"Non-tank vessels subject to this subpart may not operate upon the navigable waters of the United States unless in compliance with a vessel response plan (VRP) approved under §155.5065." There is no evidence of a submitted or approved Non-Tank Vessel Response Plan. This creates a serious operational deficiency in that the vessel and crew are not provided the proper oil spill response plan in the event of such an emergency. Submit the necessary information for plan approval per the process outlined in 33 CFR 155.5065. Vessel may not move, any movement requires transit plan approval. 33 CFR 155.5015

Since no non-tank vessel response plan was submitted, identify the gap in the company's safety management system (SMS) that allowed the confusion of non-tank vessel response plan applicability, and ensure this gap is written down and addressed to prevent future incidents. Provide this completed SMS portion to both your TPO (ABS) and our office for review within 14 days. 46 CFR 138.220(c)
