This letter sets forth conditions of operation….” Marine Inspector observed foam blocks established by the current stability letter to be not properly installed. Outfit vessel with foam block arrangement in accordance with the vessel’s current stability letter. 46 CFR 170.120

(a) “All electrical installations shall be to the satisfaction of the Officer in Charge, Marine Inspection.” Marine Inspector identified a bolt at the air induction for the forward generator that was sticking out unable to be tightened due to stripped threads. 46 CFR 183.05 OLD T

“Batteries shall be located as high above the bilge as practicable and secured against shifting with motion of the boat….” Marine Inspector identified battery installation not properly secured under the bridge console. 46 CFR 183.05-20 OLD T

“A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. For equivalent kits, the contents must be stowed in a suitable, watertight container that is marked “First-Aid Kit”. A first-aid kit must be easily visible and readily available to the crew.” Marine Inspector identified expired first aid kits onboard. Outfit vessel with first aid kits that are not expired. 46 CFR 121.710

“Twist-on type connectors may not be used for making joints in cables, facilitating a conductor splice, or extending the length of a circuit.” Marine Inspector identified twist on type connectors (wire nuts) all around vessel including, but not limited to under the pilot house and behind the DJ booth on the uppermost deck. 46 CFR 120.340

“Installation of diesel engine exhaust pipe shall be in accordance with § 182.15-20...Exhaust piping shall be led to the point of escape with a minimum number of bends or elbows. It shall be gastight throughout its length and shall be properly supported by noncombustible hangers or blocks.” Marine Inspector identified exhaust leak by the starboard exhaust stack on the 1st deck. Determine source of leak and provide repair plan. 46 CFR 182.20-20 OLD T; 46 CFR 182.15-20 OLD T

“Air-cooled propulsion and auxiliary engines installed below deck as permitted by § 182.20-10 shall be fitted with air intake ducts or piping from the weather deck. The ducts or piping shall be so arranged and supported to be capable of safely sustaining stresses induced by weight and engine vibration and to minimize transfer of vibration to the supporting structure…” Marine Inspector Identified natural ventilation gooseneck by the starboard exhaust stack to be not connected. Outfit vessel with connection to the existing gooseneck. 46 CFR 182.20-45 OLD T

"(b) The minimum number of mariners holding a license or MMC officer endorsement as mate required to be carried on... every inspected, seagoing, passenger vessel must not be less than the following,...(4) All vessels of less than 100 GRT—one mate (except vessels on voyages not exceeding 12 hours in duration may, if the OCMI determines it to be safe, be operated without mates)." "...The recommended experience for the SENIOR DECKHAND is:1. 30 days experience on board the vessel. 2. 30 hours at the helm under supervision of a master or mate... thevessel's master should designate the SENIORDECKHAND in writing and a copy of this designation should be retained on board the vessel." To operate without req'd mate within SEC NY, OCMI requires full compliance with NVIC 1-91. USCG MI observed no designation letter onboard or logs of req'd training for the crew identified as senior deckhands. 46 CFR 15.810; NVIC 1-91

"The general construction of the vessel shall be such as to minimize fire hazards insofar as reasonable and practicable." USCG MI observed several trash bins constructed of plastic, a petroleum product. Replace bins with suitable incombustible material such as metal to mitigate fire hazards. 46 CFR 177.10-5 OLD T

"(b) Portable fire extinguishers shall be installed and located to the satisfaction of the Officer in Charge, Marine Inspection." Mount fire extinguisher on the bridge. 46 CFR 181.30-10 OLD T

"(b) Gages to indicate engine cooling water discharge temperature and lubricating oil pressure shall be provided..." Engine cooling water temperature gauge not operational on the stbd generator. 46 CFR 182.20-5(b) OLD T

"Propulsion machinery shall be suitable in type and design for propulsion requirements of the hull in which it is installed..." The reduction gear's oil gauge is not suitably mounted to a bracket. 46 CFR 182.05-1

Grind out and re-weld the underside of the insert in the male head under the toilet. The top of the weld was not inspected and will require inspection prior to clearing. If the top side of the weld is in similar shape as the underside. The insert should be ground out and re-welded on both sides to the satisfaction of the attending marine inspector. Prior to credit DD.

Make full repairs as discussed to the crack discovered in the bow rub rail. A new piece of U-channel shall be fitted and welded in place. Prior to credit DD.

Grind down and fill small hole in the rub rail decking by the bow. The area should be cleaned and inspected by the attending marine inspector prior to any paint in the area. Prior to credit DD.

Crop out and replace 5 brackets and decking as identified along the Port side rub rail. Once the brackets are fitted the area shall be made available to the attending marine inspector prior to fitting the deck plating. Prior to credit DD.

