SHAMROCK

An inspection for renewal of a Certificate of Inspection is conducted to determine if the vessel is in satisfactory condition, fit for the service intended, and complies with all applicable regulations. It normally includes inspection and testing of the structure, machinery, equipment, and on a sailing vessel, rigging and sails. The owner or operator must conduct all tests as required by the OCMI, and make the vessel available for all specific inspections and drills required by subpart H of this part. In addition, the OCMI may require the vessel to get underway. You must submit your written application for renewal of a Certificate of Inspection to the OCMI at least 30 days prior to the expiration date of the Certificate of Inspection, as required in § 176.105 of this part. The operator failed to complete a COI renewal prior to the expiration of the COI. The operator did not submit a written application for renewal 30 days prior to the expiration of the COI. 46 CFR 176.404

Whenever damage or deterioration to hull plating or structural members that may affect the seaworthiness of a vessel is discovered or suspected, the cognizant OCMI may conduct an internal structural examination in any affected space including fuel tanks, and may require the vessel to be drydocked or taken out of service to assess the extent of the damage, and to effect permanent repairs. During a damage survey conducted following Typhoon Sinlaku, the vessel SHAMROCK was found to have sustained significant structural damage to the starboard side hull in way of Starboard Void Space No. 3. Damage is consistent with a collision event in which the vessel SUPER EMERALD broke free from its mooring and struck the vessel LEATHERNECK outboard of SHAMROCK, allegedly causing SHAMROCK to be crushed against the dock on its starboard side. The following structural damage was observed: 1. Upper weld seam puncture – between transverse frames 1 and 2, above upper longitudinal frame 1: The deck chine weld seam in Void Space No. 3 starboard was found punctured in the bay between transverse frames 1 and 2, above longitudinal frame 1. The weld exhibited a breach with visible separation of the seam consistent with compressive impact loading. 2. Side shell weld seam puncture – aft of transverse frame 1, between longitudinal frames 1 and 2: An additional puncture to the side shell weld seam was observed aft of transverse frame 1 in the bay between upper longitudinal frames 1 and 2. 3. Longitudinal frame – stitch weld fracture at upper longitudinal frame 2 at the transverse frame 2 intersection, side shell: Found fractured at the junction of longitudinal frame 2 and transverse frame 2 along the side shell, with visible separation of the weld toe and loss of structural continuity at that node. SHAMROCK will proceed to drydock at the earliest practicable opportunity for a complete out-of-water structural assessment and full repair of all collision-related damage identified by the MI. The SHAMROCK is NOT authorized to carry passengers or operate under its Certificate of Inspection until all deficiencies identified herein are corrected to the satisfaction of the attending MI. The vessel may only be operated for the limited purpose of proceeding under its own power to a drydock or repair facility, provided the vessel remains in a seaworthy condition for such transit and the transit is coordinated with MSU Saipan. 46 CFR 176.600 (d)

Electrical equipment on a vessel must be installed and maintained to: Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock; Minimize accidental personnel contact with energized parts. The overcurrent protection installed to protect the DC emergency circuit is rated for AC current only and does not protect the conductor from an electrical fire. 46 CFR 183.200

Electrical equipment on a vessel must be installed and maintained to: Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock; Minimize accidental personnel contact with energized parts. The newly installed breaker panel on the bridge is missing a circuit breaker cover, exposing live conductors to crew members and creating an electrical shock hazard. 46 CFR 183.200

Gauges to indicate jacket water discharge temperature, and lubricating oil pressure must be provided for all propulsion engines installed in the vessel. The gauges must be readily visible at the operating station. The port main engine jacket water discharge temperature gauge was not operational when tested. 46 CFR 182.20-5

All vessels except non-self propelled vessels shall be provided with suitable steering apparatus. The steering hydraulic ram is leaking hydraulic oil when the steering gear is in use. The oil is leaking at a rate of 1/4 cup upon each turn of the steering gear. 46 CFR 182.30-1

Protective gratings shall be provided at such locations where persons or gear might come in contact with the exhaust pipe. The starboard main engine is missing lagging around the turbo charger, endangering personnel that come into contact with the piping during operation. 46 CFR 182.20-20; 46 CFR 182.15-20

Electrical equipment on a vessel must be installed and maintained to: Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock; Minimize accidental personnel contact with energized parts. The battery charger 10 AWG conductor is taped to a 2 AWG conductor. The connection does not meet regulations and is not enclosed. Furthermore, the conductor is not protected by an overcurrent device. 46 CFR 183.115(c)

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull. Dive report dated 31OCT24 found 3 inch by 1 inch blade tip damage to one of the starboard propeller blades. Repair or replace starboard propeller to the satisfaction of attending Marine Inspector.

