Chief Engineer stated the Oil Water Separator overboard discharge pipe is clogged. Return the overboard discharge valve to fully operational status. MARPOL Annex I/14.1

The company should establish a safety and environmental protection policy which describes how the objectives given in paragraph 1.2 will be achieved. The objective nature of deficiencies 02, 03, and 04 demonstrate the vessel is not being maintained to international standards, bringing into question the validity of the Safety Management Certificate issued pursuant to the ISM Code. An external audit is required to be submitted prior to departure from port. 74SOLAS(2020) IX/3.1 ISM A/10.1 30abc

The Oil Record Book Part 1 shall be completed on each occasion, on a tank-to-tank basis if appropriate, whenever any of the following machinery space operations take place in the ship. PSCO observed missing oil record book entries to include bunkering entry on 24JUL2022, oil water separator entries and weekly tank soundings. MARPOL Annex 1/17.2 30abc

The purpose of this regulation is to prevent the ignition of combustible materials or flammable liquids. For this purpose, the following functional requirements shall be met: Means shall be provided to control leaks of flammable liquids. PSCOs discovered lagging on numerous fuel oil service pipes to be lasted or excessively soaked in oil presenting a fire hazard. 74SOLAS(2020) II-2/4.1.1 30abc

Portable fire extinguishers shall comply with the requirements of the Fire Safety Systems Code. All fire extinguishers shall be of approved types and designs based on the guidelines developed by the organization. Portable fire extinguishers were last serviced in March 2021. 74SOLAS(2020) II-2/ 10.3.1 30ac

The following arrangements shall be tested in accordance with the Fire Test Procedures Code: Fire dampers, including their relevant means of operation. Fire damper in purifier room could not be closed. 74SOLAS(2020) II-2/9.7.1.2.1 17ac

The machinery, boilers and other pressure vessels, associated piping systems and fittings shall be of a design and construction adequate for the service for which they are intended and shall be so installed. Hydraulic start on emergency generator failed to start. 74SOLAS(2004) II-1/ 26.1 10c

A ship when in port or an offshore terminal of another party is subject to inspection by officers duly authorized by such party concerning operational requirements under this Annex, where there are clear grounds for believing that the master and crew are not familiar with essential shipboard procedures relating to the prevention of pollution by oil. PCSOs observed vessel's crew taking tank soundings through oil purifier drain port instead of tank sounding tube/port. Provide training on tank sounding procedures for all personnel involved in tank sounding operations. MARPOL ANNEX I/11.1

Oil residue tanks shall be of adequate capacity to receive oil residues which cannot be dealt with otherwise IAW the requirement of this Annex; tanks shall be designated and constructed so as to facilitate their cleaning and discharge of residue to reception facilities. PSCOs observed inaccurate tank levels in ORB, when compared to tank sounding. Clean all tanks listed on IOPP and provide accurate tank sounding. MARPOL ANNEX I/12.3.5

The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations. Class society conducted an external ISM Audit on 26/08/2022 with an observation, as the objective evidence (ORBs, ENG Logs, Sounding Records etc.) was in the possession of the USCG. Objective evidence is now in the possession of the Ship/company and available for examination by class. An additional external audit is required to be completed by class to address listed observation and submitted prior to departure from port in order to meet the requirements of deficiency 01 issued on 8/24/2022. 74 SOLAS(2020) IX/3.1 ISM A/10.1

Condition of the ship and its equipment shall be maintained to conform with the provision of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. Vessel's Low Temperature Plate Cooler is leaking due to unsuccessful repair from routine maintenance. Vessel is required to provide class survey upon repair.

