Each towing vessel must have a reliable means to provide notification when an emergency condition exists or an essential system develops problems that require attention. The following alarms must be provided: High bilge levels. Alarms must be visible and audible at each operating station. Bilge alarm panel inoperable in the Bridge at the operating station. Rectify to the satisfaction of the attending Marine Inspector. 46 CFR 143.230(a)(5) 46 CFR 143.230(b)(1)

All bilges and void spaces are kept free from accumulation of combustible and flammable materials and liquids insofar as practicable. Bilges contained substantial amounts of excess oil. Rectify to the satisfaction of the attending Marine Inspector. 46 CFR 142.220(a)

All seals and gaskets must be properly maintained to prevent leaks of flammable or combustible liquid. Fuel filter on STBD side of engine room was leaking. Exhaust leak present on STBD side Main Engine at gasket. Rectify to the satisfaction of the attending Marine Inspector. 46 CFR 143.220(a)

Each vessel must be designed and constructed to minimize fire hazards insofar as reasonable and practicable. Machinery and fuel tank spaces must be separated from accommodation spaces by bulkheads. Open penetration found in battery room leading to crew berthing space. Bulkhead no longer provides designed and constructed requirements to minimize fire hazards and separate accommodation spaces. Rectify to the satisfaction of the attending Marine inspector. 46 CFR 144.400 46 CFR 144.405

A towing vessel may not be operated without having onboard a valid COI issued by the Coast Guard as required by § 136.202. Vessel missed annual window. Vessel must conduct COI inspection prior to operation. 46 CFR 136.200

Survival craft must be stowed in accordance with the requirements of § 199.130 of this chapter. Each liferaft must be arranged for float-free launching. A hydrostatic release unit used in a float-free arrangement must be approved under approval series 160.162. Hydrostatic release unit for inflatable liferaft was expired. Replace to the satisfaction of the attending Marine Inspector. 46 CFR 141.310 46 CFR 199.130

Towing vessels must be equipped with the following equipment, as applicable to the area of operation: Search light, controllable from the vessel's operating station and capable of illuminating objects at a distance of at least two times length of the tow. Search light bulbs inoperable. Replace to the satisfaction of attending Marine Inspector. 46 CFR 140.725

46 CFR 136.200 Each towing vessel certificated under the provisions of this subchapter must be in full compliance with the terms of the COI. Vessel has been going on international voyages to Dominican Republic, COI route and condition states “not on international voyage”.

46 CFR 143.300 (b)Pressure vessels must be externally examined annually. Relief valves must be tested in accordance with§ 143.245. Provide evidence that the two pressure vessel relief valves meet the testing requirement to the satisfaction of the attending marine inspector.

46 CFR 144.605 Means must be provided for stopping each fan in a ventilation system serving machinery spaces and for closing, in case of fire, each doorway, ventilator, and annular space around funnels and other openings into such spaces. Engine room ventilation securing bolt is painted over not allowing the cover to be secured in the closed position.

46 CRF 141.340 (g) (1) Lifejackets must have the following attachments and fittings: Each lifejacket must have a lifejacket light approved under approval series 161.012 or 161.112 securely attached to the front shoulder area of the lifejacket. 02 Lights in crew accommodation were operational but was expired. Replace lights to the satisfaction of the marine inspector. 02 lights did not have the battery expiration date listed on the light per manufactures instructions in the captain quarters and the bridge.

46 CFR 143.205 (a)Machinery and electrical systems must be designed and maintained to provide for safe operation of the towing vessel and safety of persons onboard under normal and emergency conditions.1)Port main diesel engine has a coolant leak. Make repairs to the satisfaction of the attending marine inspector.2) STBD generator has lube oil leak below the fuel priming pump. Make repairs to the satisfaction of the attending marine inspector.3) Crank case breather filter assembly needs filters replaced on both main diesel engines and generators.

46 CFR 142.230 (c)The frame or support of any semi-portable fire extinguisher fitted with wheels must be welded or otherwise permanently attached to a steel bulkhead or deck to prevent it from rolling under heavy sea conditions. The port aft engine room extinguisher bracket is not permanently attached. Fix bracket to the satisfaction of the attending marine inspector.

46 CFR 141.380 The owner or managing operator must maintain valid proof of registration. Vessel did not have proof of current registration with NOAA. Provide evidence to the attending marine inspector.

46 CFR 140.705 (b) (1)A towing vessel must carry adequate and up-to-date charts, maps, and nautical publications for the intended voyage, including charts, including electronic charts acceptable to the Coast Guard, of appropriate scale to make safe navigation possible. Digital charts were found not updated, and upon trying to update on board, the system did not completed the update process.

46 CFR 140.715 (a)Towing vessels must meet the communications requirements of 33 CFR part 26 and 33 CFR 164.72, as applicable. VHF radio needs to have the MMSI number entered in the radio, and is not connected to a GPS receiver. No GMDSS Master Plan available at the GMDSS station.