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull. Vessel reported a loss of propulsion while underway and subsequent grounding. Vessel was able to return to port and reported no flooding to internal sections of the hull. Provide diver's report to identify any possible underwater damage sustained as a result of the grounding. 46 CFR 177.100 - 17c

All vessels except non-self-propelled vessels shall be provided with suitable steering apparatus. Vessel reported loosing propulsion due to failure of a control air pressure switch. Perform satisfactory sea-trials to the satisfaction of attending Marine Inspector. 46 CFR 182.30-1 - 17c.

Gauges to indicate engine RPM, jacket water temperature, and lubricating oil pressure must be provided for all propulsion engines installed on the vessel. The gauges must be readily visible at the operating station. The stbd main engine's jacket water temperature gauge is inoperable.

When, in accordance with § 178.210 of this chapter, a vessel must be provided with a stability letter, the stability letter must be posted under glass or other suitable transparent material, such that all pages are visible, at the operating station of the vessel. If posting is impracticable, the stability letter must be kept on board in a weathertight container readily available for use by the crew and display to passengers and others on request. The vessel completed a simplified stability test in 2011 IAW 46 CFR 178.330. Page two of the stability letter was not found posted on the vessel. 46 CFR 176.306

IAW 46 CFR 184.115, an existing vessel need not comply with the requirements of § 184.610 until March 11, 2001, or 10 years after its keel was laid or the vessel was at a similar stage of construction, whichever is later. 46 CFR 184.610(e)- On a vessel of not more than 19.8 meters (65 feet) in length carrying not more than 49 passengers, a public address system is not required if a public announcement made from operating station without amplification can be heard throughout the accommodation spaces of the vessel during normal operating conditions, to the satisfaction of the cognizant OCMI. A public address system is required on this vessel and is installed. 46 CFR 183.310- (1) Each vessel that relies on electricity to power the following loads must be arranged so that the loads can be energized from two sources of electricity: (i) The vital systems listed in § 182.710 of this chapter; (ii) Interior lighting except for decorative lights; (iii) Communication systems including a public address system required under § 184.610 of this chapter; and (iv) Navigation equipment and lights. The following systems were tested under emergency battery power and were not operational: VHF radio and PA system. 46 CFR 183.310

A suitable hull strainer shall be installed for diesel engine cooling in the circulating water intake line. The hull strainer was found leaking water at one drop per 10 seconds. 46 CFR 182.20-10(b)(3)

All wiring shall be run as high as practicable above the bilges. The starting conductors for the main engines and generator were found installed in the bilge. 46 CFR 183.05-50(a)

An electrical system that has any current carrying conductor intentionally connected directly or indirectly to the metal hull shall be subject to additional requirements as determined by the OCMI in subchapter J as per 46 CFR 183.10-30(a). Ground detection for each AC system that has a grounded neutral must have the following equipment that can withstand the max available fault current without damage: An anmeter that: indicates the current in the ground connectino, has a scale that accuratley and with clear definition indicates current in the 0 to 10 ampere range, and an ammeter switch that is the spring return to on type as per 46 CFR 111.05-27. The anmeter installed for ground fault detection is outside of the current range specified in the regulations. The anmeter was not found to be operational when tested. 46 CFR 183.10-30(a)

Batteries connections shall be made to the battery terminals with permanent type connectors. Unapproved butterfly nuts found installed at battery terminals. 46 CFR 183.05-20(c)

New installations of electrical equipment and material, and the repair or replacement of wire and cable, on an existing vessel, which are completed to the satisfaction of the cognizant Officer in Charge, Marine Inspection (OCMI) on or after March 11, 1996, must comply with this part. Unapproved welding cable was found installed from the battery switch to the main engine starting battery. 46 CFR 183.115(c) 46 CFR 183.340

