The owner or managing operator of a towing vessel that has selected the TSMS option and who has chosen to demonstrate compliance through an external survey program must: (1) Have the vessel surveyed annually by a surveyor from a TPO; (2) Ensure the survey is conducted in accordance with § 137.215; (3) Ensure the survey is conducted within 3 months of the anniversary date of the COI. Vessel lapsed annual survey in excess of 3 months past anniversary date. Coast Guard issued Certificate of Inspection has been revoked and vessel will be restricted from towing operations until proof of annual surveys from the past 3 years have been submitted to and approved by this office. 46 CFR 137.205(a)

is 400 gross tons or more as measured under the
convention measurement system in 46 U.S.C. 14302 (i.e.
ITC tonnage).
Subject vessel is 423 GT ITC. Vessel can operate within
the Port of New York. If the vessel wishes to depart the
Port of New York, the vessel owner/operator must receive
approval from any COTP zone prior to entering.
Restriction will be lifted once an approved VRP has been received.
