The port side cargo pump room has a prime mover where the shaft penetrates a gas tight bulkhead. The approved Hazardous area plan indicates that this bulkhead is required to be gas tight due to the prime mover’s distance from pipe flanges and the cargo pump installation on deck. This penetration must be gas tight, currently the gasket material for this boundary is broken apart. Replace the gasket system with materials in kind to return the bulkhead and the shaft penetration to gas tight condition. Provide the CG with evidence of completion. To be corrected prior to placing the prime mover back in operation.

The vessel previously requested and was issued MARPOL Annex I and II documents to allow for service outside of the Great Lakes. For MARPOL certificates to remain valid all applicable regulations in MARPOL must be followed. The vessel does not have an approved Shipboard Marine Pollution Emergency Plan (SMPEP), and/or Shipboard Oil Pollution Emergency Plan (SOPEP) as required by MARPOL Annex II reg 17, and ANNEX I Reg 37, as the vessel is approved for the carriage of Noxious Liquid Substances and oil products. Submit a SMPEP/SOPEP to the CG’s Marine Safety Center for review and approval. Until such plan is approved the vessel MAY NOT operate outside of the Great Lakes. This issue is to be resolved within 60 days or the MARPOL documents may be surrendered.

Vessels Dry-Dock Exam dates have expired. Vessel is prohibited from conducting cargo operations or transporting cargo for hire and must complete a credit dry-dock examination as required by 46 CFR 91.40-3. All cargo tanks shall be opened and certified as gas free. Owner/operator must contact and schedule an underwater hull survey with the cognizant OCMI. In order to clear this requirement and for credit all inspections, tests, repairs, shall be completed satisfied by the attending Coast Guard Marine Inspector.

On 20APR20 the Master of the towing vessel ALBERT (O.N. 609156) reported that while pushing the tank barge MARGARET (O.N. 1178588) the fwd rake of the MARGARET struck an unnamed spud barge in the Fox River in Green Bay, WI. As a result of the collision the MARGARET sustained damage to the port side bow rake. Prior to the MARGARET's departure from Green Bay, WI a damage survey report completed by the vessel's Classification Society must be provided to MSD Sturgeon Bay for evaluation. Once received and reviewed MSD Sturgeon Bay will provide further guidance and/or direction.

On 20APR20 the MARGARET collided with a spud barge at approximately 0330. The Coast Guard was not notified of this hazardous condition until 1110 of the same day. As per 33 CFR 160.216 whenever there is a hazardous condition the Owner, agent, master, operator or person in charge shall immediately notify the nearest Coast Guard Sector Office. The notification of this incident was not immediate.

On 22AUG20 when reviewing MISLE to close out the damage survey activity it was discovered that there was an outstanding 835 in MISLE issued by Sault Ste Marie for a failure of the starboard main engine. This 835 was required to be resolved by 16JAN20. The main engine was repaired on 13APR20 but the company never notified the Coast Guard and the vessel continued to sail between 16JAN20 and 22APR20 with the unresolved 835. During this time the repairs were never verified or reported to the Coast Guard. Failure to resolve that 835 constitutes a violation of 46 USC 3311(b). This deficiency has been entered for enforcement referral.

As per MSC NVIC 10-92 approval letter E1-1803476 dated 10 September 2018 the installation, workmanship and testing shall be to the satisfaction of the OCMI. An air dryer in the compressed air system, as reviewed by ABS and approved by MSC under NVIC 10-92, was not installed. Installation of the air dryer is to be made and accepted to the satisfaction of an attending marine inspector.

Each generator prime mover must have an overspeed device that is independent of the normal operating governor and adjusted so that the speed cannot exceed the maximum rated speed by more than 15 percent. Each prime mover must also shut down automatically upon loss of lubricating pressure to the generator bearings if the generator is directly coupled to the engine. Vessel was not able to provide evidence of these satisfactory tests. Vessel is to provide satisfactory testing 0f 02 on-board generators prior to departure from next offloading port said to be Green Bay, WI.
