Certificate Required. (a) A towing vessel may not be operated without having on board a valid COI issued by the Coast Guard as required by § 136.202. Vessel's COI has missed the required annual inspection window. COI has therefore expired. Vessel is not authorized to operate commercially until a new COI is conducted. 46 CFR 136.200(a)

The following systems must be equipped with gauges at the machinery location. The generators did not have RPM gauges. Install RPM gauges for the generators located in the machinery location. 46 CFR 143.230(c)(3)

Each towing vessel must have a reliable means to provide notification when an emergency condition exists or an essential system develops problems that require attention. The following alarms must be provided to include low hydraulic steering fluid levels. Install a low-level hydraulic sensor to detect the loss of hydraulic oil on the steering system with corresponding alarm. 46 CFR 143.230(a)(6)

Fuel systems for towing vessel main engines and generators must have a documented maintenance plan to ensure proper operation of the system. Create and provide a fuel maintenance plan for the described machinery locations. 46 CFR 143.255(a)

Pressure vessels must be externally examined annually and relief valves must be tested in accordance with § 143.245. In absence of applicable testing for existing pressure relief valves, replace pressure relief valves and provide documentation of certification. 46 CFR 143.300(b)

Electrical systems and equipment must function properly and minimize system failures and fire and shock hazards. Vessel has plastic ties as cable supports. Replace plastic ties throughout machinery space, specifically steering gear room, to minimize the risk of entanglement during an emergency situation. 46 CFR 143.400(A)

Each towing vessel must be equipped with an industrial type first aid cabinet or kit, appropriate to the size of the crew and operating conditions. Vessel did not have appropriate first aid kit. Place onboard appropriate / unexpired first aid kit 46 CFR 140.435

Negative DOT drug testing records must be kept for 1 year per 49 CFR 40.333(a)(4). Records on hand were incomplete.

Pre-employment drug testing background checks have not been performed as required under 49 CFR 40.25.

Company does not have satisfactory arrangements to conduct post-casualty chemical testing.

Company does not have satisfactory arrangements in place to conduct reasonable cause chemical testing.

Shipboard supervisors have not received received 1 hour employee assistance program (EAP) training.

In addition to the requirements in paragraph (a) of this section, all fire detection equipment and systems must be maintained IAW the attached nameplate and manufacturer's approved design manual. Fire-detection system was last serviced February 2023. Servicing was not completed within the last 12 months. Service fire-detection system and provide proof to the CG Marine Inspector (MI) prior to conducting commercial towing operations.

The following alarms must be provided: high bilge levels. Alarms must be visible and audible at each operating station. Aft bilge high level alarm did not activate when tested. Restore functionality and provide proof to CG MI.

Alarms must have a means to test actuation at each operating station or have a continuous self-monitoring alarm system which actuates if an alarm point fails or becomes disabled. Operation of alarms in 46 CFR 143.230(a)(1)(2)(4)(6)&(7) could not be tested. Crew was unfamiliar with how to test alarms. Determine test procedure and test alarms in presence of a CG MI.

The master must ensure that all doors designed to be watertight or weather-tight function properly. Starboard watertight door, IVO galley, did not fully seal, allowing for light shine through in various locations. Renew door to ensure watertight integrity is maintained.

At least one lifebuoy must have a lifeline, secured around the body of the buoy. Each lifeline must be at least 60' in length. Lifeline was only 30' long. Replace lifeline to meet requirements of 46 CFR 141.360(c).

The master must ensure that all lifesaving equipment is properly maintained. Lanyards for both ring life buoys water lights were deteriorated. Renew lanyards.

Refresher [health and safety information] training must be repeated annually and may be conducted over time in modules covering specific topics. Annual training was not completed. Complete annual training and determine method for tracking completion.

The hull of each documented vessel must be marked as required by part 67 of this chapter. Vessel hailing port was illegible on the starboard, aft quarter. Vessel name was missing on the stern.

The master must ensure that all lifesaving equipment is properly maintained and ready for use at all times. Liferaft provided onboard was incorrectly installed preventing a float-free arrangement.

All lifesaving equipment must be tested and maintained IAW the minimum requirements of 199.190 of this chapter. Weekly visual inspections of survival craft were not being conducted or logged in the TVR.

