Machinery and electrical systems must be designed and maintained to provide for safe operation of the towing vessel and safety of persons onboard under normal and emergency conditions. Vessel experienced reduction in required voltage for port and starboard engines resulting in loss of propulsion/equipment failure. Vessel cannot depart until repairs cleared by USCG/TPO.

Notwithstanding the requirements of § 155.5021 of this subpart, a vessel may continue to operate for up to 2 years after the date of submission of a vessel response plan (VRP) pending approval of that VRP, if the vessel has received written authorization for continued operations from the Coast Guard. (b) To receive this authorization, the vessel owner or operator must certify in writing with an original or electronic signature to the Coast Guard that the vessel owner or operator has identified and has ensured, by contract or other approved means, the availability of the necessary private response resources to respond, to the maximum extent practicable, to a worst case discharge or substantial threat of such a discharge from their vessel. (c) Those nontank vessels temporarily authorized to operate under the provisions provided in this section must comply with 33 CFR 155.1070(c), (d), and (e). Vessel does not have an approved NTVRP or written authorization for continued operations from the Coast Guard. Provide NTVRP approval letter or UCCG authorization letter.

External audits for obtaining and renewing a TSMS certificate are conducted through a TPO and must include both management and vessels as follows: (b) Vessel audits. (2)An external audit must be conducted no later than 6 months after the issuance of the initial COI for vessels subject to the owner or managing operator's TSMS that have been owned or operated for fewer than 6 months prior to receiving the initial COI. Vessel has been not been operating under the new managing operator's TSMS. Vessel must complete an external audit within 6 months.

THE OWNER, AGENT, MASTER, OPERATOR, OR PERSON IN CHARGE MUST, WITHIN 5 DAYS, FILE A WRITTEN REPORT OF ANY MARINE CASUALTY REQUIRED TO BE REPORTED UNDER 4.05-1. INCIDENT OCCURED ON 24DEC2021, SUBMIT CG-2692 PRIOR TO MOVEMENT OF VESSEL.

RAILS OR EQUIVALENT PROTECTION MUST BE INSTALLED NEAR THE PERIPHERY OF ALL DECKS ACCESSIBLE TO CREW. VESSEL HAND RAILS ON STARBOARD SIDE 01 DECK DAMAGED PROVIDING INSUFFICIENT FALL PROTECTION FOR PERSONS ON BOARD.

MEANS MUST BE PROVIDED FOR STOPPING EACH FAN IN A VENTILATION SYSTEM SERVING MACHINERY SPACES AND FOR CLOSING, IN CASE OF FIRE, EACH DOORWAY, VENTILATOR, AND ANNULAR SPACE AROUND FUNNELS AND OTHER OPENINGS INTO SUCH SPACES. STARBOARD SIDE EXHAUST STACK VENTILATION DAMPENER DAMAGED AND CANNOT BE CLOSED.

ALL VESSEL EQUIPMENT MUST BE USED IN ACCORDANCE WITH THE MANUFACTURERS RECOMMENDED PRACTICE AND IN A MANNER THAT MINIMIZES THE RISK OF INJURY. STARBOARD SEWAGE VENTILATION GOOSE NECK DAMAGED; AND TEMPORARY REPAIR OF FOAM INSULATION INSTALLED WHERE PREVIOUSLY WELDED TO BULKHEAD.

EACH LIFE BOUY MUST BE MARKED IN BLOCK CAPITAL LETTERS WITH THE NAME OF THE VESSEL. LETTERING WORN OFF ALL LIFE RINGS.

A towing vessel may not be operated without having onboard a valid COI issued by the Coast Guard. Vessel has 30 days to obtain new COI via Coast Guard Option due to non-conformities identified during ISM-DOC audit dated 23-24JAN2020. Vessel 835v is extended till 28MARCH2020 as dirceted by CG HQs due to the authorization of DNV-GL to issue the compnay its temp DOC.

On 31Jul19 the DOC for Bouchard Transportation Co. Inc. was revoked by the USCG. The EVENING BREEZE utilized an existing SMS to obtain an initial COI in accordance with 46 CFR 138.225 and subsequently requires a DOC and SMC. The company must submit a plan of how it intends to be compliant with its issued COI by 29OCT19.

In light of the company's DOC being revoked, the vessel shall not be engaged as a towing vessel as defined in 46 CFR 136.110 until the local OCMI completes a satisfactory Subchapter M compliance inspection.

1. Submit written causal analysis via Class Surveyor for securing 2 of 3 generators.

2. Repair secured generators to satisfaction of Class Surveyor [name withheld] report to USCG Marine Inspector to clear. 701 AC.

3. Vessel must schedule and complete USCG Subchapter M survey within 15 days or vessel will be restricted from tug operations.
