46 CFR 16.230(c) Random Testing Requirements: Marine Employers must provide a scientifically valid method to randomly select crewmembers so that each covered crewmember shall have an equal chance of being tested each time selections are made. American Maritime Safety Inc. selects a random vessel in your fleet to be tested. Since crews are shared among your vessels, a vessel may be minimally crewed or not crewed, the DER has some discretion in determining the crew that has been selected. In order to meet the requirements of this section of 46 CFR, American Maritime Safety Inc. shall provide an alternative means for random selection so that they may prove that each covered crewmember will have an equal chance of selection. Portland Tugboat LLC shall provide correspondence about this alternative to this office within by April 6, 2023.
