New installations that are not replacements in kind must comply with the requirements of subpart C of this part, if applicable. The owner of a vessel subject to inspection under section 3301 shall- (1) ensure that such vessel is equipped with a vessel master key control system, manual or electronic, which provides controlled access to all copies of the vessel's master key of which access shall only be available to the individuals described in paragraph (2); (2) establish a list of all crew, identified by position, allowed to access and use the master key and maintain such list upon the vessel, within owner records and included in the vessel safety management system; (3) record in a log book information on all access and use of the vessel's master key, including- (A) dates and times of access; (B) the room or location accessed; and (C) the name and rank of the crew member that used the master key; and(4) make the list under paragraph (2) and the log book under paragraph (3) available upon request to any agent of the Federal Bureau of Investigation, any member of the Coast Guard, and any law enforcement officer performing official duties in the course and scope of an investigation. Vsl has no Master Key, identified crew, or logbook. 46 USC 3106

Means must be provided for stopping each fan in a ventilation system serving machinery spaces and for closing, in case of fire, each doorway, ventilator, and annular space around funnels and other openings into such spaces. VSL's engine room fire dampers port side handle is broken off and stbd side has a gap when closed. 46CFR144.605

The master or officer in charge of a navigational watch must ensure all hatches and openings of the hull and deck are kept tightly closed except: when operating on rivers with a tow, if the master determines the safety of the vessel is not compromised; or when operating on lakes, bays, and sounds, without a tow during calm weather, and only if the master determines that the safety of the vessel is not compromised. MI observed port main deck watertight door removed for repair without prior approval. Vessel is restricted in towing operations to rivers route only, if the master determines the safety of vessel is not compromised. A log entry must be entered into the official log and or nav assessment for each voyage. 46CFR140.610(c)

Propulsion machinery, including main engines, reduction gears, shafting, bearings, and electrical equipment and systems must be maintained to ensure proper operation. MI found sheered off cotter pin on stbd steering ram castle nut and port steering ram castle nut had no cotter pin. 46CFR143.205(c)(1)

Stbd main engine day tank in ER had soft patch on bottom of tank and was observed leaking diesel fuel, port main engine day tank had soft patch. Both tanks require repair. 46CFR143.220(a)

Propulsion machinery, including main engines, reduction gears, shafting, bearings, and electrical equipment and systems must be maintained to ensure proper operation. MI observed outer shell cables were unsecured to the steering pump in E/R. 46CFR143.205(a)

Electrical systems and equipment must function properly and minimize system failures and fire and shock hazards.MI observed STBD and Port wire cables coming from battery to battery charger exposed cut and exposed. 46CFR143.400(a)

Machinery systems must be designed and maintained to provide for safe operation of the towing vessel and safety of persons onboard under normal and emergency conditions. MI observed the stbd lube oil transfer pump missing its cover. 46CFR143.220(a)

All pressure vessels must have the MAWP indicated by a stamp, or other means visible to the crew. Vessel has 02 UPVs without identifiable labeling of MAWP. 46CFR143.300(c)

Electrical systems and equipment must function properly and minimize system failures and fire and shock hazards. MI observed the P-1 distribution breaker panel with an opening. 46CFR143.400(a)

Stowage positions for life jackets stowed in berthing space or stateroom and all life jacket containers must be marked in block capital letters and numbers with the minimum quantity, identity, and if sizes other than adult or universal sizes are used on the vessel, the size of the life jackets stowed inside the container. Stowage areas inside berthing spaces were not marked. 46CFR141.340(h)

A towing vessel must carry adequate and up-to-date charts, maps, and nautical publications for the intended voyage. Vessel's U.S. pilot and USCG Light List were outdated. 46CFR140.705(b)

Inspection for certification. Nature of inspection. The inspection will ensure that the vessel is in satisfactory condition and fit for the service for which it is intended, and that it complies with the applicable statutes and regulations for such vessels. The inspection will include inspections of the structure, pressure vessels and their appurtenances, piping, main and auxiliary machinery, electrical installations, lifesaving appliances, fire detecting and extinguishing equipment, pilot boarding equipment, and other equipment. While conducting the vessel's initial COI inspection, excessive structural steel wastage, holed, and or insets were discovered throughout the forward void space and lazarette. Prior to issuance of the initial COI, vessel must complete and internal structure examination. Hull and structural areas where wastage is in question to be in excess of 25% of original thickness must gauged by a Non-Destructive Testing (NDT) level II technician. All hull and structural areas in excess of 25% wastage of original thickness must be cropped and renewed. Owner/Operator has been informed that a dry dock may be required once assessment has been completed. Vessel may not be used for towing operations. 46CFR136.212(b)

The master must ensure that all hatches, doors, and other openings designed to be watertight or weatheright function properly. Gaskets on watertight doors and hatches are not functioning as intended and are worn and wasted. 46CFR140.610(b)

Paints, coatings, or other flammable or combustible products onboard a towing vessel must be stored in a designated storage room or cabinet when not in use. The vessel does not have a designated space free of ignition sources or a flammable storage cabinet meeting UL 1275 on board. Additionally, the vessel does not have the 40b portable fire extinguisher located near the cabinet. 46CFR142.225

The following systems must be equipped with gauges at the machinery location: main engine and auxiliary engine local RPM gauges. The main and auxiliary engines are not equipped with local RPM gauges. 46CFR143.230(c)

Each towing vessel must perform the applicable tests in Table 143.2245(b). Alarm set points listed in 143.230 have not been conducted. 46CFR143.245(b)

All owners and operators of an existing towing vessel must have a valid COI prior to the specified phase-in period. This vessel is one of the associated fleet that has not obtained a valid COI. The vessel shall be made available for a Coast Guard COI inspection within 90 days. If an inspection is not completed prior to this date, the action for this deficiency shall be changed to a 60 (Rectify deficiencies prior to movement) and the vessel may no long be permitted to operate.