Each towing vessel must perform the applicable tests in Table 143.245(b) of this section. The tests required by this section must be recorded IAW with part 140 of this subchapter. All tests prescribed, except for the tests required before getting underway, were not being conducted or logged at the required frequency.

Machinery systems must be maintained to provide for safe operation of the towing vessel and safety of persons onboard. Soft patches observed on the bilge discharge line, firemain and on the cross-connect for the bilge and firemain. No leaks observed when tested. Detemine extent of wastage within 30 days.

Regardless of the option chosen to obtain a COI, upon obtaining a COI each towing vessel must then undergo a drydock and internal structural examination at the following intervals: A vessel that is exposed to salt water more than 6 months in any 12-month period since the last examination or initial certification must undergo a drydock and internal structural examination at least twice every 5 years, with not more than 36 months between examinations. Vessel has failed to complete a credited drydock examination by October 27, 2023, As indicated by the issued Certificate of Inspection. The vessel is restricted from operating in a commercial towing capacity, until a satisfactory drydock examination has been completed by a Coast Guard marine inspector. 46CFR137.300(a)(1)

The Owner/Operator must provide satisfactory evidence of the inspection and servicing of the portable and fixed fire fighting equipment. Vessel could not provide proof of annual servicing to the Marine Inspector. Provide proof of servicing prior to issuance of the COI.

The Owner/Operator must provide satisfactory evidence of the inspection and servicing of the inflatable life raft. Vessel could not provide proof of annual servicing to the Marine Inspector. Provide proof of servicing prior to issuance of the COI.

Employers must ensure that they and their crewmembers meet the requirements of the Required Chemical Testing. Vessel could not provide proof of enrollment in a Chemical Testing Program. Provide proof of crewmembers enrollment in Chemical Testing Program prior to issuance of the COI.

Vessel must be able two all around red lights in a vertical line when the vessel is not under command. One of the two red all around lights was removed from the mast. Replace missing all around red light prior to getting vessel underway.

The master of a towing vessel must ensure that each crewmember participates in fire-fighting drills and receives instruction at least once a month. According to the drill log, the last fire drill was conducted on August 5, 2022. Complete fire fighting, Man overboard and abandon ship drills and provide proof of logging of drills in the Towing Vessel Record for 3 months. Email records to Marine Inspector at [email withheld].

Pressure vessels over 5 cubic feet in volume and over 15 pounds per square inch maximum allowable working pressure (MAWP) must be equipped with an indicating pressure gauge (in a readily visible location) and with one or more spring-loaded relief valves. The total relieving capacity of such relief valves must prevent pressure from exceeding the MAWP, as established by the manufacturer, by more than 10 percent. The forward air receiver relief valve is reduced down from 1" to a 1/4" relief valve that would prohibit the pressure from exceeding 10% MAWP in the event of a fire or malfunction of the air compressor. Install a properly sized relief valve in the forward air receiver prior to the issuance of the COI. 46 CFR 143.300

Alarms must: Be visible and audible at each operating station. The alarm located at the operating station may be a summary alarm; if the alarm at the operating station is a summary alarm, the specific alarm condition must be indicated at the machinery or bilge location; The engine control station audible alarm is out of commission. Repair audible alarm to original condition to the satisfaction of the attending Marine Inspector within two weeks.46 CFR 143.230

Piping and machinery components that exceed 220 °C (428 °F), including fittings, flanges, valves, exhaust manifolds, and turbochargers, must be insulated. Measures must be in place to prevent flammable or combustible liquid piping leaks from coming into contact with these components. Install exhaust lagging on all exposed sections of (dry) exhaust manifold to the satisfaction of the attending Marine Inspector within 30 days. 46 CFR 143.220

Emergency exits used as means of escape must be marked on both sides in clearly legible letters at least 50 millimeters (2 inches) high: “EMERGENCY EXIT, KEEP CLEAR”. The vertical secondary means of escape in the engine room is not marked. Properly mark means of escape from engine room prior to the issuance of the COI. 46 CFR 144.160

All portable and semi portable fire extinguishers must be suitably mounted in a bracket recommended by the manufacture and or properly secured to prevent it from falling in heavy seas. The portable 40 B:C fire extinguisher on the upper engine room deck is loose. Properly mount fire extinguisher bracket to the satisfaction of the attending Marine Inspector prior to the issuance of the COI. 46 CFR 136.112