New installations of electrical equipment and material, and the repair or replacement of wire and cable, on an existing vessel, which are completed to the satisfaction of the cognizant Officer in Charge, Marine Inspection (OCMI) on or after March 11, 1996, must comply with this part. A SENS battery charger with a manufacture date of 2019 was found installed onboard without approved electrical plans. Provide approved electrical plans for the new intallation. 46 CFR 183.115(c)

An adult life jacket must be provided for each person carried on board a vessel. 27 adult lifejackets and 6 child lifejackets were found in poor condition and tore at the collar when tested by bending in hand. Total persons reduced to 24 and no children are permitted. 46 CFR 180.71(a)

Each item of survival craft equipment must be of good quality, and efficient for the purpose it is intended to serve. One life float paddle was found fractured and is not ready for service. Total persons reduced to 30. 46 CFR 180.175(a)

Each hatch exposed to the weather must be watertight. Flush deck hatches on the aft main deck were found without gaskets. 46 CFR 171.124(a)

New installations of electrical equipment and material, and the repair or replacement of wire and cable, on an existing vessel, which are completed to the satisfaction of the cognizant Officer in Charge, Marine Inspection (OCMI) on or after March 11, 1996, must comply with this part. The operator replaced the previous single phase Delco Generator rated for 240 volts and 25KVA, with a new generator that is manufactured by MagnaPlus and distributed by Marathon Generators. The new generator is a model 283PSL1707, serial MT-0117293-0122, rated for 40 deg C ambient temp, 1800 RPM, 60 Hz, 480 Volts, 3 phase, with an output of 45 amps/30KW. An email was sent to the port engineer in January 2022 stating that if the new generator electrical rating is different than the original then electrical plans must be submitted to MSC for approval. Submit AC electrical plans for the new generator installation to MSC for approval. 46 CFR 183.115(c)

Machinery must be suitable for the vessel and its operations and for the purpose intended. Crew commenced replacement of port & STBD propulsion engines without notify the CG.

No major repairs or alterations affecting the safety of the vessel with regard to the hull, machinery, or equipment, shall be made without the knowledge and approval of the Officerin Charge, Marine Inspection. Repair hole on line connected to bilge suction system in forward engine room compartment to the satisfaction of the attending USCG Marine Inspector.

All vessels of 26 feet in length and over shall be provided with individual bilge lines and bilge suctions for each watertight compartment. Prove operation of bilge suction in lower cabin.

The bilge suctions shall be fitted with suitable strainers having an open area not less than three times the area of the bilge pipe. Bilge suction line below galley space is not fitted with a suitable strainer having an open area not less than three times the area of the bilge pipe.

Repair holed and wasted potable water supply line on starboard side main deck to the satisfaction of the attending USCG MI.

All vessels must have navigation lights that are in compliance with the applicable sections of the International and Inland Navigation Rules. Anchor light comes on intermittently. Repair and prove operation of anchor light to the satisfaction of the attending USCG MI.

Each paddle must be of at least 4 feet in length, lashed to the life float to which it belongs and buoyant. Replace broken wooden paddle due to wood rot with new for 15 x person buoyant apparatus.

Retroreflective material required by this section must be Type I material that is approved under subpart 164.018 of this subchapter. Replace unapproved reflective tape on ring buoys with USCG approved type in accordance with cite.

Each life jacket must be marked with Type I retro-reflective material in accordance with 46 CFR 164.018. Total of 23 x adult and 1 x child personal flotation devices inspected with non-approved USCG reflective tape. Replace with USCG approved reflective tape to the satisfaction of the attending USCG [name withheld] corrective action, vessel is limited to carrying no more than 28 persons including crew.

All electrical equipment and circuits must be clearly marked and identified. (1) Engine room compartment electrical panel must be marked to identify each equipment and amperage that are in use for operations.

Electrical installation shall be to the satisfaction of the OCMI rep. Properly secure loose overhead light fixture above generator in engine room compartment.

