick closing valves (FT-V-04 & FT-V-01) failed to close during testing. Maintenance conducted by crew on fire damper and quick closing valves. Each retested satisfactory. Focused SMS external audit required prior to departure from port of repair. This audit shall focus on the deficiencies marked as SMS Related to include engineering record keeping (PSTPs/ORB), unauthorized repairs/alterations, reporting defects to ABS and company engagement for maintenance/repairs needed.

Drills shall, as far as practicable, be conducted as if there were an actual emergency. During fire and abandoned ship drills, the crew failed to follow standard MSC shipboard emergency response procedures. Additionally, multiple personnel were confused about muster location and failed to report to the lifeboats with required equipment.

The ship should be maintained in conformity with relevant rules and regulations with inspections held at appropriate intervals, and should ensure any non-conformity is reported, appropriate corrective action taken, and records of those activities are maintained. During annual inspection, Marine Inspectors noted the Fire [name withheld] indicated active faults across the fire detection system first dated December 30, 2021. Lack of objective evidence documenting efforts to correct the faults indicate a potential failure of the Safety Management System on-board. No maintenance requests for the faulty fire detection panel were produced, quarterly operational testing and inspection of the fire detection system was overdue, and no records of completed installation or commissioning of the fire detection panel upgrade in December 2021 were available for inspection. External SMS audit required by RO (ABS) prior to ship's release from flag state detention. Scope of audit may be limited to fire detection system servicing,on-board maintenance, operational testing, and non-conformity reporting. Function of fixed fire detection & fire alarm systems shall be periodically tested by means of heat or smoke for which the detector is designed. The detection system shall initiate audible & visual alarms on the navigation bridge and engineer officer locations. MI's noted 193 faults on the fire detection panel impacting Loop #7 (Cargo handling areas, main deck, Cargo Holds 3 & 4, Aviation hangar and refueling spaces) & Zone #2 (Accommodations & Bridge deck levels) detectors & function. Before the ship leaves port and at all times during the voyage, all lifesaving appliances shall be in working order and ready for immediate use. Prove proper operation of No. 1 starboard lifeboat steering to the satisfaction of the attending Marine Inspector.
