The company should establish procedures to ensure that the ship is maintained in accordance with the provisions of the relevant rules and regulations established by the Company. The technical nature of deficiency noted above provides objective evidence of a serious failure of the implementation of the ISM Code. An external audit report satisfactory to the OCMI must be submitted prior to the clearance of this deficiency. 74SOLAS(20) IX/3 ISM Code 10.1 30ac

THE PURPOSE OF THIS REGULATION IS TO LIMIT THE FIRE GROWTH POTENTIAL IN EVERY SPACE OF THE SHIP. FOR THIS PURPOSE, THE FOLLOWING FUNCTIONAL REQUIREMENTS SHALL BE MET: MEANS OF CONTROL FOR FLAMMABLE LIQUIDS IN THE SPACE SHALL BE PROVIDED. PSCO OBSERVED EXCESS OIL ACCUMULATION IN STBD AND AFT BILGE WELL.

OIL FILTERING EQUIPMENT REFERRED TO IN PARAGRAPH 1 OF THIS REGULATION SHALL BE OF A DESIGN APPROVED BY THE ADMINISTRATION AND SHALL BE SUCH AS WILL ENSURE THAT ANY OILY MIXTURE DISCHARGED INTO THE SEA AFTER PASSING THROUGH THE SYSTEM HAS AN OIL CONTENT NOT EXCEEDING 15PPM. PSCO OBSERVED FRESH WATER LINE FOR OWS NOT CONNECTED, PREVENTING FRESH WATER CALIBRATION AND SENSOR FLUSH, REQUIRED TO BE CONDUCTED IN THE MANUAL.

WHERE THE EMERGENCY SOURCE OF ELECTRICAL POWER IS A GENERATOR, IT SHALL BE STARTED AUTOMATICALLY UPON FAILURE OF THE MAIN SOURCE OF ELECTRICAL POWER SUPPLY. PSCO OBSERVED EMERGENCY GENERATOR DID NOT START INDEPENDENTLY UPON 3 ATTEMPTS; CREW HAD TO ASSIST IN EMERGENCY GENERATOR START UP.

THE FOLLOWING FIRE PROTECTION SYSTEMS SHALL BE KEPT IN GOOD ORDER SO AS TO ENSURE THEIR REQUIRED PERFORMANCE IF A FIRE OCCURS: FIRE DETECTION AND FIRE ALARM SYSTEMS. PSCO OBSERVED SMOKE ALARM IN DECK WORKSHOP COVERED BY PLASTIC, OBSTRUCTING ITS OPERATIONAL READINESS.

The company should establish procedures, plans, and instructions, including checklists as appropriate, for key shipboard operations concerning the safety of the personnel, ship, and protection of the enviornment. The vessel has checklists on weekly, monthly, and annual checks, however their SMS does not have particular procedures regarding how to test specific systems, particularly fire detection and the OWS. Crew was unfamiliar with locations of different detectors and uncertain in which testing devices werre required. The SMS does not address specific testing ewuipment that is required. Additionally, crew was unfamiliar with accessing the electronic logs on the MEPC 107(49) oil content meter. PSCO had to demonstrate how to access the logs using the operations manual. Reccomend an internal audit regarding shipboard operations, maintenance, and reporting of non-conformities be conducted within 90 days.

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed hairline cracks in numerous windows of the free fall lifeboat.

The condition of the ship and it's equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed stack ventilation flame screens covered in soot and fuel oil, and one was found to be torn.

The machinery, boilers, and other pressure vessels, associated piping systems and fittings shall be of design and construction adequate for the service for which they are intended and shall be so installed and protected as to reduce to a minimum any danger to persons on board, due regard being paid to moving parts, hot surfaces, and other hazards. PSCO observed fabricated catch for Lube Oil on No 1 generator and pooled oil underneath. Additionally PSCO observed a second fabricated catch and oil leak on FW stern tube hydraulic oil tank.

Electrical installations shall be such that: the safety of passangers, crew and ship from electricals hazards will be ensured. PSCO observed shaft generator to be missing electrical connections and internal windings covered in oil.

