An existing vessel my be deemed by the OCMI, or TPO, to be in compliance with this subpart provided that either: The vessel is built, equipped, and maintained to conform to the rules of a recognized classification society appropriate for the intended service and route, but not classed. Vessel personnel witnessed a discharge of fuel from the side shell. The shell is adjacent to a fuel tank that was subsequently drained and secured to stop the discharge. Fuel tank is to remain isolated and secured until permanent repairs can be conducted. Repair in kind to the satisfaction of the USCG Marine Inspector or TPO. The TPO, TVIB, is authorized to review and accept repairs in accordance with CG-CVC Policy Letter 17-10. TVIB must provide MSD Fort Smith with objective evidence that all repairs are properly made and that all tests are satisfactorily conducted.

Machinery and Electrical systems must be designed and maintained to provide for safe operation of the towing vessel and safety of persons on board under normal and emergency conditions. Vessel was found to have sustained damage to the starboard engine clutch after striking debris in the river. The damage to the clutch disabled the starboard engine. Make repairs to the clutch and its components and conduct operational tests prior to vessel getting back underway.

Machinery and electrical systems must be designed and maintained to provide for safe operations of the towing vessel and safety of persons onboard under normal and emergency conditions. Vessel rep reported loss of oil pressure on STBD main diesel engine. Vessel movement restricted until repairs are completed to the satisfaction of the TPO.

A towing vessel must be maintained and operated so the watertight integrity and stability of the vessel are not compromised. Vessel is permitted to transit to repair yard for repairs following provisions of approved TSMS. VSL is not permitted to push loaded cargo. TPO acceptance of repairs will be accepted to clear this Deficiency
