A towing vessel must carry adequate and up-to-date charts, maps, and nautical publications for the intended voyage. Vessel was not equipped with approved monitor for ENC. 46 CFR 140.705

A fixed fire pump must be capable of delivering water … at a pitot-tube pressure of at least 344 kilopascals (kPa) (50 pounds per square inch (psi)). The fixed fire pump is not capable of delivering water at 50 psi. Prior to towing ops, 46 CFR 142.325(a)(1)

Machinery and electrical systems must be designed and maintained to provide for safe operation of the towing vessel and safety of persons onboard under normal and emergency conditions. Bilge piping IWO fire pump is leaking excessively. Prior to towing ops, 46 CFR 143.205(a)

Pressure vessels over 5 cubic feet in volume and over 15 pounds per square inch maximum allowable working pressure (MAWP) must be equipped with an indicating pressure gauge (in a readily visible location) and with one or more spring-loaded relief valves. The total relieving capacity of such relief valves must prevent pressure from exceeding the MAWP, as established by the manufacturer, by more than 10 percent. Relief valves are set at above MAWP. 14 day, 46 CFR 143.300(a)

Each towing vessel must have a reliable means to provide notification when an emergency condition exists or an essential system develops problems that require attention. The following alarms must be provided: (1) Main engine low lubricating oil pressure; (2) Main engine high cooling water temperature; (3) Auxiliary generator engine low lubricating oil pressure; (4) Auxiliary generator engine high cooling water temperature; (5) High bilge levels; (6) Low hydraulic steering fluid levels, if applicable; and (7) Low fuel level, if fitted with a day tank. Alarms must: be visible and audible at each operating station. The alarm located at the operating station may be a summary alarm; if the alarm at the operating station is a summary alarm, the specific alarm condition must be indicated at the machinery or bilge location. Neither operating station has the required alarms visible. 30 days, 143.230

Emergency lighting must be provided for all internal crew working and living areas. Emergency lighting sources must provide for sufficient illumination under emergency conditions to facilitate egress from each space and must be either: (1) Automatic, battery-operated with a duration of no less than 2 hours; or (2) Non-electric, phosphorescent adhesive lighting strips that are installed along escape routes and sufficiently visible to enable egress with no power. There is insufficient/no emergency lighting installed in internal crew working and living areas. 14 days, 46 CFR 143.410

Means must be provided to ensure that windows immediately forward of the operating station in the pilothouse allow for adequate visibility to ensure safe navigation regardless of weather conditions. This may include mechanical means such as windshield wipers, defoggers, clear-view screens, or other such means, taking into consideration the intended route of the vessel. 30 days, 46 CFR 144.905(b)

An EAP training program must be conducted for the employer's crewmembers and supervisory personnel. The training program must include at least the following elements: the effects and consequences of drug and alcohol use on personal health, safety, and work environment; the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; and documentation of training given to crewmembers and the employer's supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. There are no records of training for supervisory personnel. 14 days, 46 CFR 16.401

Collection of an individual's saliva or breath to comply with § 4.06-3(a) must be taken only by personnel trained to operate the alcohol-testing device in use and must be conducted according to this subpart. There is no proof of training to operate alcohol-testing devices. 14 days, 46 CFR 4.06-20(a)(3)

The marine employer shall ensure that the urine specimen collection procedures of § 16.113 of this chapter and the chain of custody requirements of 49 CFR part 40, subpart D, are complied with. … Drug testing programs required by this part must be conducted in accordance with 49 CFR part 40, Procedures for Transportation Workplace Testing Programs. … To be permitted to act as a collector in the DOT drug testing program, you must meet each of the requirements of this section [detailed in (a)-(g)] There is no proof of training to collect urine specimens for chemical tests. 14 days, 46 CFR 4.06-40(b), 46 CFR 16.113, 49 CFR 40.33

A vessel must be operated in accordance with applicable laws and regulations and in such a manner as to afford protection against hazards to life, property, and the environment. Excessive water ingress was observed at the sea strainer.

Survival craft must be stowed in accordance with the requirements of § 199.130 of this chapter, as far as is practicable on existing towing vessels. Each liferaft or group of liferafts must be arranged for float-free launching. Liferaft was not arranged for float free launching.

No marine employer shall engage or employ any individual to serve as a crewmember unless the individual passes a chemical test for dangerous drugs for that employer. Hiring process was not completed for vessel crew, appropriate pre-employment testing or documentation must be provided. Rectify prior to towing operations.

Prior to getting underway for the first time on a particular towing vessel, each crewmember must receive a safety orientation on [items (b)(1) through (10)]. Vessel had no records of safety orientation. Rectify prior to towing operations.

All crewmembers must be provided with health and safety information and training that includes [items (a)(1) through (9)]. Crewmember training required by this section must be conducted as soon as practicable, but not later than 5 days after employment. All training required in this section must be documented in owner or managing operator’s records. Vessel had no records of health and safety training. Rectify prior to towing operations.

Section 151.57 (Garbage Management Plans) applies to a manned oceangoing ship of 40 feet or more in length that is documented under the laws of the United States or numbered by a state and that either is engaged in commerce or is equipped with a galley and berthing. Vessel did not have a garbage management plan compliant with the requirements of 33 CFR 151.57.

The operator of a vessel with a capacity of 250 or more barrels of oil, hazardous material, or liquefied gas as regulated in Table 4 of 46 CFR part 154 shall provide transfer procedures that meet the requirements of this part and part 156 of this chapter for transferring (a) To or from the vessel; and (b) From tank to tank within the vessel. Vessel did not have transfer procedures compliant with 33 CFR 155.750. Rectify prior to oil transfer.