Gauge area identified along the centerline just aft of the centerline keel cooler to determine steel thickness. Report finding to the attending marine inspector. Prior to credit DD.

Remove interior bulkhead covering and crop and renew steel on the STBD transom where a 16" long hole was discovered along the deck plating. The area shall be cropped to good steel as discussed and fit-up made available for inspection to the attending marine inspector prior to final welding. Prior to credit DD.

The hole discovered in the STBD rudder post shall be cleaned-out to bare metal and filled. Once filled the area shall be made available to the attending marine inspector prior to painting. Prior to credit DD.

The old sewage discharge hole on the STBD side shall be cropped and renewed with an approx. 18"xl8" insert. The interior bulkhead coverings shall be removed and a fitup shall be proven to the attending marine inspector prior to final welding. Prior to credit DD.

In the Laz, the 1st and 2nd longitudinal above the chine on the Port side shall be cropped and renewed where marked or to good metal. The longitudinals shall be made available to inspect the final welds. Prior to credit DD.

In the Laz, 05 gussets were missing and shall be replaced along the port side of the forward bulkhead. Once welded, the final welds shall be made available for the attending marine inspector. Prior to credit DD.

In the Laz, along the portside overhead, two longitudinals near the forward bulkhead were discovered to be cropped out and never replaced. The longitudinals shall be re-welded in place and final welds made available for the attending marine inspector.

In the Laz, the longitudinal just aft of the sewage tank port-side edge shall be cropped and renewed where marked or to good metal. The longitudinal shall be re-welded in place and final welds made available. Prior to credit DD.

In the Laz, the STBD #5 longitudinal (from centerline) shall be cropped and renewed where marked or to good metal. The longitudinal shall be re-welded in place and final welds made available for the attending marine inspector. Prior to credit DD.

In the Laz, The STBD #6 (from centerline) (tall structure member) shall be cropped where marked or to good metal. Once the area is cropped, a fit-up shall made available for the attending marine inspector prior to final welds. Prior to credit DD.

In the Laz, the STBD #7 longitudinal (from centerline) shall be cropped and renewed where marked or to good metal. The longitudinal shall be re-welded in place and final welds made available for the attending marine inspector. Prior to credit DD.

In the Laz, the STBD #7 vertical frame (from the centerline) on the forward bulkhead shall be cropped and renewed where marked or to good metal. The longitudinal shall be re-welded in place and final welds made available for the attending marine inspector. Prior to credit DD.

In the Laz, the #8 longitudinal (from centerline) shall be cropped and renewed where marked or to good metal. The longitudinal shall be re-welded in place and final welds made available for the attending marine inspector. Prior to credit DD.

Vessel shall be safe from electrical shock of personnel. On 2/5/2020, a USCG Marine Inspector received a shock while touching the hull of the M/V QUEEN OF HEARTS. Determine the cause of the electrical shock and effect necessary repairs to satisfaction of attending Marine Inspector. 46 CFR "Old T" 183.01-5

All conductors shall be of the stranded type. Replace or remove any solid core wiring found. Any replacement wires must comply with 46 CFR 120.240. -46 CFR "Old T" 183.05-45(b) -46 CFR 120.115(c)

Wiring joints and splices shall be mechanically secure. Any splices found that are not made with a mechanical connection shall be redone or removed. New splices need to comply with 46 CFR 120.340. -46 CFR "Old T" 183.01-5 -46 CFR 120.115(c)

Each grounding wire shall have green insulation. If a existing grounding wire that is not green is found, it shall be marked at both ends with green tape. -46 CFR 120.372(d)

Remove "dead end" wires from all distribution panels, switch-boards, junction boxes, etc to the satisfaction of attending Marine Inspector. -46 CFR "Old T" 183.01-5

Illegal pigtail/shoretie found connected to engine room 110V/220V panel. Corrected on the spot. -46 CFR "Old T" 183.01-5

Conduct casualty analysis report, repair transmission clutch actuator and conduct sea trials to the satisfaction of a USCG Marine Inspector. 46 CFR 155.840

Starboard MDE has oil leak. Make permanent repairs to MDE.

Observed multiple electrical hazards in engine room; loose wires, dead end wires, loose/disconnected conduits, missing protective covers for breaker panel in galley, and multiple daisy-chained electrical extension chords. Make proper repairs to all electrical issues identified.

Conduct satisfactory bilge pump and bilge system test in the presence of a Coast Guard Marine Inspector.

Found loose pressure gauge on the 471 Generator. Properly secure loose pressure gauge.

Found numerous life jackets with improper vessel name marking. Properly mark life jackets with full vessel name.

Provide heat resistant specs for fuel sight gauges located on the port and starboard fuel tanks. If unable to provide specs, install heat resistant sight gauges with adequate protection to prevent damage to sight gauge. Fuel sight gauges must have automatic shut off devices in case of fuel line rupture.