A second source of energy shall be provided for an additional three starts within 30 min unless manual starting can be demonstrated to be effective. PSCO found accumulator supply line fitting leaking for ships emergency generator. 74 SOLAS (2009) II-1/44.2 40ac

Lighting fittings shall be so arranged as to prevent temperature rises which could damage the cables and wiring, and to prevent surrounding material from becoming excessively hot. E/R lighting diffuser in way of the shaft generator found melted. 6.1 Each separate circuit shall be protected against short circuit and against overload, except as permitted in regulations 29 and 30 or where the Administration may exceptionally otherwise permit. Emergency fire pump found with multiple loose wiring dead end circuits, not properly terminated. 1.3 All electrical apparatus shall be so constructed and so installed as not to cause injury when handled or touched in the normal manner. Rescue boat launching station found with missing threaded cap for control box connection and live power source. 74 SOLAS (2009cons.) II-1/45. 16ac

The arrangement of ventilation inlets and outlets and other deckhouse and superstructure boundary space opening shall be such as to complement the provisions of paragraph 5.3 and regulation 11.6. PSCO's found CO2 room fixed ventilation opening and harbor crew toilet fixed ventilation opening wasted. SOLAS (2009cons.) II-2/4 5.2.6 50ac

To enable pipes of reception facilities to be connected with the ship's discharge pipeline for residues from machinery bilges and from oil residue (sludge) tank, both lines shall be fitted with a standard discharge connection. PSCO's found port side sludge connection wasted, in way of bunker station. MARPOL 73/78 Annex I/13 SOLAS 74 (2009cons.) I/11 16ac

(c) The ballast water report required by paragraph (b) of this section must include the following information: vessel's total ballast water capacity. PSCO noted reports being submitted to NBIC contained incorrect ballast water tank capacities. Ship to provide amended ballast water report to reflect correct capacities. In addition, local OCMI to review next NBIC submission prior to next arrival. 33 CFR 151.2065(c)(3) 40ac

SOLAS 74(2014) II-1/26. 1 The machinery, boilers and other pressure vessels, associated piping systems and fittings shall be of a design and construction adequate for the service for which they are intended and shall be so installed and protected as to reduce to a minimum any danger to persons on board, due regard being paid to moving parts, hot surfaces and other hazards. II-1/26. 3 Means shall be provided whereby normal operation of propulsion machinery can be sustained or restored even though one of the essential auxiliaries becomes inoperative. Special consideration shall be given to the malfunctioning of: .6 The sources of water pressure Port State Control Officers observed repairs being made while attending vessel, to ballast water/cooling pipe in E/R. A crack was discovered at a connection flange after close up inspection of removed piping and components. System also serves as secondary cooling through cross connections in system. Repairs to be made with report from Class of any findings prior to vessel movement.

Each emergency generating set arranged to be automotically started shall be equipped with starting devices approved by the administation with a stored energy capability of at least ghree consecutive starts. PSCO observed the primary battery start did not start the emergency generator. SOLAS II-1/44.2

THE MACHINERY AND ASSOCIATED FITTINGS SHALL BE OF A DESIGHN ADEQUATE FOR THE INTENDED SERVICE. VESSELS MAIN PROPULSION CONTROLLABLE PITCH PROPELLER SYSTEM DOES NOT FUNCTION AS PER DESIGN. INDICATOR READS ZERO PITCH WHILE VESSEL HAS MOVEMENT ASTERN. 74SOLAS(04) II-1/26.1 17ac

THE CONDITION OF THE SHIP AND ITS EQUIPMENT SHALL BE MAINTAINED TO CONFORM WITH THE PRESENT REGULATIONS TO ENSURE THE SHIP IN ALL RESPECTS REMAINS FIT. SHIP'S PORT SIDE ACCOMODATION LADDER WAS SEVERELY DAMAGED WHILE IN PORT. 74SOLAS(04)I/11a

Structural fire protection shall be kept in good order so as to ensure their required performance if a fire occurred. PSCO observed significant degradation of the vapor barrier in the paint locker. 74SOLAS(14) II-2/14.2.1 50ac

Each life raft shall be stowed with a float free arrangement complying with the requirements of paragraph 4.1.6 of the code so that it floats free. PSCO observed the painter line not connected to the weak link. 74SOLAS(14) II/13.4.2 10c

The means for securing and maintaining weathertightness of hatchway covers shall be to satisfaction of the administration. 01 cargo hold-down device bent and incapable of locking. ICLL (66) I/16 50ac

All electrical apparatus shall be so constructed and so installed as not to cause injury when handled or touched in the normal manner. PSCO observed the protective cover was missing. 74SOLAS(04)II-1/45.1.3 10c

Machinery shall be protected as to reduce to a minimum any danger to persons on board, due regard being given to moving parts. Port State Control Officers observed missing protective machinery cover on the number one and two low temperature cool water pumps in the starboard side of the engine room.