All towing vessels must be operated in a manner that minimizes the risk of down-flooding and progressive flooding. The deadlight covers in the upper engine room are missing the deadlight covers. Properly install the missing dead light covers to the satisfaction of the attending Marine Inspector prior to the issuance of the COI. 46 CFR 140.610

Waste receptacles. Unless other means are provided to ensure that a potential waste receptacle fire would be limited to the receptacle, waste receptacles must be constructed of noncombustible materials with no openings in the sides or bottom. Two waste receptacles in the lower and upper engine room are of the open type. Remove or replace open type receptacles in the engine room prior to the issuance of the COI. 46 CFR 144.425

Each towing vessel must carry on board and maintain the following: a currently corrected edition of or an applicable currently corrected extract from, each of the following publications for the area to be transited: Coast Guard Light List, Notices to Mariners or LNMs and U.S. Coast Pilot. Current editions of the Coast Pilot and Light List were out of date. No LNMs onboard the vessel. Provide updated publications prior to issuance of vessel's COI. 33CFR164.72(b)(2)

Towing vessels must be equipped with an illuminated magnetic compass, readable from each operating station. Magnetic compass light was extinguished. Replace light prior to issuance of the COI. 46 CFR 140.725(d)

A vessel of 20 meters or more in length shall be provided with a bell in addition to a whistle. No bell was on board the vessel at the time of inspection. Install bell prior to issuance of the COI. 33 CFR 86.23(a)

Each ship subject to the Bridge-to-Bridge Act must have on board a radio operator who holds a restricted radiotelephone operator permit or higher class license. Master, Eilert, does not hold a radio operator permit. Show proof of obtaining permit prior to COI issuance. 47 CFR 80.163

If more than one ring life buoy is carried, at least one must not have a lifeline attached. Ring life buoys were all outfitted with either a lifeline or a water light. Remove lifeline from one ring life buoy prior to issuance of the COI. 46 CFR 141.360(c)(1)

Each towing vessel must be equipped with an industrial type first aid cabinet or kit, appropriate to the size of the crew and operating conditions. Vessel's first aid kit had multiple expired medications. Replace expired medications prior to issuance of the COI. 46 CFR 140.435

A vessel must be operated in such a manner as to afford protection against hazards. Forward, external ladder leading to the bow was missing 2 of the 4 bolts affixing it to the deck. An additional bolt was loose presenting a hazard for the crew. Replace bolts prior to issuance of the COI. 46 CFR 140.205(a)

All lifesaving equipment must be tested and maintained in accordance with the minimum requirements of 199.190. Each EPIRB must be tested monthly. The EPIRB must be tested using the integrated test circuit and output indicator to determine that it is operative. Master could not prove previous EPIRB tests were conducted. Provide 3-months of proper logs showing the EPIRB testing is being conducted. Email records to [email withheld]. 46 CFR 141.235 46 CFR 199.190(e)(2)

Any vessel of at least five net tons which engages in Coastwise Trade must have a valid Certificate of Documentation (COD) onboard the vessel with the appropriate endorsements. Vessels COD is expired and therefore is no longer valid. Vessel is not allowed to operate and shall remain moored/anchored until the vessels COD is renewed with the National vessel documentation center (NVDC).

46 CFR 142.240(a)(1) All hand portable fire extinguishers must be inspected or tested at least once every 12 months. Portable fire extinguishers must be tested in accordance with the tests required by Chapters 7 and 8 of NFPA 10. Two 40 B-C fire extinguishers in the engine room did not have proof of annual testing/inspection. Provide proof of servicing.

46 CFR 140.605(b) A towing vessel must be maintained and operated so the watertight integrity and stability of the vessel are not compromised. The watertight and weathertight doors between the engine room and the steering gear room, the STBD side entrance to the galley, exiting the aft end of the engine room to the fantail, and the hatch above the main engine air intake were unable to be properly opened/closed and dogged down. Demonstrate proper operation of identified doors/hatches to the satisfaction of the attending Marine Inspector.

