Objective evidence in the company's failure to identify additional substandard material condition from crew inspections of the barge cargo area was noted in the lack of the ship's maintenance log entries and failure of taking appropriate corrective actions by the ship's crew or company to address the eight (8) severely wasted cargo hatches identified by the attending Coast Guard Marine Inspectors. Further evidence was noted from the Coast Guard Inspection on 05 Dec 2017 conducted by MSU Texas City. During the 05 Dec 2017 inspection, numerous cargo hatch deficiencies were identified, as noted in MISLE activity 6318874 deficiencies number four (4) and five (5). Deficiencies 4 and 5 were rectified three months later by Sector Miami on 08 MAR 2018 (MISLE Activity 6367121). During the span of those 3 to 4 months from DEC 2017 to MAR 2018, the ships crew and company did not reasonable suspect or identified the substandard condition of the remaining cargo hatches as the company only replaced the four cargo hatches (1P, 2P, 5S, and 6P) that were identified from the 05 DEC 2017 Coast Guard inspection. As noted in 10.3 the company should identify equipment and technical systems of the sudden operational failure of which may result in hazardous situations. The safety management system should provide for specific measures aimed at promoting the reliability of such equipment or systems these measures should include the regular testing of standby arrangements and equipment or technical systems that not in continues use. The substandard condition of the wasted cargo hatches clearly presented a hazardous situation on board the B.NO. 240 in not being able to maintain vapor tightness.