Before the ship leaves port and at all times during the voyage, all life saving appliances shall be in working order and ready for immediate use. Port State Control Officers observed aft free fall life boat engine unable to start. Engineer determined the fault was due to a bad contact on the accumulator battery, and was repaired prior to exam completion. 74SOLAS(14)III/20.2

In cargo ships of 1000 GT and upwards, shall provide fire hoses for each 30m of length of ship. Each hose shall be provided together with any necessary fitting or tools. PSCO observed missing fire hose station at bay 25 portside. PSCO also observed multiple fire hose stations missing spanner wrenches. 74SOLAS(04)II-2/10.2.3 17c

Doors fitted in boundary bulkheads of machinery spaces of category A, shall be reasonably gas tight and self closing. PSCO observed fire doors M03, T04, and T04-1 not self closing. 74SOLAS(04) II-2/9.4.2.1 40ac

No person may cause a vessel to enter into or get underway on the navigable waters of the U.S unless no more than 12 hrs before entering or getting underway, the following equipment has been tested: 1) standby or emergency generator 2) storage batteries for emergency lighting and power systems in vessel control and propulsion machinery spaces 3) main propulsion machinery, ahead and astern. Testing of emergency generator, emergency storage batteries and and main propulsion machinery were not required to be tested in their SMS checklist 7.1.1, 7.1.3, and 7.4.4. 33 USC 1221/33CFR164.25 40c

The means for securing and maintaining weather tightness shall be to the satisfaction of the administration. Arrangements shall ensure that the tightness can be maintained in any sea condition. Anchor chain lockers found with minimal hardware holding access cover in position. ICLL 88P/16(6) 16ac

Efficient guard rails and bulwarks shall be fitted to all exposed parts of the freeboard and superstructure decks. As well as satisfactory means shall be provided for protection of the crew in transiting to and from crew quarters and all parts of ship for necessary work. Substantial wastage was noted on cargo ladders on both port and starboard from bay 1 to bay 29. Fiberglass deck grating also found damaged on port side bay 11, 17, 19, 22. ICLL 88P/25 16ac

All electrical apparatus shall be be so constructed and so in insulated as to not cause injury when handled or touched. Dead end wires found on foc'sle (starboard side,) emergency generator room faceplate, main deck engine junction box, and junction box in vicinity of oily water separator, multiple openings on electricians testing station control cabins in engine control room propped open for temporary cable connection. 74SOLAS(04) II-1/45.1.3 16ac

Cargo ships shall carry at least one rescue boat complying with the regulations of section 5.1 of the code. LSA code 4.4.1.1 states all lifeboats shall be properly constructed and shall be of such form and proportions that they have ample stability assuring no loss of buoyancy material and no other damage. PSCO noted the rescue boat on board had damage on the tip of the bow. 74SOLAS(04)III/31.2 16ac

This regulation is to prevent the ignition of combustible material or flammable liquids. Means shall be provided to control leaks of flammable liquids. The ignitability of flammable material shall be restricted. 1) PSC observed a coating on many electrical cables and wire runs. This coating is unknown to crew and class. Request lab testing of coating substance to determine flammability. 2) The crane hydraulic oil reservoir in steering gear room has oil in the cofferdam, there is no plug in the cofferdam. 74SOLAS(04)II-2/4.1.1 16ac

Associated piping for Machinery shall be of a design and construction adequate for the service for which they are intended and shall be installed and protected to reduce to a minimum any danger to persons onboard, PSCO observed a temporary repair (soft patch) on the water line to the stern tube. 74SOLAS(04)II-1/26.1 16ac

Ships shall be designed, constructed and maintained in compliance with structural requirements of the class society. Approximate 6" crack found aft of port side anchor wash remote operated valve on foc'sle. 74SOLAS(04)II-1/3-1 50ac

