No marine employer shall engage or employ any individual to serve as a crew member unless the individual passes a chemical test for dangerous drugs for that employer. Two employees were not on the employee roster for pre-employment testing. 46 CFR 16.210 (a)(1)

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. Alcohol strips were found to be out of date. 46 CFR 4.06-15 (a) (1)

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: (1) Charts of large enough scale to make safe navigation possible; (2) U.S. Coast Pilot or similar publication; (3) Coast Guard Light List. Vessel does not have up to date charts, U.S. Coast Pilot, and Coast Guard Light List. 46 CFR 184.420 (a) (1) (2)(3)

To enhance protection of life and property it is mandatory that each 406.0-406.1 MHz EPIRB be registered with NOAA before installation and that information be kept up to date. An incorrect call sign was found on the EPIRB’s registration. 47 CFR 80.1061 (f)

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull, protection against fire, means of escape in case of a sudden unexpected casualty, guards and rails in hazardous places, ventilation of enclosed spaces, and necessary facilities for passengers and crew. Vessel has not logged the amount of water being pumped in their daily bilge log as required from CG-835V dated 01MAY2024. 46 CFR 177.100

Fill pipes and sounding pipes must be so arranged that overflow of liquid or vapor cannot escape to the inside of the vessel. A wooden plug was found to be inserted in the fill pipe. 46 CFR 182.445 (d)

A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. For equivalent kits, the contents must be stowed in a suitable, watertight container that is marked “First-Aid Kit”. A first-aid kit must be easily visible and readily available to the crew. The ammonia ampules were found to be out of date. 46 CFR 184.710

Whenever damage or deterioration to hull plating or structural members that may affect the seaworthiness of a vessel is discovered or suspected, the cognizant OCMI may conduct an internal structural examination in any affected space including fuel tanks, and may require the vessel to be drydocked or taken out of service to assess the extent of the damage, and to effect permanent repairs. The OCMI may also decrease the drydock examination intervals to monitor the vessel's structural condition. Vessel is overdue for drydock examination due April 30, 2024 (one year drydock) as per issued CG-835V dated September 20, 2023. Vessel is to complete a satisfactory drydock examination prior to carrying passengers. 46 CFR 176.600 (d).

The vessel must conduct the following items in addition to the current terms of their issued COI: ***Vessel must maintain a daily bilge pumping log that accurately lists all the spaces being pumped, along with the time and the amount of water being pumped out of the bilges.*** ***Vessel must immediately report any notable changes or increases in bilge pumping schedules, as well as any increases in water ingress, to the Sector Los Angeles/ Long Beach Officer in Charge, Marine Inspection (OCMI).*** 46 CFR 177.100

The minimum clear opening of a door or passageway used as a means of escape must not be less than 32 inches in width, however, doors or passageways used solely by crew members must have a clear opening not less than 28 inches. The sum of the width of all doors and passageways used as means of escape from a space must not be less than 0.333 inches multiplied by the number of passengers for which the space is designed. The forward and aft passenger berthing areas have door/passageway openings that are 28 inches in width. Vessel is prohibited from carrying overnight passengers or utilizing overnight accommodations until regulations or alternative compliance is met to OCMI satisfaction.

A means of escape which is not readily apparent to a person from both inside and outside the space must be adequately marked in accordance with § 185.606 of this chapter. The means of escape in the engine room/crew accommodation is not marked “EMERGENCY ESCAPE, KEEP CLEAR” on both sides in clearly legible letters. Vessel is prohibited from carrying overnight passengers or utilizing overnight accommodations until regulations or alternative compliance is met to OCMI satisfaction.

A ladder leading to a deck scuttle may not be used as a means of escape except: (1) On a vessel of not more than 65 feet in length, a vertical ladder and a deck scuttle may be used as not more than one of the means of escape from passenger accommodation space; or (2) As not more than one of the means of escape from any crew accommodation space or work space. The vessel is over 65 feet in length and the emergency escape in the aft passenger compartment consists of a vertical ladder. Vessel is prohibited from carrying overnight passengers or utilizing overnight accommodations until regulations or alternative compliance is met to OCMI satisfaction.

Permission for repairs or alterations. The owner or managing operator shall submit drawings, sketches, or written specifications describing the details of any proposed alterations to the cognizant OCMI. Vessel provided electrical plan to USCG MSC and Sector LALB. Complete MSC approval and any changes (vessel allowed to operate while these plans are being reviewed).

Each space accessible to passengers or crew on a regular basis must have at least two means of escape. A dead end passageway more than 20 feet in length is prohibited. The minimum clear opening of a door or passageway used as a means of escape must not be less than 32 inches in width, however those used by crew members may be 28 inches in width. Ladders are steep ladders, stairways and stairwells having an angle of greater than 40 degrees for passenger and 50 for crew. Vessel reconstructed the engine/generator enclosure in the galley/berth, ensure a suitable means of escape is provided.

