The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. Due to the objective evidence in the below deficiencies, the vessel is not in substantial compliance with relevant conventions, calling into question the adequacy and implementation of the vessel’s SMS under the ISM code. PSCO’s collected objective evidence that the vessel is not following SMS procedures 9.3. PSCO observed an inoperable fire pump at the port aft due to a broken impellor as well as a soft patch on the fire main that was not reported. Vessel could not produce evidence that the vessel or company notified their Recognized Organization or Flag Administration of the serious safety deficiencies. An external audit is required. 74SOLAS (20) IX/3.1 ISM Code Part A/10.1 30bc

Fire extinguishing appliances shall be kept in good order and available for immediate use at all times during the voyage. PSCO observed an inoperable fire pump at the port aft due to a broken impellor as well as a soft patch on the fire main that was not reported. 60 SOLAS II/66 17bc

All the life-savings appliances shall be kept in working order and available for immediate use before the ship leaves port and at all times during the voyage, PSCO observed the rescue boat winch was non-operational which prevents the launching of the rescue boat. 60SOLAS III /4(c) 17bc

The siting and installation of accumulator batteries which provide a reserve source of energy shall be such as to ensure... reasonable safety. PSCOs observed water build up in battery case. 74SOLAS (20) IV/13.7.3 10c

A reserve source... of energy shall be provided on every ship to supply radio installation for the purpose of conducting distress and safety radiocommunications...PSCO observed that the batteries used to supply GMDSS equipment were dead. 74SOLAS (20) IV/13.2 17bc

The Administration shall issue an appropriate minimum safe manning document or equivalent. PSCOs observed an expired Minimum Safe Manning Certificate. 74SOLAS (20) V/14.2.2 17bc

Contracting Governments undertake... to maintain... measures for the purpose of ensuring that, from the point of view of safety of life at sea, all ships shall be sufficiently and efficiently manned. PSCOs observed that no [name withheld] is currently assigned to the ship. 74SOLAS(20) V/14.1 17bc

The ring, lines and letters shall be painted white or yellow on dark background. They shall also be permanently marked on the sides of the ship to satisfaction of administration. PSCO’s observed certain letters were no longer white and two lines were not permanently welded. ICLL CH. 1 REG.8 40bc

The entry for each discharge to a port reception facility shall include date and time of discharge and the estimated amount discharged for each category in cubic meters. PSCOs observed the entry to previous discharge of garbage to be inaccurate in accordance with the receipt. MARPOL Ch V/1-.3.4 10c

Adequate information shall be provided to enable the equipment to be properly operated and maintained taking into account the recommendations of the organization. PSCO's observed no monthly EPIRB or SART test recorded in the vessel's GMDSS logbook in accordance with the guidelines establishedby the vessel's administration. 74SOLAS(2020Cons.)) CH. IV Reg 15.3

Control stations shall be separated from the remainder of the ship by "A" class bulkheads and decks. PSCO observed control station on bridge was not protected by "A" class boundary door, which allowed for the passage of flame and smoke.

The deck line... shall be marked amidships on each side of the ship. PSCO observed there was no deck line.

A cargo ship shall be subject to a minimum of two inspections of the outside of the ship’s bottom during any five year period, except where regulations 14(e) or (f) is applicable. Where regulation 14(e) or (f) is applicable, this five year period may be extended to coincide with the extended period of validity of the certificate. In all cases, the interval between any two such inspections shall not exceed 36 months. The vessel’s last out of water drydock was 21DEC20, surpassing the 36-month interval. The period of validity was exceeded, rendering the Cargo Ship Safety Construction Certificate invalid. 74 SOLAS (20 Cons.) CH. 1/Reg. 10(a)(v)

Where air pipes to ballast and other tanks extend above the freeboard or superstructure decks, the exposed parts of the pipes shall be of substantial construction... PSCO observed excessive corrosion to multiple tank ventilation pipes on both port and starboard sides of vessel’s bulkhead deck, preventing them to be sealed and potentially permitting water intrusion, thus compromising the weathertight integrity of these structures. ICLL 66, Reg 20

Machinery space openings in position 1 or 2 shall be properly framed and efficiently enclosed by steel casings of ample strength... During the deck walk PSCOs identified 04 cluster areas of deck wastage with holes ranging from 1" to 2" located on the port side interior machinery space stairwell,in addition multiple areas of excessive corrosion and wastage on the knife-edges on 02 doors on the main deck leading down to the engine room, compromising their structural strength and weathertight integrity. ICLL 66, Reg 17

The annual survey shall include a general inspection of the structure, machinery and equipment referred to in paragraph (b)(i), to ensure that they have been maintained in accordance with regulation 11(a) and that they remain satisfactory for the service for which the ship is intended. PSCOs observed potential unknown water source in the steering compartment under concrete repair. Request a survey with ultrasonic shots to ensure the vessel’s structure, ballast tanks, and steering compartment are within permissible wastage specifications.

