MI observed several unfastened windows on upper deck. Repair/fasten down prior to credit dry dock.

Propulsion machinery must be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at a constant marine load. Vessel report a loss of propulsion due to port side engine being rendered inoperable causing an undue risk to the port of New York. In order to clear this deficiency the following actions must be carried out: 1. Provide a causal analysis report on the loss of propulsion and provide a repair proposal. 2. Post-approval of repair proposal and upon completion of repairs, provide USCG a tech report delineating all repairs and pier side propulsion test satisfactory. 4. Vessel must undergo an underway sea trial to the satisfaction of an attending marine inspector prior to carrying passengers.

All Pressure vessels must meet the requirements of sub-chapter F. Port air receiver failed hydrostatic test. 46CFR119.330 701C

Where liquid level indicating gages are installed, they shall be provided at the tank connections with devices which will automatically close in the event of rupture of the gage or gage lines. MI observed the liquid level indicator does not automatically close. Cite: 46CFR182.20-25(a)(5)

All electrical installations shall be to the satisfaction of the Officer in Charge, Marine Inspection. MI observed alternator was arking and sparking. Vessel must replace alternator. Cite: 46CFR183.01-15(a)

Penetrations for hydraulic steering lines, port and starboard sides of pilot house, lack complete smoke and flame barrier. Remove compromised filler material and refill penetrations with material certified for A-Class boundaries. 46 OLD CFR 177.10-5

Vessel reported a unintended grounding causing a Marine Casualty. IAW 46 CFR 122.304 the movement of the vessel shall be under the direction and control if the master at all times and shall operate the vessel keeping the safety of the passengers and crew. Vessel must be pulled out of water for damage survey. Make proper repairs to damaged areas and complete successful sea trials to the satisfaction of a USCG Marine Inspector prior to carrying passengers for hire. 46 CFR 115.700(a)

At each inspection all observed unsafe practices, fire hazards and other hazardous situation be corrected. Overhead light and expansion tank for starboard generator were zip ties to piping in engine room. Mount light and expansion to correctly. 46 CFR 115.840 (a)

A storage cylinder must be securely fastened, supported, and protected against damage. CO2 bottle for fixed firefighting system was loose and not secured properly. Secured CO2 bottle correctly. 46 CFR 118.410(c)(4)

At each inspection all observed unsafe practices, fire hazards and other hazardous situation be corrected. Water intrusion was seen coming from upper deck into main deck. Locate source of water intrusion and make repairs. 46 CFR 115.840(a)

Each life jacket must be marked in clearly legible black letters with vessels name. 04 Child life jackets and 02 adult life jackets were missing vessels name. Add vessels name to life jackets. 46 CFR 122.604(b)

Each connection to a conductor or terminal part of a conductor must be made within an enclosure. Outlet in engine was missing enclosure. Provide enclosure for outlet. 46 CFR 120.340(g)

At each inspection the bilges and other spaces maybe examined to see that there are no excessive accumulation of oil, trash, or debris that might create a fire hazard. Oil was in engine room and diesel was fuel tank void bilges. Remove all oil and diesel from bilges. 46 CFR 115.830(b)

A-Class bulkheads or decks must be composed of steel or equivalent material and must be so insulated with approved structural insulation. Insulation of missing in overhead forward starboard side of engine room. Replace missing insulation. 46 CFR 116.415 (2)(i)

An exposed hazard, such as gears or rotating machinery, must be protected by a cover, guard or rail. Rotating flex coupler of port and Starboard MDE's were missing a guard. Provide guards for rotating machinery. 46 CFR 116.960

Make proper repairs/replace both the port and starboard props.

Make proper repairs/replace the port and starboard shaft struts.

Make proper repairs/replace starboard shaft. Operator shaft will be replaced.

Crop and renew bottom plate aft of starboard rudder. Cracked hull due to rudder breaking the hull from grounding.

Replace cracked top bearings/shaft collars on both the port and starboard rudder assembilies.