Electrical installation shall be to the satisfaction of the OCMI rep. Prove operation of port side forward flood light on mast.

Battery terminals shall be of the soldered type and all connections shall be made to the battery terminals with permanent type connectors. Spring clips or other temporary type clamps are not permitted. Positive and negative electrical wires are wrapped around battery terminals. Properly connect electrical cables to battery.

Electrical equipment on a vessel must be installed and maintained to provide services necessary for safety under normal and emergency conditions. On August 11, 2022, while the vessel was at Sumay Cove, the vessel suffered a loss of electrical power and the generator main breaker failed to reset. Prior to carrying passengers conduct a causal analysis as to the failure of the electrical system, provide written documentation to the scope of repairs, and effect permanent repairs. Repairs and tests are to satisfaction of the attending CG MI.

All vessels shall be provided with a hand operated portable fire pump having a capacity of at least 5 gallons per minute. This fire pump shall be equipped with suction and discharge hose suitable for use in fire fighting. The hand portable fire pump may also serve as a bilge pump. Vessel to have and maintain a hand operated portable fire pump in accordance with cite.

Verify each electrical panel numbered switching unit and circuit directory are correct and properly labeled in accordance with this cite.

It is further intended that all machinery be installed and maintained in such a manner as to afford adequate protection against fire, explosion, machinery failure and personnel injury. Repair or replace with new as to original leaking port side overboard valve in engine room to the satisfaction of the attending USCG MI.

Operational readiness, maintenance and inspection of lifesaving equipment. Each survival craft on a vessel must be in good working order and ready for immediate use before the vessel leaves port and at all times when the vessel is underway. Maintenance, inspections of survival craft and testing of EPIRB are completed in accordance with Subpart and logged or otherwise documented for review by the Coast Guard upon request.

Make repairs to the stbd main engine throttle in the wheel house.

Each item of lifesaving equipment determined by the marine inspector to not be in serviceable condition must be repaired or replaced. Replace water logged/damaged life floats to as original to the satisfaction of the attending USCG Marine Inspector. Update: 12MAY2022 - Pending new life floats, vessel is prohibited from carrying no more than 10 persons total on each voyage. Vsl has installed a 10 person life float approved by CID.

Vessel must stow the buoyant apparatus in a float free arrangement. Vessel had painted the weak link to the vessel hull.

All vessels (old T) are required to be provided with a hand operated portable fire pump having a capacity of 5 gpm. Vessel was missing the portable hand fire pump.

The Marine employer must have adequate amount of alcohol testing devices onboard the vessel for the total crew size onboard.

Placards containing the instructions for the donning and use of lifejackets onboard the vessel must be posted in conspicuous places that are regulary accessible and visible to the crew and passengers. Vessel was missing the instrucitons for the JIM BUOY life jacket model SO-1.

1Vessel must carry an appoved first-aid kit. vessel had expired medications within the first-aid kit.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date charts. Vessel had the 2009 edition charts onboard with no weekly NTM updates corrected.

Each lighting fixture globe, lens, or diffuser must have a guard or made of high strength material, except in an accommodation space, radio room, galley, or similar space where it is not subject to damage. The lighting fixture in the fwd lower compartment was extinguished.

While underway on board vessel SHAMROCK to and from a vessel at anchorage, MI observed weathertight/watertight doors remained open during both transits. Vessel is on an Oceans route per COI and stability letter states that all openings remain closed. Vessel is restricted to operating within Apra Harbor, Guam until full compliance is met to the satisfaction of the attending [name withheld] in this part shall be construed as limiting the marine inspector from making such tests or inspections as are reasonable and practicable to be assured of the seaworthiness of the vessel per 46 CFR 176.30-1.

Where fixed seats are installed, the seat spacing shall be such as to provide for ready escape in case of fire or other casualty. Bench seats in main passenger cabin to are not bolted/affixed to the deck to prevent from shifting or turning over. Repair to as original to the satisfaction of the attending Marine Inspector.