Where "A" class divisions are penetrated for the passage of electrical cables, pipes, trunks, ducts, etc., or for girders, beams, or other structural members, arrangements shall be made to ensure that the fire resistance is not impaired. PSCO observed an uninsulated penetration through an "A" Class fire boundary in the ECR escape trunk. An A/C unit was installed through the penetration. Arrangement was approved under previous class society, not the current class society.

An alarm shall be provided indicating any fault requiring attention and shall be capable of sounding an audible alarm in the main machinery control room or at the propulsion machinery control position. Vessel crew reported that while in Houston, receiving a class survey, they suffered a casualty to their ECR/Engine Room alarms, rendering them inoperable and reported that they only have alarms on the navigation bridge. Vessel indicated that class did not issue any documentation. SOLAS 14 (20) II-1 / 51.1.1

For every ship to which CH I applies, the administration shall issue an appropriate minimum safe manning documen t. Vessel's minimum safe manning states that the vessel has a periodically unmanned machinery space. The vessel's crew reported & PSCO's observed that vessel's alarm cpu is inoperable preventing engine, valve & pump alarms from being received, vessel does not have flag document certifying current manning levels as safe. SOLAS 14 (20) V / 14.2.2

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed that the rescue boat engine is not operating as designed. 74 SOLAS (2001 cons.) III/20.1 17ac

The ring, lines and letters shall be permanently marked on the sides of the ship. PSCO observed that the mark of the issuing authority are not permanently affixed. ICLL 66 Reg 7/8 40ac

Before the ship leaves port and at all times during the voyage, all life saving appliances shall be in working order and ready for immediate use. PSCO observed emergency swing lever on single point rescue boat/life raft davit was twisted together with the break release resulting in a broken lever for emergency swing function. Temporary repairs made by crew and tested.

Main and auxiliary machinery essential for the propulsion and safety of the ship shall be provided with effective means for its operation and control. The #1 & #2 start air receivers lag pressure switches were electrically disconnected. 74SOLAS(01)II-1/31.1

Where the emergency source of electrical power is a generator, it shall be started automatically upon failure of the main source of electrical power supply. Emergency generator was completely dismantled for repairs. 74 SOLAS (01) II-1/43.3.1.2. Please refer to flag's document attached for extention approval.

All steering gear components and the rudder stock shall be of sound and reliable construction to the satifaction of the administration. During outbound transit vessel had loss of steering function that resulted in potential ground. Pilot called assist tug and returned vessel to prt. Class to atest to function and realibility of steering gear and controls (to incude hydraulic leaks found near steering gear) prior to departure from port.

Ships shall be maintained in compliance with the structural requirements of a class society which is recognized by the administration. It was reported that the vessel ran soft aground. Class to attest to structural itegrity of the vessel prior to departure.

The machinery shall be so installed and protected as to reduce to a minimum any danger to persons onboard, due regard being paid to moving parts. PSCO observed machinery gearing on port side rear of main engine with a screen guard missing.

Fire fighting systems and appliances shall be in good working order and readily available for immediate use. PSCO observed fire station number 21 was heavily corroded with salt water and unable to be opened by crew for over ten minutes.

The machinery, boilers and other pressure vessels, associated piping systems shall be of a design and construction adequate for the service for which they are intended and shall be so installed and protected as to reduce to a minimum any danger to persons on board, due regard being paid to moving parts, hot surfaces and other hazards. The design shall have regard to materials used in construction, the purpose for which the equipment is intended, the working conditions to which it will be subjected and environmental conditions on board. The PSCO discovered the following hazardous conditions in the vessels machinery spaces: Missing and oil soaked lagging found on fuel line leading to main engine, starboard side, at bottom deck of engine room. Oil soaked electrical equipment on main engine to include: control box, oil mist detectors, and governor. HFO manifold in engine room, bottom deck, found with oil soaked lagging. Found oil soaked lagging throughout purifier space and purifier equipment. Oily rags and buckets thrown into ship’s framing, adjacent to fuel oil purifier space. Drained fuel oil from fuel tank in emergency generator space, stored using 5 gallon container in the space. 74 SOLAS (1997 Cons.) II-1/26.1