Except as provided in paragraph (d) or (e) of this section, a towing vessel with overnight accommodations and alternating watches (shift work), when pulling, pushing or hauling alongside one or more barges, must have a system to detect when its master or mate (pilot) becomes incapacitated. The system must: (1) Have an alarm in the pilothouse distinct from any other alarm; (2) Require action from the master or officer in charge of a navigational watch, during an interval not to exceed 10 minutes, in order to reset the alarm timer; (3) Immediately (within 30 seconds) notify another crewmember if the pilothouse alarm is not acknowledged.Vessel does not have an installed system and currently does not have procedures onboard for the providing of a second person in the pilothouse at all times as an alternative allowed by 46 CFR 143.450(d). 46CFR143.450(a)

A vessel with a valid load line certificate issued in accordance with subchapter E of this chapter may be deemed in compliance with the requirements of subparts B and C of this part. During ABS load line survey the following was identified and brought to the attention of attending MI: (1) Port side bulwark stay deck connection buckled on No.6 and No.7 (2) Starboard side bulwark stay deck connection fractured on No.14. Due to vessel operations and fuel tanks location beneath the main deck, repairs required at next Sub Chapter M dry dock to satisfaction of attending marine inspector, with a due date of 31 May 2024 as per COI. 46 CFR 144.125

Record of drills and instruction must be maintained in the TVR or official log book. No documentation of any drills or other required information was observed on board in the logbook where the master stated such records should be maintained. Provide recording keeping system to capture drills/required documentation.

Each towing vessel must perform the applicable tests in Table 143.245(b) of this section. The tests required by this section must be recorded IAC/w part 140 of this sub-chapter. No records where available or for inspection or other documentary objective evidence that the required tests where being conducted. Provide recording keeping system to capture test schedules and required documentation.

All lifesaving equipment must be tested and maintained IAC/w 46CFR199.190. Receipts and other records of these inspections and test must be retained for at least 1 year after the expiration of the COI. No records of weekly, monthly, quarterly, or annual testing of any equipment was produced on board the vessel. Provide recording keeping system to capture test schedules and required documentation.

The master of a towing vessel must ensure that each crew-member participates in fire-fighting drills and receives instruction at least once a month. Documentation must be in compliance with 46CFR140.915. No records of firefighting drills where observed. Provide recording keeping system to capture drill schedules and required documentation.

Each towing vessel operating in oceans and coast-wise service must have a line throwing appliance approved under approval series 46CFR160.040 which states that an approved appliance with a total of 4 charges. Provide 04 additional appliances or charges to satisfy this requirement.

A towing vessel subject to this sub-chapter and choosing the Coast Guard Inspection option, or required to have the Coast Guard inspection option must undergo an annual inspection within 3 months before or after the COI anniversary date. The vessel's anniversary date is May 2nd. The vessel operated for over a month beyond the end of the compliance time frame before the company was made aware by Sector San Juan personnel that an inspection was due immediately.

Each lifebuoy with a floating electric water light must have a lanyard of at least 910 millimeters securing the water light around the body of the lifebuoy. The lanyard for all four water lights were not secured around the body of the lifebuoy.

The master must ensure that all doors designed to be watertight or weathertight function properly. The STBD second deck door was not found to be watertight as the ends of the rubber gasket did not come together, and light was showing when the door was closed.

A towing vessel subject to this subchapter and choosing the Coast Guard inspection option, or required to have the Coast Guard inspection option, must undergo an annual inspection within 3 months before or after the COI anniversary date. Towing Vessel is overdue for annual inspection.

Where practicable, each space where crew may be quartered or normally employed must have two means of escape. Emergency escape door from crew berthing is to tightly locked down to be opened by hand.

All towing vessels must be operated in a manner that minimizes the risk of down-flooding and progressive flooding. Inspector observed 02 pipes penetrating from void space #2 portside adjacent to engine room that are not blanked off.

Where practicable, each space where crew may be quartered or normally employed must have two means of escape. Emergency escape door from crew berthing is too tightly locked down to be opened by hand.

Each exhaust pipe from an internal combustion engine which is within reach of personnel must be insulated or otherwise guarded to prevent burns. On a new vessel, each pipe that contains vapor, gas, or liquid that has a temperature exceeding 150 °F (65.5 °C) which is within reach of personnel must be insulated where necessary or otherwise guarded to prevent injury. Replace damage section exhaust lagging in the port main engine.

All seals and gaskets must be properly maintained to prevent leaks of flammable or combustible liquid into the machinery space. Starboard side main engine crank case collection line was chafed.

Electrical systems and equipment must function properly and minimize system failures and fire and shock hazards. Generator port and stb were missing covers and generator box was easily accessible.

Electrical connections must be suitably installed to prevent them from coming loose through vibration or accidental contact. Battery connectors in the battery room is not of the permanent type.