46 CFR 143.300(a) Pressure vessels over 5 cubic feet in volume and over 15 pounds per square inch maximum allowable working pressure (MAWP) must be equipped with one or more spring loaded relief valves. The total relieving capacity of such relief valves must prevent pressure from exceeding the MAWP, as established by the manufacturer, by more than 10 percent. The two large > 5cu/ft pressure vessels in the engine room, relief valves are reduced down from 1-1/2 inch NPT to 1/4 inch NPT preventing adequate pressure relief.

Def Code: CG020 CG-543 PL 11-01, 2013 VGP Commercial vessel greater than 79ft in length shall meet the requirements of the 2013 Vessel General Permit rules established by the EPA. The vessel did not have any documentation that they were in compliance with VGP requirements. Review CG-543 Policy Letter 11-01 and EPA Final rule 2013 VGP and provide documentation showing compliance.

46 CFR 199.190(e)(2) Each EPIRB must be tested monthly. The EPIRB must be tested using the integrated test circuit and output indicator to determine that it is operative. Master could not prove previous EPIRB tests were conducted and did not know how to properly test the EPIRB. EPIRB was tested on the spot. Provide documentation showing EPIRB testing is conducted and logged for February.

46 CFR 143.235(b)(3) The General Alarm has installed in the engine room and any other area where background noise makes a general alarm hard to hear, a supplemental flashing red light that is identified with a sign that reads. “ATTENTION GENERAL ALARM-WHEN ALARM SOUNDS or FLASHES GO TO YOUR STATION”. The red flashing light in the engine control room is missing the sign stating “ATTENTION GENERAL ALARM-WHEN ALARM SOUNDS or FLASHES GO TO YOUR STATION”.

46 CFR 4.06-15 The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. Vessel had expired alcohol test strips on board the vessel. Obtain valid and up to date means of testing for alcohol.

46 CFR 143.205(a) Machinery and electrical systems must be designed and maintained to provide for safe operation of the towing vessel and safety of persons onboard under normal and emergency conditions. The main shaft stern tube is leaking excessively, approximately twenty gallons per minute causing a flooding/sinking hazard.

46 CFR 143.220(a) All seals and gaskets must be properly maintained to prevent leaks of flammable or combustible liquid, as those terms are defined in 46 CFR sub part 30.10, into the machinery space. The fuel oil transfer pumps seal is leaking diesel fuel while in operation presenting a fire hazard in the machinery space

46 CFR 143.205(a) Machinery and electrical systems must be designed and maintained to provide for safe operation of the towing vessel and safety of persons onboard under normal and emergency conditions. The fill valve for the 5 ps on the fuel oil manifold is missing the valve handle rendering it inoperable.

46 CFR 143.560(a)(2) Each distribution panel or switchboard on a towing vessel must be totally enclosed and of the dead front type. The shore power disconnect box will not close due to a broken latch and high voltage wiring is exposed presenting a shock hazard to the crew. Lock out/tag out panel until proper repairs are made. Must be corrected prior to use of shore power.

Temporary patch exhaust leak in main engine muffler/exhaust piping and provide plan for permanent repairs.

Secure/ remove dead end wiring in rudder room.

Temporary patch sewage piping in engine room and provide plan for permanent repairs.

Temporary patch deck drain piping in engine room and provide plan for permanent repairs.

Replace/tighten f/o return valve fwd engine room over head and union.

Secure dead end wires in port berthing and install cover over opening in overhead.

Prove proper operation fwd starboard side engine room fan.

Provide permanent means to secure paint locker.

Finish cleaning and wiping down engine room bilge.

Prove proper operation of installed bilge system onboard. Until bilge system is proven provide temporary Gas/diesel power pump that reach all space that could need to be dewater

Replace Emergency light in aft lower engine room

All owners and operators of an existing towing vessel must have a valid COI prior to the specified phase-in period. This vessel is one of the 100% of the vessels that has not obtained a valid COI. The vessel shall be made available for a Coast Guard COI inspection within 90 days. If an inspection is not completed prior to this date, the action for this deficiency shall be changed to a 60 (Rectify deficiencies prior to movement) and the vessel may no long be permitted to operate.

Provide permanent repair for all temporary patches on potable water system in the engine room

Remove/secure all supplies on top of engineering booth in the engine room.

Provide current DAPI enrolled paperwork on-board.