The machinery, boilers and other pressure vessels, associated piping systems shall be of a design and construction adequate for the service for which they are intended and shall be so installed and protected as to reduce to a minimum any danger to persons on board, due regard being paid to moving parts, hot surfaces and other hazards. The design shall have regard to materials used in construction, the purpose for which the equipment is intended, the working conditions to which it will be subjected and environmental conditions on board. The PSCO discovered unapproved and improper installation of the following equipment in the vessels machinery spaces: Unapproved and improperly rigged main engine governor electrical control box installed on main engine port side. Main engine exhaust gas temperature sensor improperly rigged with temporary electrical connection. Ships service generators contain loose and exposed wiring for fuel alarms. Air start control box for ship service generator found with temporary zip-tie connections. 74 SOLAS (1997 Cons.) II-1/26.1

Electrical installations shall be such that the safety of crew and ship from electrical hazards will be ensured. The PSCO discovered the following electrical hazards throughout the vessel: Daisy chained and unapproved electrical connections for equipment installed in in engine control room. Sea Water #2 Cooling Pump for main engine found with loose wires and dangerous electrical connections. Emergency generator panel found with hazardous openings on the switchboard. Hazardous electrical connections for installed equipment found in crew laundry. Explosion proof lighting found without grounding cable. Navigation equipment electrical connections open, and not installed in a panel. Several unapproved connections and electrical splices found on Navigation Bridge. Broken lighting fixtures and open light fixtures in engine room, lower deck. Ion generator pump, for recirculation of sea chest, improperly fitted and tied into ship’s electrical system. Unapproved additional lighting found installed in generator space, tied into ships electrical system inappropriately. Unapproved electrical breaker supplied unapproved and improvised heater, tied into provisions cooling pump breaker, located in ECR. 74 SOLAS (1997 Cons.) II-1/40.1.3 – 30 a/c

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. The PSCO discovered the following: Emergency light fixtures at lifeboat and rescue boat embarkations, as well as forward port side cargo hold main deck fixture, found inoperable. Public address system at embarkation stations for lifeboat and rescue boat found improperly installed and inoperable. Lifejackets not stowed in forward lifejacket storage box as designated by lifesaving plan. 74 SOLAS (1997 Cons.) III/19.2 – 30 a/c

The fire resistance of doors shall, as far as practicable, be equivalent to that of the division in which they are fitted. The PSCO discovered the following: Fire door #726 into crew and officer’s mess from passageway, not listed on fire control plan. Multiple fire doors throughout the stairway, as well as aft fire door to aft upper deck, found unable to latch properly. 74 SOLAS (1997 Cons.) II-2/47.1

In addition to complying with the specific provisions for fire integrity of bulkheads and decks mentioned elsewhere in this part, the minimum fire integrity of bulkheads and decks shall be as prescribed in tables 44.1 and 44.2. “A” class boundary cable penetration from steering space to provision store, found with wasted fire proofing, not performing as listed “A-15” according to table. 74 SOLAS (1997 Cons.) II-2/44.1

For each breathing apparatus a fireproof lifeline of sufficient length and strength shall be provided. Firefighter lifeline, found not to be of approved fire-proof type. 74 SOLAS (1997 Cons.) II-2/17.2

Objective evidence discovered in an expanded ISM exam revealed the following non-conformities; the vessel failed to fully implement the requirements of the SMS as evident by deficiencies #01 through #07. An external audit is required. 74 SOLAS (20 Cons.) IX 3.1, ISM Code 10.1