All towing vessels must be operated in a manner that minimizes the risk of down-flooding and progressive flooding. The master must ensure that all hatches, doors, and other openings designed to be watertight or weathertight function properly. The main entrance leading from the fantail to the accommodation spaces did not completely seal and the port hatch from the engine room to the steering place was miss align.

Ground detection must be located at the main switchboard or distribution panel that provides continuous indication of circuit status to ground. The ground detection indicator test light was inoperable.

Extension cords must not be used as a permanent connection to a source of electrical power. Observed power strip cord in storage room being used as an extension cord to connect security camera on bridge.

Electrical systems and equipment must function properly and minimize system failures and fire and shock hazards. Observed several uncovered dead end cables in electrical enclosure in local winch station on deck.

A towing vessel 79 feet or more in length must carry four lifebuoys, with one lifebuoy located on each side of the operating station. Lifebuoy on 2nd deck starboard side is not in serviceable condition.

Each towing vessel operating on oceans, coastwise, or Great Lakes routes must have a means to take blood pressure readings, splint broken bones, and apply large bandages for serious wounds. Vessel does not have a means to take blood pressure readings and splint broken bones

No later than July 22, 2019, the owner or managing operator must implement a health and safety plan. The health and safety plan must document compliance with this part and include record keeping procedures. Vessel does not have a health and safety plan.

A towing vessel must carry adequate and up-to-date charts, maps, and nautical publications for the intended voyage. Vessel’s paper charts are not corrected with updates.

All crewmembers must be provided with health and safety information and training and must be documented in owner or managing operator’s records. Vessel does not have documentation of health and safety information and training for crewmembers.

An owner or managing operator choosing the Coast Guard option may use a management system, vessel operations manual, towing vessel record (TVR), or logbook to meet this subchapter's recordkeeping requirements. Vessel is not properly recording training and drills.

Vessel must undergo an annual inspection within 3 months before or after each anniversary date. Vessel representative cannot conduct annual inspection due to maintenance schedule.

Persons serving or intending to serve in the merchant marine service are encouraged to take the earliest opportunity to ascertain, through examination, whether their visual acuity, color vision, hearing and general physical condition, are such as to qualify them for service in that profession. Master did not have Medical Card at the time of inspection.

The operator of a vessel with a capacity of 250 or more barrels of oil, hazardous material, or liquefied gas as regulated in Table 4 of 46 CFR part 154 shall provide transfer procedures that meet the requirements of this part and part 156 of this chapter for transferring— (a) To or from the vessel; and (b) From tank to tank within the vessel. The vessel needs to update and keep current oil transfer procedures.

Each operator or agent of a vessel with a capacity of 250 or more barrels of fuel oil, cargo oil, hazardous material, or liquefied gas as regulated in Table 4 of 46 CFR part 154, or each person who arranges for and hires a person to be in charge of a transfer of fuel oil, of a transfer of liquid cargo in bulk, or of cargo-tank cleaning, shall designate, either by name or by position in the crew, the person in charge (PIC) of each transfer to or from the vessel and of each tank-cleaning. The vessel does not have a PIC Designation Letter.

Smoke detection in berthing spaces. Each towing vessel must be equipped with a means to detect smoke in the berthing spaces and lounges that alerts individuals in those spaces. This may be accomplished by an installed detection system, or by using individual battery-operated detectors meeting UL 217 (incorporated by reference, see § 136.112 of this subchapter). Detection systems or individual detectors must be kept operational at all times when the crew is onboard the towing vessel. (c)Heat-detection system in galley. Each new towing vessel equipped with a galley must have a heat-detection system with one or more restorable heat-sensing detectors to detect fires in the galley. The system must be arranged to sound an audible alarm at each operating station. This may be a separate zone in the detection system required by paragraph (a) of this section, or a separate detection system complying with paragraphs (a)(1) and (2) of this section. The vessel was not able to test smoke and heat detectors.

Each vessel must have the following: (1) Marine charts of the area to be transited, published by the National Ocean Service, U.S. Army Corps of Engineers, or a river authority that - (ii) Are currently corrected. The vessels chart are not updated with the current corrections.

Each towing vessel must be capable of preventing all oil spills from reaching the water during transfers by: (1) Pre-closing the scuppers/freeing ports, if the towing vessel is so equipped; (2) Using fixed or portable containment of sufficient capacity to contain the most likely spill, if 33 CFR 155.320 does not apply; The vessel is missing adequate plugs for fuel/oil containment.

Each hose must: Have fittings of brass or other suitable corrosion-resistant material that comply with National Fire Protection Association (NFPA) 1963 “Fire Hose Connections,” or other standard specified by the Commandant.

Each towing vessel must have a reliable means to provide notification when an emergency condition exists or an essential system develops problems that require attention. Emergency lighting must be provided for all internal crew working and living areas. The frequency of the tests and inspections required by this section must be: For vessels, annually or as part of the biennial and mid-period inspections. The vessel did not have hydrostatically tested bunkering equipment (annual)