Vessels described in Table 136.250 of this section that operate on the Great Lakes or outside the Boundary Lines, as set forth in 46 CFR part 7, are subject to load line requirements in subchapter E of this chapter in the following circumstances [see Table 136.250]. Vessel does not have an International Load Line Certificate. Rectify prior to crossing boundary line.

The master must ensure that drills are conducted and instructions are given to ensure that all crewmembers are capable of performing the duties expected of them during emergencies. This includes abandoning the vessel, recovering persons from the water, responding to onboard fires and flooding, or responding to other threats to life, property, or the environment. Vessel has no records of drills. Rectify prior to towing operations.

Survival craft must have an aggregate capacity sufficient to accommodate the total number of individuals onboard. Liferaft capacity was not sufficient for total number persons allowed on board. Rectify prior to towing operations.

For towing vessels with berthing aboard, a sufficient number of additional lifejackets must be carried so that a lifejacket is immediately available for persons at each normally manned watch station. In addition to the immersion suits required under paragraph (a)(1) of this section, each watch station, work station, and industrial work site must have enough immersion suits to equal the number of persons normally on watch in, or assigned to, the station or site at one time. Vessel did not have lifejackets and immersion suits located at remote watch stations. Rectify prior to towing operations.

All lifesaving equipment must be tested and maintained in accordance with the minimum requirements of § 199.190 of this chapter, as applicable. Each battery clearly marked with an expiration date and used in an item of survival equipment must be replaced during the annual inspection if the expiration date has passed. Several life buoy light batteries were expired.

Stowage positions for lifejackets stowed in a berthing space or stateroom and all lifejacket containers must be marked in block capital letters and numbers with the minimum quantity, identity, and, if sizes other than adult or universal sizes are used on the vessel, the size of the lifejackets stowed inside the container. The equipment may be identified in words or with the appropriate symbol from IMO Resolution A.760(18). Immersion suits carried on towing vessels must meet the requirements of § 199.70(c) and (d) of this chapter. Each immersion suit container must be marked in block capital letters and numbers with the quantity, identity, and size of the equipment stowed inside the container. The equipment may be identified in words or with the appropriate symbol from IMO Resolution A.760(18). Stowage locations for lifejackets and immersion suits are not properly marked.

Immersion suits carried on towing vessels must meet the requirements of § 199.70(c) and (d) of this chapter. Each immersion suit or anti-exposure suit must be marked in such a way as to identify the person or vessel to which it belongs. Immersion suits are not properly marked with identifying information.

Each vessel must have the following: a current magnetic compass deviation table or graph or compass comparison record for the steering compass, in the wheelhouse. Vessel does not have a compass deviation table.

Each towing vessel operating on oceans, coastwise, or Great Lakes routes must have a means to take blood pressure readings, splint broken bones, and apply large bandages for serious wounds. Vessel is missing required first aid equipment.

Each towing vessel must perform the applicable tests in Table 143.245(b) of this section. The tests required by this section must be recorded in accordance with part 140 of this subchapter. Vessel does not have records of performing the tests outlined by Table 143.245(b) or a schedule to perform them. Rectify prior to operations.

Electrical systems and equipment must function properly and minimize system failures and fire and shock hazards. Vessel has multiple unsafe electrical installations, including dead end wires located starboard side engine room near lube oil tank, an extension cord hard wired into battery box on engine room second deck, and exposed wires on the generators. Rectify prior to towing operations.

All bilges and void spaces are kept free from accumulation of combustible and flammable materials and liquids insofar as practicable. Inspectors witnessed excessive oil accumulation in bilges. Rectify prior to towing operations.

The official number of the vessel, preceded by the abbreviation “NO.” must be marked in block-type Arabic numerals not less than three inches in height on some clearly visible interior structural part of the hull. The number must be permanently affixed to the vessel so that alteration, removal, or replacement would be obvious. Internal marking is stenciled, not permanently affixed.

The hose must be a lined commercial fire hose 15 meters (50 feet) in length, at least 40 millimeters (1.5 inches) in diameter, and fitted with a nozzle made of corrosion-resistant material capable of providing a solid stream and a spray pattern. Vessel did not have nozzles on board for all hoses. Rectify prior to towing operations.

All portable fire extinguishers, semi-portable fire-extinguishing systems, fire-detection systems, and fixed fire-extinguishing systems, including ventilation, machinery shutdowns, and fixed fire-extinguishing system pressure-operated dampers on board the vessel, must be inspected or tested at least once every 12 months, as prescribed in paragraphs (a)(1) through (8) of this section, or more frequently. Vessel does not have a plan for fire prevention and fire fighting maintenance that is compliant with 46 CFR 142.240. Rectify prior to towing operations.

All owners and operators of an existing towing vessel must have on board a valid COI prior to the specified phase-in period. This vessel has not scheduled and inspection or obtained a valid COI. The vessel shall be made available for Coast Guard COI inspection immediately and the vessel may no longer be permitted to operate.

All owners and operators of an existing towing vessel must have a valid COI prior to the specified phase-in period. This vessel is one of the 75% of the vessels that has not obtained a valid COI. The vessel shall be made available for a Coast Guard COI inspection within 90 days. If an inspection is not completed prior to this date, the action for this deficiency shall be changed to a 60(rectify deficiencies prior to movement) and the vessel may no longer be permitted to operate. 46 CFR 136.202(a)
