Each vessel must have a stability letter issued by the Coast Guard before the vessel is placed into service. This letter sets forth conditions of operation. Vessel is not operating IAW their stability letter issued, October 24, 2025. In the letter it states "No.1 Ballast Tank shall be 60% full with saltwater at all times." It was observed empty. Letter additionally states, all other ballast tanks and fresh water tanks shall be empty, they were approximately 70% full. Prior to carrying passengers. 46 CFR 178.210 46 CFR 170.120

All unfired pressure vessels must be installed to the satisfaction of the cognizant OCMI. The design, construction, and original testing of such unfired pressure vessels must meet the applicable requirements of subchapter F (Marine Engineering) of this chapter. MI observed 02 pressure vessels on board, provide size, max allowable working pressure for each tank and max allowable gauge reading for relief valve. 46 CFR 182.330

Installation of diesel engine exhaust pipe shall be in accordance with § 182.15-20...(a) Exhaust piping shall... be gastight throughout its length... Exhaust leaks detected in the engine room with USCG four gas meter. 46 CFR 182.20-20 (old T) 46 CFR 182.15-20 (old T)

Except as otherwise provided in this section, rails or equivalent protection shall be installed near the periphery of all weather decks accessible to passengers and crews... Rails of a sufficient height and/or courses not present on cargo deck's stbd side, port side, and fantail. 46 CFR 177.35-1(a) (old T)

(c)Sound signal intensity and range of audibility. A whistle fitted in a vessel shall provide, in the direction of maximum intensity of the whistle and at a distance of 1 meter from it, a sound pressure level in at least one 1 3rd-octave band within the range of frequencies... 180-2100 Hz (±1%) for a vessel of less than 20 meters (65FT) in length, of not less than the appropriate figure given in Table 86.01(c) of this section... The ship's whistle was IN-OP at the time of inspection with a small handheld air horn present in lieu of the installed system. The hand held horn is not adequate for prolonged voyages in restricted visibility. 33 CFR 86.01(c)

All escape hatches and other emergency exits used as means of escape must be marked on both sides in clearly legible letters at least 50 millimeters (2 inches) high: “EMERGENCY EXIT, KEEP CLEAR”, unless such markings are deemed unnecessary by the cognizant [name withheld] labeling in engine room is inadequately lit under emergency power and is not in close proximity to the escape. 46 CFR 185.606

(a) The owner, charterer, master, or managing operator of a vessel carrying overnight passengers shall have a suitable number of watchmen patrol throughout the vessel during the nighttime, whether or not the vessel is underway, to guard against, and give alarm in case of, a fire, man overboard, or other dangerous situation.(b) Vessels described by 46 CFR 175.110(d) must submit plans to the cognizant OCMI, in accordance with 46 CFR 176.700, for the installation and use of monitoring device to ensure the wakefulness of the watchmen required in paragraph (a) of this section... Overnight accommodation space for 12 people observed without an approved watch monitoring device. 46 CFR 185.410(a)&(b)

On vessels described by 46 CFR 175.110(d) of this chapter, a passenger safety bill must be posted by the master in each cabin or stateroom, and in passenger accommodation spaces. (c)Vessels described by 46 CFR 175.110(c) must have an interconnected fire detection system in compliance with § 181.450 installed in all enclosed areas where passengers and crew have routine access, including accommodation spaces and machinery spaces. The fire detectors onboard, Universal Security Instruments SS-775, are not interconnected. 46 CFR 181.405(c)

Each Class 1 door on a vessel in ocean service must be designed to withstand a head of water equivalent... in no case less than 10 feet (3.05 meters). Deteriorated condition of watertight doors on vessel observed. USCG requires adjustment and/or gasket renewal and chalk test in presence of inspector. 46 CFR 170.270(b) (old T)

(a) Each hatch exposed to the weather must be watertight... Deteriorated condition of hatches on vessel fantail. USCG requires adjustment and/or gasket renewal and chalk test in presence of inspector. 46 CFR 171.124(a) (old T)

(a)A pre-engineered fixed gas fire extinguishing system must:(1) Be approved by the Commandant;(2) Be capable of manual actuation from outside the space in addition to automatic actuation by a heat detector;(3) Automatically shut down all power ventilation systems and all engines that draw intake air from within the protected space; and(4) Be installed in accordance with the manufacturer's instructions. Remove both unapproved fire extinguishing balls from engine room. 46 CFR 181.420(a)