Auxiliary machinery shall be suitable in type and design for the purpose intended. It was reported by the vessel's crew that the vessel's air conditioning unit is inoperable. Openings on deckhouse and to lower passenger cabin are kept open while underway with passengers for hire on board. Repair unit in accordance with manufacturer's recommendation or recommend replacing with new. Electrical installations must be in manufacturer's recommendation or recommend replacing with new. manufacturer's recommendation or recommend replacing with new. Electrical installation of unit must be in accordance with Subpart 183.05-1 or 183.10, respectively.

Exposed electrical wiring not enclosed in junction box on water pump in forward compartment below crew galley. Remove or cap off exposed electrical wiring from breaker box and loose wiring throughout the space.

CFR 182.530(a),(c): On a vessel of at least 26ft in length, a visual and audible alarm must be provided at the operating station to indicate a high water level. There is no high water alarm in the lower passenger area, which is normally unmanned. A visual indicator must be provided at the operating station to indicate when any automatic bilge pump is operating.

OLD T 46 CFR 171.124(a): Each hatch exposed to the weather must be watertight. There are currently three hatches that were found allowing water access into the spaces; the aft door to the lower passenger area, the aft door to the main passenger area, and the engine room hatches on the main deck. (Restricted to operating within Outer Apra Harbor).

OLD T 46 CFR 180.15-5(d): The water light for the life float must be attached to the life float by a lanyard at least 18 feet in length. The current configuration utilizes a corrosion resistant clip so is not directly attached with the lanyard. (Restricted to operating within Outer Apra Harbor).

OLD T 46 CFR 180.15-5(c): Each life float must be fitted with a painter that is installed to run out freely. Current painter is not able to run out freely to utilize the weak link if vessel were sinking. Install in accordance with manufacturer’s procedures. Vessel is restricted to Lakes, Bays, and Sounds so must remain within inner harbor Guam until corrected. (Restricted to operating within 3 miles from shore).

46 CFR 180.70(d): Each vessel must carry one floating water light with a lanyard securing the water light around the body of the life ring buoy with a corrosion-resistant clip to allow for quick disconnection of the light and lanyard.

OLD T 46 CFR 177.35(b)Rails shall consist of evenly spaced courses and the spacing between courses shall not be greater than 12 inches. Replace missing lower course on starboard side aft of house.

OLD T 46 CFR 183.05-15(c): Each ungrounded conductor of circuits supplying lights shall be equipped with a circuit breaker or switch and fuse at the point of attachment to the power source. Current bathroom light in main passenger cabin is not on a breaker in the main switchboard. (NLT 20NOV2020).

OLD T 46 CFR 183.05-35: Accessories, such as switches, shall be standard National Electrical Code types for the loads to be carried and shall be of types listed by Underwriters’ Laboratories, Inc. or other recognized testing laboratory. Also, for vessels operating on salt water, all lights, receptacles and switches shall be constructed of corrosion resistant material. Passenger cabin wash room has an unapproved electrical installation for operating the toilet. (NLT 20NOV2020).

OLD T 46 CFR 185.30-15: All escape hatches and other emergency exits shall be marked on both sides “Emergency Exit, Keep Clear”. Current signage is worn and in need of replacement. (NLT 20NOV2020).

OLD J 46 CFR 112.05-10 Table 112.05-5 footnote 5, battery operated lanterns used for emergency lighting shall have rechargeable batteries and incorporate an automatic battery charger that will maintain the battery in a fully charged condition. Current emergency lighting installation in crew cabin space is wired on main circuit with main light switch. This allows the control of the charger to be turned on and off with the main light switch and is not in a constant charging position. (NLT 20NOV2020).

OLD T 46 CFR 177.30-5(b) All toilets and wash basins shall be fitted with adequate plumbing. The sewage line in crew cabin is taped and not threaded into piping. Also, lower cabin sewage line is leaking. Correctly install plumbing for both locations to avoid sewage leaking into the spaces. (NLT 20NOV2020).

46 CFR 183.420: Navigation Rule #29 indicates that a red all around light below a white all-round light in a vertical line is used for pilot vessels. SHAMROCK has lights mounted for this configuration but the red light is not operational. (NLT 20NOV2020).

46 CFR 184.704: A vessel with installed toilet facilities must have a marine sanitation device (MSD) that complies with 33 CFR 159. Vessel has an installed Type III marine sanitation device (MSD) holding tank. Verify Captain’s head is connected to holding tank and is in proper working condition. (NLT 20NOV2020).