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present convention to ensure that the ship in all respects will remain fit to proceed to sea without presenting an unreasonable threat of harm to the marine environment. PSCO discovered the following items during examination of OWS: Unapproved, flexible water inlet line to primary stage OWS, not included on vessels main drawing. Crew testing OWS with chemical method not approved by manufacturer and expired testing chemical. Chemical bottle listed expiration date 14JUL2012. Loose and unfitted bolts on recirculation valve, inboard from 3-way valve. MAPROL 73-78 ANNEX I/6.4.1

10) The means of control of any fixed gas fire extinguishing system shall be readily accessible and simple to operate and shall be grouped together in as few locations as possible at positions not likely to be cut off by a fire in a protected space. At each location there shall be clear instructions related to the operation of the system having regard to the safety of personnel. Instructions for operation of CO2 cabinets for emergency generator and paint locker, do not correspond to installed design. “C” valve is not present, other valves not properly labeled. Cabinet for emergency generator does not alarm when opened. 74 SOLAS (1997 Cons.) II-2/5.1.

Any required fixed fire alarm system with manually operated call points shall be capable of immediate operation at all times. Call point for fire alarm at main deck passageway, improperly installed. 74 SOLAS (1997 Cons.) II-2/13.1.1

All hatch covers shall be fitted with steel, such covers shall be weather tight and fitted with gaskets and clamping devices. Escape hatch leading to upper deck aft, from steering gear/workspace, unable to fully close. ICLL 66/88 16.1

The machinery, boilers and other pressure vessels, associated piping systems shall be of a design and construction adequate for the service for which they are intended. PSCO discovered the following items in the vessel’s machinery spaces: Pressure sensors and gauges for fresh water and salt water cooling of main engine found disconnected from piping. Loose drive belts and dead end wires found on emergency generator. 74 SOLAS (1997 Cons.) II-1/26.1

After any survey of the ship has been completed, no change shall be made in the structural arrangements, machinery, equipment, and other items covered by the survey, without the sanction of the Administration. Temporary patch found on fire main, leading to educator on outside of cargo hatch #2, starboard side. 74 SOLAS (2020 Cons.) I/11(b) – 16 a/c

15) Electrical installations shall be such that the safety of crew and ship from electrical hazards will be ensured. PSCO discovered multiple electrical issues as follows: Electrical ventilator controls underneath #2 crane tower, found inoperable and wasted. Light cover for lighting fixture to #2 cargo hold port side, found missing. Soft patch found on electrical stand pipe leading from cargo hatch #2. Wasted or weak stand piping for electrical equipment found throughout cargo upper deck on both port and starboard side. 74 SOLAS (1997 Cons.) II-1/40.1.3

After any survey of the ship has been completed, no change shall be made in the structure, equipment, systems, fitting, arrangements or material covered by the survey, without the sanction of the Administration. Vessel fitted with six bolted flange for sewage discharge connection, which is specifically required for the standard discharge connection for sludge discharge. MARPOL 73/78 ANNEX I/6.4.2

After any survey of the ship has been completed, no change shall be made in the structure, equipment, systems, fitting, arrangements or material covered by the survey, without the sanction of the Administration. Flow sensor on vessel’s bunker line amidships found wasted. MARPOL 73/78 ANNEX I/6.4.2 – 16 a/c

THE CONDITION OF THE SHIP'S EQUIPMENT SHALL BE MAINTAINED TO CONFORM WITH THE PROVISIONS FO THE PRESENT REGULATIONS TO ENSURE THE SHIP WILL REMAIN FIT TO PROCEED TO SEA WITHOUT DANGER TO SHIP OR PERSONS ON BOARD. THE BOILER IS NOT OPERATIONAL.

THE RESCUE BOAT SHALL BE LAUNCHED AND MANOEUVRED IN THE WATER AT LEAST ONCE EVERY THREE MONTHS. THE RESCUE BOAT HAS NOT BEEN LAUNCHED OR MANOEUVRED IN THE WATER FOR SIX MONTHS.

A STATIC LIQUID PRESSURE TEST OF THE MAIN BUNKER LINE MUST BE CARRIED OUT ANNUALLY. THE LAST PRESSURE TEST WAS CONDUCTED 16FEB15.
