Machinery and electrical systems must be designed and maintained to provide for safe operation of the towing vessel and safety of persons onboard under normal and emergency conditions. Witnessed a crack and wastage on the steering gear. Require a causal analysis report identifying the issue and create a repair plan prior to allowing the vessel to move. A towing vessel may not be operated without having onboard a valid COI issued by the Coast Guard. Due to vessel lapsing on their COI, vessel will need to have new COI issued prior to operating. Cite: 46 CFR 136.200(a) Code: 705c: piror to operating

"The owner or managing operator must implement procedures to identify and mitigate health and safety hazards, including but not limited to: (1) Tools and equipment, including deck machinery, rigging, welding and cutting, hand tools, ladders, and abrasive wheel machinery found on board the vessel; (2) Slips, trips, and falls; (3) Working aloft; (4) Hazardous materials; (5) Confined space entry; (6) Blood-borne pathogens and other biological hazards; (7) Electrical; (8) Noise; (9) Falls overboard; (10) Vessel embarkation and disembarkation (including pilot transfers); (11) Towing gear, including winches, capstans, wires, hawsers and other related equipment; (12) Personal hygiene; (13) Sanitation and safe food handling; and (14) Potable water supply." Company has no health and safety plan.

Automatic Identification Systems or AIS means a maritime navigation safety communications system standardized by the International Telecommunication Union (ITU), adopted by the International Maritime Organization (IMO), that— (1) Provides vessel information, including the vessel's identity, type, position, course, speed, navigational status"

"Each watertight door and watertight hatch must be marked on both sides in clearly legible letters at least 25 millimeters (1 inch) high: “WATERTIGHT DOOR—KEEP CLOSED” or “WATERTIGHT HATCH—KEEP CLOSED”." Watertight doors need to be marked

"Each towing vessel must have a reliable means to provide notification when an emergency condition exists or an essential system develops problems that require attention. The following alarms must be provided: (1) Main engine low lubricating oil pressure; (2) Main engine high cooling water temperature; (3) Auxiliary generator engine low lubricating oil pressure; (4) Auxiliary generator engine high cooling water temperature" high jacket water alarm need to be tested on CAT engines.

Each towing vessel must be capable of preventing all oil spills from reaching the water. The discharge containments for the port and starboard fuel vents on the 02 deck (bridge deck)are wasted and holed through at the deck inside of the coamings. Containment areas will not prevent spillage.

Operations of transmitters of any ship station must be performed by a person holding a commercial radio operator license or permit. Master could not provide proof of radio operator license. 47 CFR 80.155

Each towing vessel operating in oceans or coastwise service must have a line throwing appliance approved under approval series 160.040. Three out of four line throwing appliances have expired dates for the housing body and line, printed on the outside of the container.

Only one means of escape is required from a space where: The means of escape is located as far as possible from a machinery space or fuel tank. Forward berthing area abuts fuel tanks/piping. Previously existing emergency escape is permanently closed up by way of welded steel plate where the hatch once was.

Piping and tanks exposed to the outside of the hull must be made of metal and maintained in a leak free condition. All bilge piping is comprised of flexible hose. Replace with metallic piping prior to next drydock credit.

An existing vessel may be deemed by the OCMI to be in compliance with this subpart provided that: (b) The vessel has been both in satisfactory service insofar as structural adequacy is concerned and does not cause the structure of the vessel to be questioned by the [name withheld] is a wasted frame inside the fwd center ballast tank on the port side. Crop out and repair/replace prior to next drydock credit.

An existing vessel may be deemed by the OCMI to be in compliance with this subpart provided that: (b) The vessel has been both in satisfactory service insofar as structural adequacy is concerned and does not cause the structure of the vessel to be questioned by the [name withheld] are heavily corroded and holed through frames inside the forepeak. Crop out and repair/replace prior to next drydock credit.

All owners and operators of an existing towing vessel must have a valid COI prior to the specified phase-in period. This vessel is one of the associated fleet that has not obtained a valid COI. The vessel shall be made available for a Coast Guard COI inspection within 90 days. If an inspection is not completed prior to this date, the action for this deficiency shall be changed to a 60 (Rectify deficiencies prior to movement) and the vessel may no long be permitted to operate.
