TURBULENCE

The company and the ship shall comply with the requirements of the International Safety Management Code. For the purpose of this regulation the requirements of the code shall be treated as mandatory. The company should establish procedures to ensure that the ship is maintained in accordance with the provisions of the relevant rules and regulations established by the company. The technical and/or operational nature of the deficiencies noted below provide objective evidence of a serious failure of the implementation of the ISM Code. An external ISM audit report, satisfactory to the Coast Guard, must be submitted prior to clearance of this deficiency and departure. 74 SOLAS (2024) IX/3.1 ISM Code A/10.1 Code 30bc

All required fire detection systems shall be capable of automatically indicating the presence or indication of fire and also its location. The fire detection panel was previously found deficient on 21 December 2025. On this date, the panel was found faulting again, and multiple smoke and heat detectors were disconnected in machinery and accommodation spaces including the engine room, galley, mess room, and crew cabins. The crew reported the panel had been faulting for a week, but no non-conformity report was submitted to the company. 74 SOLAS (Unamend) II-2/13(i) Code 30bc

Where the emergency source of electrical power is a generator, it shall be started automatically upon failure of the main source of electrical power supply unless a transitional source of emergency electrical power in accordance with paragraph 3.1.3 is provided. The emergency generator (built in 2007) was manufactured with an automatic start function which was in the Off position. When questioned, the Chief Engineer informed the PSCOs that this function was inoperable. No non-conformity report was submitted. 74 SOLAS (04) II-1/43.3.1.2 Code 30bc

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. During the operational test of the emergency generator, the RPM, oil pressure, and jacket water temperature gauges were inoperable. No non-conformity report was submitted. 74 SOLAS (04) I/11(a) Code 30bc

A fireman's outfit shall consist of: (b) A breathing apparatus of an approved type which may be either: (ii) a self-contained breathing apparatus which shall be capable of functioning for a period of time determined by the Administration. SCBA bottles were removed for servicing without replacements to remain readily available for immediate use. When asked how long these would remain unavailable, the crew stated at least three days. 74 SOLAS (Unamend) II-2/14(b)(ii) Code 30bc

Sanitary accommodation shall comply with the following requirements: cold fresh water and hot fresh water available in all wash spaces. Multiple wash basins had no running hot or cold water. When questioned, the crew stated that this was due to the freshwater pump overheating, which was reported to the company on 15FEB2026. Additionally, the crew stated that the vessel has not had running hot water for approximately five years when the water heater fitted on board was removed and never replaced. 46 U.S.C. § 70002 PWSA and ILO-147 Crew Accommodation/Sanitary Facilities/Paragraph 21(c) Code 17bc

Sanitary accommodation shall comply with the following requirements: water closets provided with an ample flush of water, available at all times and independently controlled. Multiple toilets on board did not flush properly. When questioned, the crew stated that this was due to an inoperable salt water pump which was reported to the company on 06FEB2026. In the interim, the crew was utilizing the freshwater pump to provide water to the toilets. However, on 15FEB2026 the crew reported to the company that the freshwater pump became inoperable. Currently, the crew is utilizing buckets of water to flush toilets. 46 USC 70002 PWSA and ILO-147 Crew Accommodation/Sanitary Facilities/Paragraph 21(f) Code 17bc

At least two of the lifebuoys provided with self-igniting lights in accordance with paragraph (e) of this Regulation shall also be provided with an efficient self-activating smoke signal. The starboard side quick release lifebuoy was not provided with a self-activating smoke signal. 74 SOLAS (Unamend) III/21(g)

The (international shore) connection shall be kept aboard the ship together with a gasket of any material suitable for 150 lbs. per square inch service, together with four bolts and eight washers. The international shore connection was missing gasket material and four of the eight required washers. Additionally, one of the bolts provided was bent. 74 SOLAS (Unamend) II-2/5(h) Code 16bc

After any survey of the ship under paragraph 1 of this regulation has been completed, no change shall be made in the structure, equipment, systems, fittings, arrangements or material covered by the survey, without the sanction of the Administration, except the direct replacement of such equipment and fittings. There was a valve and flexible hose installed on the discharge piping, after the recirculation valve on the oily water separator, which appeared to be modifications made to the system after installation. Vessel could not provide documentation of Flag State approval for these modifications. MARPOL I/6.4.2 Code 16bc

A ship, except a ship of less than 26 feet in length, must have a placard of at least 5 by 8 inches, made of durable material fixed in a conspicuous place in each machinery space, or at the bilge and ballast pump control stations stating that the discharge of oil or oily waste into or upon the navigable waters of the United States is prohibited. The required oil discharge placard was missing. 33 CFR 159.59 Code 16bc

The duties shown by the muster list in relation to the extinction of fire pursuant to sub-paragraph (e)(vi) of this Regulation shall include particulars of: the manning of the fire parties assigned to deal with fires. During the fire drill, only one crew member donned a firefighter’s outfit; however the muster list required a firefighter’s outfit to be donned by two crew members. The drill was performed a second time and found to be satisfactory. 74 SOLAS (Unamend) III/25(g)(i) Code 10c