46 CFR 181.520: Each fire extinguisher must be located so they are clearly visible and readily accessible. Fire extinguisher at lower crew cabin is not properly marked to verify location. Provide Fire Extinguisher placard for location.

OLD T 46 CFR 176.20-1: The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of the COI. Vessel is a small passenger vessel responsible for passenger and crew safety. Removable wooden deck panels in lower passenger cabin area is deteriorated and with wood rot; deck is unstable which provides a safety hazard to crew and passengers. Wooden bulkhead panel in way of portable fire extinguisher is loose and poses a hazard to crew. Secure side panel and replace wooden deck to original.Prior to replacing with new wooden deck panels, contact USCG MI to inspect bilge below deck prior to repairs. (NLT 20NOV2020).

OLD T 46 CFR 182.25-10: All vessels shall be provided with bilge pumps in accordance with Table 182.25-10(a). The portable hand bilge pump shall be provided w/suitable hoses for pumping bilges on the suction and discharge ends. Replace missing portable hand bilge pump and maintain on board vessel. (NLT 20NOV2020).

OLD T 46 CFR 176.20-1: Low water pressure from starboard side garden hose. Repair water pump to starboard side garden to the satisfaction of the attending USCG Marine Inspector. (NLT 20NOV2020).

46 CFR 183.220 (d): All electrical equipment and circuits must be clearly marked and identified. Switchboard panels are not properly labeled at operating station and inside engine room compartment.

OLD T 46 CFR 176.25-50: At each initial and subsequent inspection...the Marine Inspector shall require that all observed unsafe practices and hazardous situations be corrected. Properly secure or remove hanging dead end wires in forward passenger cabin.(NLT 20NOV2020).

Life jackets must be maintained IAW 46 CFR 180.71; replace unapproved whistles with USCG approved, mark life jackets with name of vessel.

OLD T 46 176.20-1: Hole discovered at port side exterior of house in way of hold back hook. Repair hole on port side wheelhouse to as original.

Repair port side main propulsion engine prior to carrying passengers for hire.

Seat must be constructed to minimize the possibility of injury. Repair damaged seat covers that have sharp edge and exposed seating frames.

Unfinished deck installation in lower passenger cabin. Make permanent repair to lower cabin decks; refasten deck flooring plywood to aluminum frames, re-install deck tiles, and make all fixed seating secure to deck.

Install missing cover for electrical outlet in lower cabin portside wall and repair inoperable ceiling light fixtures.

Repair inoperable overhead light fixtures in engine room and steering space.

Attach/secure loose overhead ceiling and portside wall in lower passenger cabin.

Repair or replace inoperable port engine temperature gauge.

Repair damaged life float (LF) IAW manufacture instructions or replace damaged LF with in-kind LF.

Replace worn out retro-reflector tape on life ring buoy located outside port bridge door.

Replace worn out retro-reflector tape on all identified adult & child life jackets.

Repair inoperable existing PA system.

Conduct crew training for MOB and fire drill in GUAM prior to carry passenger. Show proof of previously conducted crew training recorded in Log or other documentation.

DAPI AUDIT to be conduct in GUAM by SECTOR Guam inspector.

Repair damaged & disconnected electrical wire to starboard engine fuel sensor.

Repair damaged supply vent louvers for air condition supply to lower passenger cabin.

Remove standing water in steering space bilge. Locate the source of water intrusion and repair.

46CFR176.25-50: Accumulation of waste oil in engine room bilge. Remove dispose of wast oil IAW federal/state laws. Determine cause of oil leak and make repairs IAW manufacturer's recommendations to prevent further leaks from reoccuring.

46CFR176.20-1/5: Generator exhaust with unapproved temporary repairs. Remove exhaust lagging for USCG inspection. Prior to repairs, submit repair plan to USCG for review. Upon completion of satisfactory repairs to the attending MI, exhaust must be rewrapped with marine exhuast insulation/heat wrap.

46CFR182.20-5: Repair port side main engine temperature gauge at operating station and locally in engine room compartment to as original. Prove proper operation to attending MI.