Ships constructed before 1 July 1998 shall, where practicable, meet the requirements of paragraphs 1.1 and 1.2. No blind sector, caused by cargo, cargo gear or other obstructions outside the wheelhouse forward of the beam which obstructs the view of the sea surface as seen from the conning position shall exceed 10 degrees. PSCOs observed cargo stacked at a height impeding the crew’s visibility from the conning position. 74 SOLAS (20 Cons.) Ch. V/Reg 22

When the gangway overhangs the water so that there is danger of employees falling between the ship and the dock, a net or suitable protection shall be provided to prevent employees from receiving serious injury from falls to a lower level. PSCOs observed the net under the gangway did not extend out to cover the space between the ship and the dock.

There shall be provided between the radio telegraph operating room and the bridge and one other place, if any, from which the ship is navigated, an efficient two-way system for calling and voice communication which shall be independent of the main communication system on the ship. The secondary, independent means of communication between the bridge and engine room, which is where the ship can be navigated, is inoperable. Solas (60) IV/8(d)

Every ship of 100 Gross tonnage and above, and every ship which is certified to carry 15 or more persons and fixed or floating platforms shall carry a garbage management plan which they shall follow. This plan shall provide written procedures for minimizing, collecting, storing, processing. And disposing of garbage including the use of the equipment on board. It shall also designate the person or persons in charge of carrying out the plan. PSCO’s observed garbage management plan on board that did not record food garbage, the plan did not state the vessel specific process for minimizing, collecting, storing, and processing garbage. MARPOL 17 V/10.2

The owner, master, or person in charge of each vessel underway shall ensure that the vessel anchors are ready for letting go. Vessel anchor is not suitable for letting based on the size of the vessel. 33CFR164.11 (o)

The bunker delivery shall be kept on board the ship in such a place as to be readily available for inspection at all reasonable times. It shall be retained for a period of three years after the fuel oil has been delivered onboard. PSCO’s discovered crew was missing bunker delivery notes from a few select fuel recipients. MARPOL 17 CONS. V/6

Accumulator batteries shall be suitably housed and compartments used primarily for their accommodation shall be properly constructed and efficiently ventilated. PSCO’s observed a battery unhoused in between the generators causing a hazard in the engine room. SOLAS 60 II/27(a)(vii)

All exposed metal parts of electrical machines or equipment which are not intended to be “live”. But are liable to become “live” under fault conditions shall be earthed (grounded): and all electrical apparatus shall be so constructed and so installed that danger of injury in ordinary handling shall not exist. PSCO’s discovered a panel with multiple grounded issues causing unknown electrical issues onboard for the crew. SOLAS 60 II/27.1(a)(1)

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons onboard. PSCO’s found a generator missing it’s guard creating a hazard to the crew. 74 SOLAS (20) I/11(a)

The ring, lines and letters shall be painted in white or yellow on a dark background or in black on a light background… Load line lettering for tropical, summer, winter, tropical fresh was not painted on the vessel. ICLL (66) Annex I/8

A ship, except a ship of less than 26ft must have a placard of at least 5 by 8 inches, made of durable material fixed in a conspicuous place in each machinery space… No Oil Discharge placard was found in any machinery space. 33CFR 155.450 (a)

Satisfactory means, permanently attached, shall be provided for closing the openings of the air pipes. PSCOs observed every air pipe on the freeboard deck to not be equipped with a permanently attached closing/opening mechanism for the vents. ICLL (66) Annex I/20

The piping systems installed on all vessels shall be safe and efficient for operation. Soft patch discovred of chill water pipe in port deck locker. Fix with proper permenant repairs to the satisfaction of attending marine inspector.

Vessel has a USCG approved resonse plant. Crew has not been follwing any plan requirements for training, drills, or QI notifications. Provide proof of follwing of all plan requirements to the satisfaction of USCG. Deficiency will remain outstanding until next annual inspection to confirm crew has followed all plan requirements.

Before the vessel leaves port and at all times while underway all lifesaving appliances shall be ready for immediate use. STBD aft ring lifebuoy bracket is broken.

NEW ORLEANS is marked as the hailing port on the Stern. The Hailing port on the COD indicates LAROSE. The Vessel representative is working with NVDC to change the COD to reflect NEW ORLEANS. Vessel rep submitted changes, which were returned by NVDC. Requested more time. Changed due date to 15 JUL 2016.