Observed electrical panel cover located in concession stand on main deck have "zipties" as hinges. These ziptie hinges must be removed and replaced with proper hinges.

The bilge suction head located in Void 1C is missing bilge strainer. Install bilge strainer.

The hertz meter gauge located on the main switch board panel for service generator is not working. Repair/replace non functional hertz meter.

Space storing carbon dioxide is missing proper warning sign. Place proper warning sign where carbon dioxide is stored i.a.w. 46 CFR 122.612(i)(1).

BILGE HIGH LEVEL ALARM IS NOT SECURELY ATTACHED. CITE: 46CFR182.530

THE VESSEL QUEEN OF HEARTS IS A SPV-TL, THEREFORE NOT REQUIRED A SAFETY MANAGEMENT SYSTEM (SMS) PER REGULATION. SECTOR NY HAS FOUND THE FOLLOWING DEFICIENCIES TO BE OBJECTIVE EVIDENCE THAT A SERIOUS SUBSTANDARD CONDITION HAS NOT BEEN PRO-ACTIVELY MANAGED BY THE VESSEL'S OWNER/OPERATOR, LEADING TO A LACK OF SAFETY CULTURE ONBOARD THE VESSEL.

REPAIRS OR ALTERATIONS TO THE HULL, MACHINERY, OR EQUIPMENT THAT AFFECT THE SAFETY OF THE VESSEL MUST NOT BE MADE WITHOUT THE APPROVAL OF THE COGNIZANT [name withheld] DISCOVERED IN LAZARETTE SPACE. VESSEL ENGINEER INITIALLY DENIED KNOWLEDGE OF UNAUTHORIZED REPAIR. UPON FURTHER QUESTIONING, HE ADMITTED TO KNOWLEDGE OF FLOODING AT THE RATE OF 3 CUPS PER MINUTE AND APPLYING AN UNAUTHORIZED EPOXY PATCH TO THE RUPTURE OOA 3 WEEKS AGO. NO REPAIR PLANS WERE SUBMITTED TO THE [name withheld] TEMPORARY REPAIR PROPOSAL AND TRANSIT PROPOSAL DELINEATING THE ROUTE AND MEASURES THAT WILL BE TAKEN ONBOARD TO ENSURE A SAFE TRANSIT, INCLUDING MITIGATING PROGRESSIVE FLOODING, TO A LOCAL SHIPYARD FOR PERMANENT REPAIRS.

WHENEVER THERE IS A HAZARDOUS CONDITION ONBOARD THE VESSEL, THE OWNER, MASTER, AGENT OR PERSON IN CHARGE SHALL IMMEDIATELY NOTIFY THE CAPTAIN OF THE PORT. NO REPORTS WERE MADE TO THE CAPTAIN OF THE PORT FOR THE RUPTURE LOCATED IN THE LAZARETTE SPACE. VESSEL ENGINEER ADMITTED TO KNOWLEDGE OF STEEL RUPTURE.

THE BILGES AND OTHER SPACES MAY BE EXAMINED TO SEE THAT THERE IS NO EXCESSIVE ACCUMULATION OF OIL THAT MIGHT CREATE A FIRE HAZARD. EGREGIOUS ACCUMULATION OF APPROX. 2 GALLONS OF OIL DISCOVERED IN ENGINE ROOM BILGES. VESSEL REQUIRED TO PROVIDE CAUSAL ANALYSIS FOR SOURCE, EFFECT REPAIR, AND REMOVE OIL FROM ALL BILGES FOR INSPECTION.

AT EVERY VESSEL INSPECTION, QUARTERS, TOILET AND WASHING SPACES, GALLEYS, SERVING PANTRIES, LOCKERS, AND SIMILAR SPACES MAY BE EXAMINED TO DETERMINE THAT THEY ARE SERVICEABLE AND IN A SANITARY CONDITION. ALL AFOREMTIONED SPACES WERE FOUND TO BE IN DISARRAY AND IN AN UNSANITARY CONDITION. VESSEL MUST ENSURE ALL SPACES ARE CLEAN AND ORGANIZED TO MITIGATE THE RISK OF ENDANGERMENT TO CREW AND PASSENGERS. MAKE READY FOR INSPECTION.

ALL OBSERVED UNSAFE PRACTICES, FIRE HAZARDS AND OTHER HAZARDOUS SITUATIONS MUST BE CORRECTED. ALL 6 PORTABLE EXTINGUISHERS AND THE INSTALLED FIRE SUPPRESSION SYSTEM WERE DELINQUENT ON SERVICING AS OF JUNE 2019. ALL FIRE SAFETY EQUIPMENT MUST BE SERVICED TO INCLUDE A SATISFACTORY TEST OF INSTALLED FIRE PROTECTION SYSTEM.