The sample is to be sealed and signed by the supplier’s representative and the master or officer in charge of the bunker operation on completion of bunkering operations and retained under the ship’s control until the fuel oil is substantially consumed, but in any case for a period of not less than 12 months from the time of delivery. The crew was only able to provided fuel oil samples for the previous five months. MARPOL VI/18.3.8.1 Code 10c

PSCO observed a fault on zone no.1 of the fire control panel. Panel had a continous audible and visual alarm through the duration of the exam. 74 SOLAS II-2/13(i) Code 17

For ships constructed before 1 July 1998, the Administration shall: ensure that when life-saving appliances or arrangements on such ships are replaced or such ships undergo repairs, alterations or modifications of a major character which involve replacement of, or any addition to, their existing life-saving appliances or arrangements, such life-saving appliances or arrangements, in so far as is reasonable and practicable, comply with the requirements of this chapter. However, if a survival craft other than an inflatable liferaft is replaced without replacing its launching appliance, or vice versa, the survival craft or launching appliance may be of the same type as that replace. With the exception of the secondary means of launching for free-fall lifeboats, each launching appliance shall be so arranged that the fully equipped survival craft or rescue boat it serves can be safely launched against unfavourable conditions of trim of up 10 degrees and list of up to 20 degrees either way: when boarded, as required by regulation III/23 or III/33, by its full complement of persons. The vessel was fitted with a new rescue boat in 2001, however, the launching appliance (davit) was not updated to meet LSA Code requirements. 74 SOLAS (2024) III/1.4.2 LSA Code 6.1.1.1.1 Code 30bc

For ships constructed before 1 July 1998, the Administration shall: ensure that when life-saving appliances or arrangements on such ships are replaced or such ships undergo repairs, alterations or modifications of a major character which involve replacement of, or any addition to, their existing life-saving appliances or arrangements, such life-saving appliances or arrangements, in so far as is reasonable and practicable, comply with the requirements of this chapter. However, if a survival craft other than an inflatable liferaft is replaced without replacing its launching appliance, or vice versa, the survival craft or launching appliance may be of the same type as that replace. Each rescue boat launching appliance shall be fitted with a powered winch motor capable of raising the rescue boat from the water with its full rescue boat complement of persons and equipment at a rate of not less than 0.3 m/s. The rescue boat davit is not fitted with a powered winch motor capable of raising the rescue boat from the water. 74 SOLAS (2024) III/1.4.2 LSA Code 6.1.1.9 Code 30bc

The Administration may, if it considers that the sheltered nature and conditions of the voyage are such as to render the application of any specific requirements of this chapter unreasonable or unnecessary, exempt from those requirements individual ships... which, in the course of their voyage, do not proceed more than 20 miles from the nearest land. The Administration issued an exemption certificate for the rescue boat and the launching appliance. However, the vessel cannot sail to Miami, FL without proceeding more than 20 miles from the nearest land. Moreover, the SOLAS Cargo Ship Safety Equipment certificate states that an exemption has not been issued. 74 SOLAS 2024 III/2.1 Code 30bc

The machinery, associated piping and fittings shall be of design and construction adequate for the service and shall be installed and protected as to reduce any danger to the persons on board. The exhaust piping for the main generator engine was leaking exhaust gasses into the engine room. 74SOLAS (81 Amendments) II-1/26 Code 17bc

Satisfactory means (in the form of guard rails) shall be provided for the protection of the crew in the necessary work of the ship. The starboard second course guard railing was wasted. ICLL 25(4) Code 40bc

A daylight signaling lamp or other means, to communicate by light during day and night using an energy source of electrical powernot solely dependent upon the ships power supply. A secondary source of power for the Aldis lamp was insufficient to operate the lamp. 74 SOLAS (20) V/19.2.2.2

The company should establish procedures to ensure that the ship is maintained in accordance with the provisions of the relevant rules and regulations established by the company. The operational nature of the deficiencies 02 and 03, provide objective evidence of a serious failure of the implementation of the ISM Code. An external audit report satisfactory to the OCMI must be submitted prior to the clearance of this deficiency.

The officer in charge of the navigational watch shall not hand over the watch to the relieving officer if there is reason to believe that the latter is not capable of carrying out the watchkeeping duties effectively, in which case the master shall be notified. The watchkeeping deck rating assumed navigation watch without meeting the requirements of STCW, Ch. 2, A-II/1.

All persons who are assigned duty as officer in charge of a watch or as a rating forming part of a watch and those whose duties involve designated safety, prevention of pollution and security duties shall be provided with a rest period of not less than 77 hours in any 7-day period. PSCO’s identified that there are insufficient qualified deck officers in charge of navigation watch and engineering officers in charge of an engineering watch to permit the required rest periods of not less than 77 hours in any 7-day period. The minimum safe manning certificate only requires two qualified deck officers and one qualified engineering officer.

