The condition of the ship…shall be maintained…to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. Ballast wing tanks throughout the cargo hold are severely wasted and holed, allowing water to pass from the tanks and into the cargo hold.74 SOLAS (14 CONS)Ch I/ Reg 11 (a)

The construction and the means for securing the weather tightness of cargo hatchways in positions 1 and 2 shall be equivalent to the requirements of regulations 15 and 16 of this annex. PSCO's observed significant wastage of the gaskets for the cargo hatch covers, preventing weather tightness. In addition PSCO observed significant wastage of the structure of the cargo hatch covers, eliminating their ability to remain weather tight. ICLL 66 ANNEX I/Reg 14(1)

After any survey of the ship under paragraph 1 of this regulation has been completed, no change shall be made in the structure, equipment, systems, fittings, arrangements or material covered by the survey, without the sanction of the administration, except the direct replacement of such equipment and fittings. In an attempt to verify that ballast tanks were not leaking into fuel tanks, PSCO's had crew members open up #1 Fuel Oil Tank Portside. Crew said that the tank was empty of fuel and not in use. Once opened, the tank was found to contain approximately 1.3 m of an unidentified oil product. Crew could not explain what the product was, how it got there, or how long it has been there. MARPOL Annex I Ch 2 / Reg 6.4.2

Crew is not using the Standard Discharge Connection built in to the ship and outlined in the IOPP. The crew is utilizing flexible hoses and a pneumatic pump to pump directly from the bilges and oily bilge tank to a mobile facility ashore. This has not been approved by the administration. 73 MARPOL(11CONS) 6.4.2

The Oil Record Book Part I shall be completed on each occasion, on a tank-to-tank basis, whenever the following machinery space operations takes place in the ship; collection and disposal of oil residues and discharge overboard or disposal otherwise of bilge water which has accumulated in machinery spaces. The vessel is collecting oil in two heavy fuel oil tanks and then pumping from these tanks to trucks shore side. The crew is not recording these operations in the Oil Record Book. MARPOL Annex I Ch3/17.2.3

The machinery, boilers, and other pressure vessels shall be adequate for the service they are intended. Three of the six cylinder heads on the main engine are leaking approximately 3 gallons per minute of jacket water when the main engine is running. 74 SOLAS (04 Cons) Ch II-1/26.1

External high-pressure fuel delivery lines between the high pressure fuel pumps and fuel injectors shall be protected with a jacketed piping system capable of containing fuel from a high-pressure line failure. The fuel line going to the aft fuel injector on cylinder #6 was damaged and wrapped in duct tape. 74 SOLAS (04 Cons) Ch II-2/4.2.2.5.2

Objective evidence discovered during an expanded ISM exam revealed the following nonconformities: The vessel failed to fully implement the requirements of the ISM Code through their SMS procedures as evident by the following deficiencies indicating that the ship and/or company are not meeting the SMS requirements. Recommend an external audit. 74 SOLAS (14 CONS)Ch IX / Reg 3.1/ISM Code Part A No 1 - The company should ensure that all personnel involved in the company's safety management system have an adequate understanding of relevant rules, regulations, codes and guidelines. The crew failed to ensure the vessel was in compliance with their IOPP and MARPOL by using flexible hoses and a pneumatic pump to pump oily bilge water from the engine room bilges and oily bilge tank to two tanks designated on the vessel's plans as heavy fuel oil tanks. The two heavy fuel oil tanks are not designated on the vessel's IOPP to store or transfer oily bilge water. The oily bilge water was then pumped to a truck shore side using a connection installed by the crew to hook up a line to a vacuum pump ashore. There is no approval from the company or administration for these operations. No 2 - The company should establish procedures, plans and instructions for key shipboard operations concerning the safety of the personnel, ship and protection of the environment. The crew is pumping oily bilge water into two tanks designated as heavy fuel oil tanks and then using an onboard manufactured hose connection to pump the oily bilges ashore using a vacuum pump on the truck ashore. There is no evidence of these operations being approved or included in the SMS or approved transfer procedures onboard the vessel. ISM Code Part A/7 No 3 - The company should periodically verify whether all those undertaking delegated ISM-related tasks are acting in conformity with the company's responsibilities under the Code. Although the company established procedures for protecting the environment and the SMS stated it is required for the vessel to comply with all applicable rules and regulations for the vessel including MARPOL, the vessel's crew used the fuel tanks for storage and transfer of oily bilge water not designated on the IOPP for such use. The Chief Engineer did not record any use of these two unapproved fuel tanks in the Oil Record Book at any time for storage or discharge of oil residue in accordance with MARPOL. See narrative for additional ISM deficiencies. ISM Code Part A/12.2 Due to space limitations, please refer to ISM non-conformities No. 4 and No. 5 as written in the activity narrative. No. 5 was issued during a follow up inspection on 07JAN2019.

Pipes and hydrants shall be so placed that the fire hoses may be easily coupled to them. PSCO observed corroded and seized cover on fire hydrant station in E.R. adjacent to main engine. SOLAS74(14Cons.)II-2 Reg 10.2.1.1 10c

A low level alarm for each hydraulic fluid resevoir to give the earliest practicable indication of hyraulic fluid leakage. Audible and visual alarms shall be given on the nav. bridge and in the machinery space. PSCO observed no audible alarms in engine room during test of low hyraulic level for steering gear. 74SOLAS(04Cons.)II-1 Reg 12.2 40c

Machinery...shall be of a design... installed and protected to reduce danger to persons onboard. PSCO observed exhaust lagging missing on prime mover for Genset#3 and no guard for rotating flywheel on Gen#1. 74SOLAS(04Cons.)II-1 26.1 40c