ALL OBSERVED UNSAFE PRACTICES, FIRE HAZARDS AND OTHER HAZARDOUS SITUATIONS MUST BE CORRECTED. NUMEROUS ELECTRICAL HAZARDS EXIST ONBOARD INCLUDING DAISY-CHAINED POWER CORDS, EXPOSED WIRING IN ENCLOSURES, AND EXPOSED DEAD END WIRES IN LIGHTING. VESSEL MUST REMOVE DAISY-CHAINED POWER CORDS, PLACE DEAD COVERS IN ALL ENCLOSURES AND PLACE ALL EXPOSED WIRING IN AN ENCLOSURE.

Vessel subject to hull inspection for superstructure and similar arrangements. Vessel stbd quarter damaged during docking maneuvers. Prepare and submit for approval repair plan to CG Marine Inspectors. Approval must be given prior to starting work.

Prepare and submit repair plan for two threaded openings in lazarette space (one port and one stbd).

Minimum capacity of fire pump shall be 50 gallons per minute at a pressure not less than 60 psi. Upon testing operation of vessels fire pump, the pumps psi gauge was reading a consistent 38 psi.

Spaces containing flammable and combustible materials must have a fixed fire extinguishing system. Flammable and combustible materials were found throughout the vessel in unprotected spaces.

Vessel must have on board alcohol test strips . Alcohol test strips were expired.

Vessel more than 65 ft must carry on board 03 lifebuoys of 24 inches IAW 46 CFR 160.050 of Subchapter Q. One of vessel's lifebuoys had a hole and all of vessels lifebuoy lanyards are not of an approved type.

Tubular sight glasses must be of heat resistant materials and have connections with devices that automatically close in the event of rupture. The port side fuel tank sight glass is not connected at all. It is wrapped around the port cover with a rag stuffed in the end. The connection devices do not automatically close. Rubber tubing used as sight glasses has not been proved to be heat resistant.

MI identified a sewage leak in the toilet facility area. Toilet facility area is not in a sanitary condition.

MI identified unsafe conditions throughout the vessel. A/C compressor units are not secured.

Vessels fire detection system must comply with the regulations of this part. Vessels fire detection panel was displaying a troubleshooting alarm and crew was unable to rectify.

Vessel must carry a first aid approved under 160.041 of Subchapter Q or a kit with equivalent contents or instructions. Vessel did not have an approved type first aid kit.

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without approval from the cognizant OCMI. Vessel installed welding wire and LED lights and has changed the location/configuration of battery banks located in the engine room. Vessel is to submit an electrical line drawing to the OCMI and MSC for review and approval.

An adult life jacket must be provided for each person on board the vessel. 8 life jackets were found to have deteriorated retro material. Total persons allowed is 416.

On a vessel on which the number of passengers permitted on upper decks is limited by stability criteria, the maximum number of passengers allowed must be indicated by a durable marking at least 1 inch at the entranceway to that deck. Vessel did not have markings for 2nd and 3rd deck, both are limited by stability criteria.

All wires and cables must be ran as high as practical above the bilges. Battery cables were ran on the deck through out the bilges in the engine room.

At each inspection bilges and other spaces may be examined for excessive accumulation of oil, trash , and debris that might create a fire hazard, clog bilge pumping system, or block emergency exits. There was an excessive amount of oil and debris found in the engine room bilges.

At each inspection all observed unsafe practices or hazardous situations must be corrected. The aft stairs are not bolted down or secured.

Portable watertight containers for distress flares and smoke signals shall be clearly marked "DISTRESS SIGNALS". Vessel's portable container was unmarked.

At each inspection, inspection of all accessible parts of the exterior and interior of the hull, watertight and weather-tight bulkheads and decks shall be prepared. The bulkhead to the forward deck is not weather-tight. There is a penetration from an ice machine line.

Piping conveying vapor, gas, or liquid of which temperature exceeds 150 degrees F must be insulated to prevent injuries. The exhaust piping on the port MDE is not fully insulated. It is only partially insulated.

The cognizant OCMI may require any additional tests or inspections to determine that the vessel and its equipment are suitable for intended service. A significant flex in the deck located on the 2nd deck next to the balcony, port side was identified. Vessel is to sand down area and make ready for inspection for the attending marine inspector.

Vessel has an expired VSP. Vessel is restricted to 150 passengers until provide vaild VSP.

Remove wooden storage doors and replace with steel as original.

Vessel is past due for drydock inspection and is restricted from carrying passengers until credit drydock is completed by CG Marine Inspector.

Complete first annual inspection prior to carrying passengers.

Prove processing of Certificate of Documentation application from NVDC.
