An existing vessel may be deemed by the OCMI, or TPO, to be in compliance with this subpart provided that the vessel has been both in satisfactory service insofar as structural adequacy is concerned and does not cause the structure of the vessel to be questioned by either the OCMI, or TPO engaged to perform an audit or survey. Following report of grounding, vessel will complete damage survey to the satisfaction of ABS.

Navigational safety equipment that fails during a voyage must be repaired at the earliest practicable time. The owner, managing operator, or master must consider the state of the equipment (along with such factors as weather, visibility, traffic, and the dictates of good seamanship) when deciding whether it is safe for the vessel to proceed. Vessel will provide tests of all navigational equipment to the satisfaction of ABS.