Wiring Joints and splices. (1)Wiring Joints and splices shall be mechanically secure and made in junction boxes... Observed unapproved screw-type wire nuts w/o a junction box cover in galley. 46 183.05-50(b) (old T)

The owner... shall notify the cognizant OCMI... whenever... alterations affecting the safety of the vessel, together with the nature of any repairs or alterations contemplated. Prior to operations, schedule USCG inspection during crane installation for verification of MSC's H1-2402935. 46 CFR 176.665(a)

After loading and prior to departure and at all other times necessary to assure the safety of the vessel, the master shall determine that the vessel complies with all applicable stability requirements in the vessel's trim and stability book, stability letter, Certificate of Inspection, and Load Line Certificate, as the case may be. As per the stability letter issued to the vessel on October 15th, 1981, the vessel shall only load cargo within the safe operating region of the LOADING DIAGRAM and the center of gravity of the deck cargo shall not exceed 3 feet above the main deck. In addition, the crane installed on board must only be utilized in the capacity highlighted in the request letter issued to this office dated July 18th, 2023 valid for 30 days only.

Propulsion machinery shall be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load under such requirements without exceeding its designed limitations. Starboard main engine has an exhaust leak. 46 CFR 182.05-1 (a)

All vessels of 26 feet in length and over shall be provided with individual bilge lines and bilge suction for each watertight compartment. Lazarette was unable to be pumped out at the time of inspection. 46 CFR 182.25-5 (a)

A hatch exposed to the weather must be watertight. Three lazarette hatches require new gaskets. 46 CFR 179.360

All life ring life buoys shall be marked with the vessel’s name. Vessel’s ring buoys were not marked with vessel’s name. 46 CFR 185.30-5

The master of the vessel shall ensure that the EPIRB is tested monthly. No monthly EPRIB tests have been carried out.

MI observed the hydrostatic release unit on the port side IBA was improperly installed. Proper installment must be completed before operating on an oceans or coastwise route. 46CFR180.10-5

All vessels with crew members living on board shall be provided with crew accommodations of sufficient size, adequate construction, and with suitable equipment to provide for the protection and accommodation of the crew in a manner practicable for the size, facilities, and service of the vessel. Accommodation space by the galley area didn't have a smoke detector and was missing the light cover and the smoke detector in the accommodation space on the bridge was expired. 46CFR177.25-1

As per the stability letter issued to the vessel on October 15th, 1981, the vessel shall only load cargo within the safe operating region of the LOADING DIAGRAM and the center of gravity of the deck cargo shall not exceed 3 feet above the main deck. In addition, the installed crane on board must not be utilized until proper stability calculations are performed in accordance with 46 CFR 173 by a naval architect.

Vessel was due for DD/ISE by February 29, 2020. DD/ISE did not happen until March 2. 46 CFR 176.600 701C

Transverse L-Beam in Lazarette next to port watertight hatch is severly corroded and needs to be cropped and renewed. 46 CFR 177.100 16c

EPIRB monthly test is not being consistently recorded in the ship's log. Record test monthly in log book.

LSA equipment maintenance and record keeping are not consistently entered in ship's log. Record maintenance of the ship's life saving equipment in logbook.

The engine room escape hatch did not open from the engine room and was only able to be opened from the outside deck. The handle was seized and requires maintenance for escape from the engine room. Lubricate all moving parts, exercise profusely and test.

The remote fuel shut off valve did not indicate the position of the valve in the engine room. Install signage that indicates position of the valve as open or closed.

The signage for immersion suits and PFDs in the accommodation space were incorrect. Install proper signage with corresponding labels and number of units on each stowage location.

While conducting man overboard drill, the master and the deckhand did not have sufficient communications (hand held radios or other means to communicate clearly). Provide crew with hand held radios or similar devices to improve communications during emergencies and drills.

The master shall conduct sufficient drills. Vessel must provide means for deckhand to communicate with master without losing sight of man overboard during drill.

Vessel is past due for drydock inspection and is restricted from carrying passengers until credit drydock is completed by CG Marine Inspector.

PMark all immersion suits w/ SOLAS retroreflective tape.

Properly secure freezer in accom space.

Properly repair lube oil leak IWO feed hose.