PSCO identified a leak on the main diesel engine’s salt water cooling pump.

Where the cables are neither sheathed nor armored and there might be a risk of fire on the event of an electrical fault, precautions shall be required by the Administration. PSCO identified an improper electrical connection with an internet router located in the engine room.

The company and the ship shall comply with the requirements of the international safety management code. For the purpose of this regulation, the requirements of the code shall be treated as mandatory. The technical and/or operational nature of deficiencies 02, 03, 04, and 05 indicate a serious failure, or lack of effectiveness, of the implementation of the ISM Code. A safety management audit carried out by the Administration or the RO, with a corresponding report of findings satisfactory to the OCMI must be submitted prior to clearance of this deficiency and release from detention. 74 SOLAS (20) IX/3.1 ISM Code Part A/10.1

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for use. The rescue boat is kept with the engine off the boat while underway and would not start once connected to the rescue boat. 74 SOLAS (01) III/20.2

The bilge in the engine room was found with excess oil creating a hazardous environment to the ship and persons on board. 74 SOLAS (20) 1/11(a)

Each fire drill shall include checking of relevant communication equipment. PSCO observed no means of operational communication during the fire drill. 74 SOLAS III/19.3.4.2.4

Ships shall be fitted with a system to automatically transmit the information specified in paragraph 5 of this part. The vessel does not have a valid LRIT Conformance Report. 74 SOLAS (20) V/19-1.4.1

If it is intended to operate the quick-release arrangement provided for the self-activated smoke signals and self-igniting light, have a mass of not less than 4 kg. PSCO observed life buoys with only a weight of 2.5 kg. 74 SOLAS (20) III/32.1.1 LSA 2.1.1.7

If a ship has any watch or workstations which are located remotely from the place where immersion suits are usually stowed, immersion suits of an appropriate size shall be provided at these locations for the number of persons normally on watch. No immersion suits were stowed on the bridge for watch standers. 74 SOLAS (20) III/32.3.3

An immersion suit that had buoyancy and is designed to be worn without a life jacket shall be fitted with a light complying with the requirements of paragraph 2.2.3. The immersion suit kept in the engine room was found missing a light. 74 SOLAS (20) III/32.3.3.1 LSA 2.3.1.4

Hoses specified in this Chapter as “fire hoses” shall together with any necessary fittings and tools be kept ready for use in conspicuous positions. PSCO observed no means of necessary tools stored with fire hose to secure fitting. 74 SOLAS(81) II-2/4.7.7.1

For each breathing apparatus a fireproof lifeline of sufficient length and strength shall be provided capable of being attached by means of a snap hook to the harness or separate belt. Vessel could not prove the lifeline was made of fireproof materials. 74 SOLAS (81) II-2/17.2

The ring, lines, and letters shall be painted in white or yellow on a dark ground. The deck line was not visible and is painted the same color as the hull. ICLL 66 Regulation 8

The hydraulic line for the steering system is damaged due to it chafing against a nameplate causing a gash in the line. 74 SOLAS (20) 1/11(a)

PSCO requested crew test steering loss of power alarm and crew stated the alarm did not exist despite it listed as an alarm on the Bridge. 74 SOLAS (20) 1/11(a)

Each operation described in paragraph 2 of this regulation shall be fully recorded without delay in the Oil Record Book Part I, so all entries in the book appropriate to that operation are completed. The entries regarding the OWS were missing amount moved between bilge and holding tank, and destination was incorrect. MARPOL Annex I/17.4

The bunker delivery note shall be accompanied by a representative sample of the fuel oil delivered...and retained under the ships control until the fuel oil is substantially consumed, but in any case, for a period for not less than 12 months from time of delivery. The vessel had no fuel samples available. MARPOL Annex 6/18.8.1

The operator of a vessel with a capacity of 250 or more parrels of oil shall provide transfer procedures that meet the requirements of this part and part 156 of this chapter for transferring to or from the vessel. The vessel did not have transfer procedures available to meet this part. 33 CFR 155.720

Subject to the provisions of regulation I/10, paragraph 5, any certificate required by the convention must be kept in its original form on board the ship with the holder is serving. All crew members had photocopied versions of their flag endorsements. STCW I/2.11

The owner, master, or person in charge of each vessel underway shall ensure that the vessel’s anchors are ready for letting go. The vessel is missing the port anchor. 33 CFR 164.11(o)

All ships of 500 gross tonnage and upwards shall have...a gyro-compass bearing repeater, or other means, to supply heading information visually at the emergency steering position if provided. There is no means to supply heading information at the emergency steering position. 74 SOLAS (20) V/19.2.5.2

On all ships within the machinery spaces, EEBDs shall be situated ready for use at visible places. The EEBD on the harbor generator space had no charge. 74 SOLAS (20) II-2/13.4.3.1

All lifesaving appliances in this part shall be fitted with retro-reflective material where it will assist in detection. The stern ring buoy was found with the retro-reflective tape worn and non-reflective. 74 SOLAS (20) III/32.1.1 LSA 1.2.7
