The TSMS must include the elements listed in paragraphs (a) through (d) of this section. Company does not have a TSMS culture in place that complies with TSMS elements mandated by the applicable CFRs; nor does it currently implement procedures to ensure compliance with operational and equipment requirements. Per the findings from the post casualty inspection on 17 Sept 2019 and reports submitted by company. Per CG-CVC policy letter 17-10 6.a. the owner, managing operator or TPO shall notify the local OCMI of any unsafe condition or major non-conformity and discuss procedures for correcting such an item in accordance with approved TSMS. The bilge high-water alarm required by this part was identified missing from vessel on 25 July 2019 (major non-conformity)yet no Corrective action per TSMS was conducted, and OCMI was not notified. A follow on audit conducted in August failed to address this item and that report indicated vessel was compliant. A detailed external management audit must be performed paying specific attention to 46 CFR 138.220 parts (a) & (d).