An exposed hazard, such as gears or rotating machinery, must be properly protected by a cover, guard, or rail. During inspection, no such arrangements were sighted on the anchor winch reduction gear. Provide plan for satisfactory protective arrangement to satisfaction of Marine Inspector, and then install. Vessel may operate with equipment dogged down, and move passengers off focscle area while operating equipment. 46 CFR 177.960

A pre-engineered fixed gas fire extinguishing system must be in compliance with § 181.420 of this part and may only be installed in a normally unoccupied machinery space, a paint locker, or a storeroom containing with a gross volume of not more than 57 cubic meters (2,000 cubic feet). Vessel installed new pre-engineered fixed gas fire extinguishing in conjunction with repower, provide details of "fume tight" space and properly sized extinguishing system, and plan for satisfactory checks of this system. (system checked for shutdown, override, and discharge light/audible alarm on 24 AUG, space appears fume tight but is relatively large). 46 CFR 182.400(b)(2)

An inflatable liferaft must be serviced at a facility specifically approved by the Commandant for the particular brand, and in accordance with servicing procedures meeting the requirements of part 160, subpart 160.151, of this chapter no later than the month and year on its servicing sticker affixed under 46 CFR 160.151–57(n). Port liferaft servicing (30 pax) is expired. Stbd liferaft (50 pax) sat. Vessel may sail with 75 pax, or use loan raft for full COI complement. 46 CFR 185.730(a)(1)

Piping, valves, and fittings in a fire main system must comply with subpart G, part 182, of this chapter. Machinery and equipment installed on each vessel must be suitable for the vessel and its operation and for the purpose intended. Number 2 fire station piping is leaking at fire main manifold. 46 CFR 181.310(b) 46 CFR 182.100

In systems greater than 50 volts. Each connection to a conductor must be made withing an enclosure. Electrical supply to fan in Captain's cabin supply is spliced (110v) and no junction box. 46 CFR 183.340(f)

An interconnected detection and alarm system must: Be installed such that the actuation of alarm in one area results in both audible and visual alarms in all areas required by to be protected by the interconnected detection and alarm system. Activation of one smoke alarm did not communicate to and activate alarm in all spaces. 46 CFR 181.450(a)(2)

Each fall must be renewed when necessary due to deterioration or at intervals of not more than 5 years, whichever is earlier. Falls for rescue boat deteriorated and require replacement within 6 months. 46 CFR 185.704(b)

The station bill must set forth the special duties and duty station of each crew member for various emergencies. Station bills posted did not reflect current duties of crew. 46 CFR 185.514(b)

Must cap all sea intakes below the waterline that are not being used.

AFTER AN EXTENSIVE 12 WEEK DRYDOCK PERIOD, SIGNIFICANT WATER INGRESS WAS OBSERVED DUE TO PLANK SHRINKING. VSL IS TO ALLOW SUFFICIENT SOAK TIME, ( 03 ) DAYS / ( 72 ) HOURS PIER SIDE TO ALLOW PLANKING MEMBERS TO SWELL AND TIGHTEN. VSL IS TO MONITOR WATER INGRESS LEVELS AND DEWATER AS NEEDED. AFTER ( 03 ) DAYS HAS PASSED, A MARINE INSPECTOR WILL CONDUCT AN INTERNAL STRUCTURAL EXAMINATION UNDERWAY/UNDER POWER TO ASCERTAIN THE VSLS WATERTIGHT INTEGRITY.

A vessel must be operated in accordance with applicable laws and regulations and in such a manner as to afford adequate precaution against hazards that might endanger the vessel and the persons being transported. Vessel noticed the forepeak taking on water at approximately 50 gallons per hour while transiting under power; installed bilge system can keep up with the water intake. Vessel must discover the source of the flooding and minimize all flooding hazards to the satisfaction of the Marine Inspector prior to movement.

Your vessel must undergo an annual inspection within 3 months before or after each anniversary date of the COI. Vessel exceeded 3 month interval on 11JUN2020. Vessel is required to complete a satisfactory annual inspection prior to carrying passengers.

THE OWNER OR MANAGING OPERATOR SHALL MAKE A VESSEL AVAILABLE FOR DRYDOCKN EXAMINATIONS AT LEAST ONCE EVERY TWO YEARS. THE VESSEL HAS NOT COMPLETED A SATISFACTORY DRYDOCK EXAMINATION. VESSEL CANNOT CARRY PASSENGERS UNTIL SATISFACTORY EXAMINATION IS COMPLETED.

All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from causing fire, explosion, machinery failure, and personnel injury. Vessel experienced black smoke and metallic noise coming from the engine, this resulted in the engine being shutdown, further resulting in the vessel being towed back to the pier. Prior to getting underway, vessel rep must contact dispatch for notification. Vessel must prove proper operation of engine & propulsion system to Marine Inspector.

A watertight door was installed, by a prior owner, in the watertight bulkhead at frame 20 without approval of the cognizant [name withheld] or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant OCMI, except during an emergency. The bulkhead must be restored to its original condition as approved on 19 JUNE 1987.

Surfaces with in 3 feet of cooking appliances must have B-15 class fire boundaries. Provide fire boundary around galley stove.

Unauthorized installation of a watertight door- Provide a plan to ensure the transverse watertight bulkhead separating the forward accommodation space and the main hold complies with watertight door regulations in 46 CFR 179.330.

Provide a proper anchor light.

Provide a pressure gauge on the fire pump outlet.

Remove all dead-end wires.

Provide permanent type connectors for all batteries.

Provide overnight accommodations for 11 additional passengers. Vessel restricted to 38 passenger while operating overnight.

Repair the steering gear.

Repair or replace the fuel tank.

Conduct satisfactory hull and internal structural exam.