The company shall ensure that all personnel involved in the company safety management system, SMS, have an adequate understanding of relevant rules, regulations, codes, and guidelines. PSCO observed several locations in machinery spaces that had electrical equipment tagged out. Lock out, tag out SMS checklist #7.5 was not being followed. In general crew members shared a general lack of understanding of SMS requirements and procedures. Recommended ISM Document of Compliance audit. 74SOLAS(14)IX/3 ISM Code 6.4 50ac

Electrical instillations shall be such that electrical services essential for safety will be ensured under various emergency conditions. PSCO discovered loose connections on backup GMDSS batteries. 74SOLAS(04)II-1/40.1.2 10c

Escape routes shall be maintained in a safe condition, clear of obstacles. PSCO observed a vacuum and a standard sized barrel blocking an escape ladder in the steering gear room. 74SOLAS(04)II-2/13.1.2 10c

Main and emergency switchboards shall be so arranged as to give easy access as may be needed to apparatus and equipment, without danger to personnel. PSCO observed assorted equipment stored behind main switchboard in ECR. 74SOLAS(04)II-1/45.2 10c

The means for securing and maintaining weathertightness of hatchway covers shall be to the satisfaction of the administration. 18 out of 60 cargo hold-down devices were broken and incapable of locking. Vessel requested parts in June, 2019 and followed up in October, 2019 with no response from the company. ICLL(66) I/16 - 17ac

Efficient guard rails shall be fitted to all exposed parts of the freeboard. Vessel had deteriorated and missing sections of rails near the starboard side liferafts and near the bow, cargo hatch 1A. ICLL(66) I/16 - 16ac

The material condition of lagging in the incinerator, fuel purifying, and engine room was degraded and missing. 74 SOLAS (14) I/11 - 16ac

The company and the ship shall comply with the requirements of the ISM Code. The company should establish procedures to ensure the ship is maintained in conformity with relevant rules and regulations. PSCO observed a lack of maintenance for the ship and its equipment, especially regarding the engine room, structural fire protection, and lifesaving equipment. SMS "7.7 Risk Assessment S-07 refers to Safe Work Practices 20.3.2, 20.3.5, and 20.3.6 which requires various maintenance of oil leakages in machinery spaces. Objective evidence revealed through SMS "7.4.1 Daily Tests & Checks" which requires oil leakage inspection (item 1) among other entries and completion must be entered into ships daily logs. Active leaks in engine room do not reflect the checklist is being completed or logged. Recommend ISM Audit. 74SOLAS(14)IX/3.1, ISM A/10.1, 30abc

Means shall be provided to control the leaks of flammable liquids. PSCO observed excessive accumulation of flammable liquids throughout engine room. Pooling was noted all along main engine, IVO two ships generators, and in the bilges. Oil soaked lagging was also observed in several locations. General condition of the engine room posed an immediate fire and safety hazard to the ship and crew. 74SOLAS(14)II-2/4.1.1, 30abc

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed cracked life buoys with crumbling exposed buoyant material, missing plugs, degraded retro-reflective tape, dry-rotted line, and degraded color. PSCO confirmed required weekly and monthly checks are being performed, however buoys were not annotated as being deficient. 74SOLAS(14)III/20.2, 17abc

Structural fire protection (SFP) shall be kept in good order so as to ensure their required performance if a fire occurred. PSCO observed significant degradation of SFP in the CO2 room to include missing insulation, penetration packing falling apart, and worn/missing sections of vapor barrier. 74SOLAS(14)II-2/14.2.1.1.1, 16ac

Each emergency generating set arranged to be automatically started shall be equipped with starting devices approved by the administration. A second source of energy shall be provided for an additional three starts within 30 mins unless manual starting can be demonstrated to be effective. Vessel's hydraulic manual starting was not operational. SOLAS 74(2009) Ch II-1 Reg 44.2 - 17a

Such certificates shall be accepted unless there are clear grounds for believing that the condition of the ship or of it's equipment does not correspond with the particulars of any certificate or that the ship and its equipment are not in compliance. Vessel's Cargo Ship Safety Equipment Certificate Form E states the vessel is equipped with one 20 person life raft, two 26 person life rafts, and two 6 person life rafts required by III/31.1.4 Vessel is equipped with two 20 person life rafts and one 6 person life raft on the bow which does not conform with the Form E. SOLAS 74(2014) Ch I Reg 19(b) - 50a