CARGO SECURING MANUAL REQUIRES THAT CONTAINER TWISTLOCKS BE WELDED TO THE DECK. TWIST LOCKS ARE NOT WELDED AND ARE WASTED & RUSTED, OR ARE MISSING LOCKING DEVICES, PREVENTING LOCKING. A BOAT, A TRUCK AND 50% OF THE CONTAINERS BEING SHIPPED WERE NOT SECURED IAW THE MANUAL. 74 SOLAS (14 CONS) VI/5.6

1530 - AFTER ANY SURVEY OF THE SHIP UNDER REGULATIONS 7, 8, 9 OR 10 HAS BEEN COMPLETED, NO CHANGES SHALL BE MADE IN THE EQUIPMENT AND OTHER ITEMS COVERED BY THE SURVEY WITHOUT THE SANCTION OF THE ADMINISTRATION. ONE OF THE 9 GHZ RADARS REQUIRED BY THE SAFETY EQUIPMENT CERTIFICATE HAS BEEN REMOVED FROM SERVICE. 74 SOLAS (14 CONS) VI/5.6

1410 - Propulsion main engine - The design of the machinery shall have regard to materials used in construction, the purpose for which the equipment is intended, the working conditions to which it will be subjected and the environmental conditions on board. Main engine cylinder number two leaking water and oil. 74SOLAS(04 cons)II-1/26.1

0715 - Detection - Any required fixed fire detection and fire alarm system shall be capable of immediate operation at all times. Fire alarm detection panel indicating a fault. 74SOLAS(97 cons)II-2/13.1.1

0730 - Appliances (general equipment) - The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations. Fire main, port side forward, on main deck is holed. 74SOLAS(2014 cons)I/11(a)

1799 - Other (MARPOL Annex I) - Every ship of 400 gross tonnage and above shall be provided with a tank or tanks of adequate capacity. IOPP does not properly indicate tanks as the vessel is equipped, in 3.1 and 3.3. - MARPOL(2011)Annex I/Reg 12.1

0999 - Other (Safety in general) - Electrical installations shall be such that the safety of crew and ship from electrical hazards will be ensured. Electrical panel in the CO2 room does not have a cover and is a shock hazard. - 74SOLAS(04 cons)II-1/40.1.3

1581 - Rudder angle indicator - The angular position of the rudder shall be recognizable in the steering gear compartment. Rudder angle indicator at steering gear is off 5 degrees. - 74SOLAS(04 cons)II-1/29.11.2

0199 - Other (certificate) - Each transfer pipe system must not leak under static liquid pressure at least 1.5 times the maximum allowable working pressure. Vessel could not provide proof of test records for hydrostatic test. Provide test prior to bunkering in the United States. - 33CFR156.170(c)(1)(iii)

0640-Not less than 12 rocket parachute flares, complying with the requiremenets of section 3.1 of the code, shall be carried and be stowed on or near the navigation bridge. All 12 flares were expired. 74 SOLAS (14) Ch. III Reg 6.3 17bc

1299 - Load Line Mark - The International Load Line Certificate shall not be delivered to the ship until the officer or surveyor acting under the provisions of Article 13 of the convention has certified the marks are correctly indicated on the ship's sides. Vessel's load line markings do not reflect the load line marks indicated on the ship's certificate. - ICLL 66 Annex I/Reg 9

0199 - Documentation - Ship's systems and equipment used shall conform to performance standards and functional requirements. Any shipboard equipment shall be of a type approved by the Administration. Vessel does not have an LRIT Conformance Test Certificate. 74 SOLAS (14 Cons) V/19-1.6

1500-The condition of the ship and it's equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. The vessel's CSSEC indicates the vessel has a 9Ghz and a 3Ghz radar fitted. 3Ghz radar was found inoperable. 74SOLAS(14Cons.) Ch.1/Reg 11(a)

0999-In a ship in which oil fuel is used, the arrangements for the storage, distribution and utilization of the oil fuel shall be such as to ensure the safety of the ship and persons on board. Out of service heavy fuel oil lines found disconnected. 74SOLAS(97Cons.) Ch II-2/Reg 15.2

1760-To enable pipes of reception facilities to be connected with the ship's discharge pipeline for residues from machinery bilges and from oil residue tanks, both lines shall be fitted with a standard discharge connection in accordance with table. Vessel's standard discharge connection found missing required hardware. MARPOL Annex 1. Ch 3/Reg 13

The company should identify equipment and technical systems the sudden operational failure of which may result in a hazardous situation. The SMS should provide for specific measures aimed at promoting the reliability of such equipment. The vessel's SMS does not address the maintenance of the fire-fighting equipment located in the paint locker. 74 SOLAS (14) IX/3.1, ISM Code 10.3

Fire-fighting systems and appliances shall be kept in good working order and readily available for immediate use. Fixed sprinkler system in the paint locker not able to function as designed due to blockage in nozzles resulting from corrosion. 74 SOLAS ('14 CONS.) II-2/14.2.1.2

All electrical apparatus shall be so constructed and so installed as not to cause injury when handled or touched in the normal manner. Exposed wiring was found on the circuit board to the main diesel generator. Spliced wiring found leading to the 220V outlet in the Boson stores. 74 SOLAS ('04 CONS.) II-1/45.1.3

All ships 300 GT and up shall be fitted with an echo depth sounding device. While conducting bridge exam, vessel's echo depth sounder was found inoperable. 74 SOLAS (14) V/19.2.3

The company should ensure that the master is given the necessary support so that the master's duties can be safely performed. Vessel's master has submitted two purchase requests for mooring lines found unsuitable for mooring. Company has failed to provide lines. 74 SOLAS (Con.14) IX/3.1, ISM Code 6.1.3