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. Rescue boat and associated lifting appliances were damaged. 74SOLAS(14) III/20.2 17ac

Guard rails or bulwarks shall be fitted around all exposed decks. Lowest course of guard rail forward of port side davit-launched life raft was found wasted. ICLL (Proto 88) 25/2 50ac

Embarkation stations shall be readily accessible from accommodation stations and work areas. Deck passage forward of the starboard life raft is blocked by spare piping. 74SOLAS(14) III/11.3

Life saving appliances shall be marked with the date by which they must be replaced. All three VHF two-way radios were not replaced by expiration date of January 2019. 74SOALS(14) III/34 Ref. LSA I/1.2.3

The administration shall be satisfied that the performance of the equipment required by chapter V is maintained. Voyage data recorder battery expired February 2019. 74SOLAS(14) V/16.1

Whenever a defect is discovered which substantially affects the efficiency of the equipment covered by Annex I, the master or owner of the ship shall report at the earliest opportunity to the administration or recognized organization, who shall cause investigations to be initiated. The Oily water separator's through-put, according to the oil record book, is approximately 0.2m^3/hr, which is significantly less efficient than the 2.5m^3/hr listed on the IOPP supplement. As a result, the oily bilge water holding tank is almost full, and oily water is being retained in the bilge well below the shaft seal. MARPOL I/6.4.3

All ships of 300 GT and upwards shall have a 9GHz radar. The ship's 9Ghz radar is inoperable. 74SOLAS(14) V/19.2.3.2

Every ship shall be provided with a receiver capable of receiving NAVTEX broadcasts. NAVTEX receiver is inoperable. 74SOLAS(14) IV/7.1.4

Fire-fighting systems and appliances shall be kept in good working order and readily available for immediate use. Vessels emergency firepump is inoperable. Rectify deficiency by 27AUG18, prior to departing Jacksonville. 74SOLAS(04) II-2/14.2.1

Firefighting systems and appliances shall be kept in good working order and readily available for immediate use. Class survey to verify equivalent safe means of firefighting until emergency pump is repaired. Vessel has previously notified Flag and company. USCG Sector Jacksonville must approve plan prior to departing the port. 74SOLAS (04 CON) II-2/14.2.1.2:

Satisfactory means (in the form of guard rails, lifelines, gangways, etc.) shall be provided for the protection of the crew in the necessary work of the ship. Observed numerous grating areas of the deck wasted causing an unsafe condition. Class survey required to verify which gratings are safe or need repair. ICLL 66 Annex I Reg 25

Emergency generator sets shall be equipped with two starting devices unless manual starting can be demonstrated effectively. Only one set of batteries is installed and manual start was inoperable. 74SOLAS (04 CON) II-1/44.2

1410- Propulsion/ Main Engine- Connections within the fuel supply line and spill lines shall be constructed having regard to their ability to prevent prescribed oil fuel leaks while in service and after maintenance. Fuel pump No. 6 was saturated in fuel oil due to changeover from HFO to WLSP. Other fuel pumps were observed without leaks.- 74SOLAS(04)II-2/4.2.2.5.4

1499-Other (Prop. & auxialiary machinery)- Arrangements for the utilization of other flammable oils employed under pressure in heating systems shall be such to ensure the safety of the ship and persons on board. Fuel supply line for oil-fired unit portion of the ship's boiler was leaking at the elbow.- 74SOLAS(04)II-2/4.2.4

0910- Closing devices watertight doors- All access openings in bulkeaheads at ends of enclosed superstructure shall be fitted with weather-tight doors. Weathertight door to SOPEP locker showed daylight when closed around gasket area.- ICLL(88PROTO)REG12

The vessel was issued an inbound letter of deviation due to a in operable S-band radar. While the vessel was in port the X-band radar also became in operable. 74 SOLAS(14)CHI REG 11(a) 17 a.c

The vessel's S-band radar was reported inoperable.