Crop and renew 2 areas on transverse frame connecting between the port and starboard rudder assemblies.

At each inspection for certification and each other inspection the bilges and other spaces may be examined to see that there is no excessive accumulation of oil, trash or debris the might create fire hazards or blockages. Attending Marine Inspector (MI) found approximately 6" of blue tinted water in the lazarette space. Vessel not operating in compliance with the COI. 46CFR115.830(b) 46CFR115.100(b)

At each inspection for certification and each other inspection the bilges and other spaces may be examined to see that there is no excessive accumulation of oil, trash or debris the might create fire hazards or blockages. Attending MI found 6" of oily water in the engine room bilge. Vessel not operating in compliance with the COI. 46 CFR 115.830(b) 46 CFR 115.100(b)

The design of all exhaust systems must ensure minimum risk of injury to personnel and protection must be provided in compliance with 46CFR116.970. Attending MI found missing and loose exhaust lagging in engine room. 46 CFR 182.20-20(a)

A vessel is inspected for compliance with the standards required by this subchapter, however items not covered are inspected in accordance with OCMI as good marine practice. Attending MI determined the electrical conduit was not properly supported and the junction boxes were missing covers in the overhead. 46 CFR 115.800(a)

At each inspection for certification and each other inspection the bilges and other spaces may be examined to see that there is no excessive accumulation of oil, trash or debris the might create fire hazards or blockages. Attending MI found approximately 50 gallons of coolant in the fuel tank space bilge. Vessel not operating in compliance with the COI. 46CFR115.830(b) 46CFR115.100(b)

Receptacle outlets and attachment plugs for portable apparatus operating at 100 volts or more must have a grounding pole and grounding conductor in the portable cord. Attending MI found a portable electric heater that had the ground conductor removed from the plug. 46CFR183.10-20(o)

This vessel is a "TL-boat", therefore not required a safety management system (SMS) per regulation. Sector NY has found the following deficiencies to be objective evidence that a serious substandard condition has not been pro-actively managed by the vessel's owner/operator, leading to a lack of safety culture onboard the vessel. 46CFR176.25-50

Generators and engines do not shutdown as required upon activation of installed fire protection system.

Bilge alarm float switch does not function properly.

Stbd aft electrical panel on bridge has a large loose wire. Remove or place in enclosure.

Post emergency broadcast placard at operating station.

Remove and clean all PFD's and their storage areas. Label all PFD's with vessel name.

Update PFD storage placards throughout vessel. Anywhere PFD's are stored must be labeled "Adult/Child Life Jackets"

Repair exhaust rips/missing in lazarette space.

STARBOARD MAIN ENGINE AND GENERATOR EXHAUST CONNECTION TO HULL IS FAILING. MAKE WATERTIGHT.

Replace or repair structural fire protection portside enigine room frames #2, #3, and #4 (overhead only) to satisfaction of attending CGMI.

Replace frayed wired on portisde main diesel engine.

Replace inspection port covers of magnetic pickups on both main diesel engines.

Provide repair proposal for broken glass on forrward sliding glass doors.

Conduct smoke detector test in engine room.

Vessel lost throttle and gear control after port generator went offline and air tanks could not be replenished. Make satisfactory repairs to port generator and demonstrate satisfactory operation of vessel controls via sea trials.

Flex coupler on port MDE was reported as defective. Must repair in kind and demonstrate satisfactory sea trials.

Provide permanent rudder stop for rudder in laz.

Provide current FCC Safety Radio Certificate . Vessel is restricted to operations no more than 1000 feet from shore until a valid certificate is issued and placed onboard.

Provide current FCC Bridge to Bridge Radiotelephony Certificate. Vessel is restricted to operations no more than 1000 feet from shore until a valid FCC Bridge to Bridge Radiotelephony Certificate is issued and placed onboard.

Provide servicing for all portable fire extinguishers and the fixed gas fire extinguishing system on board prior to carrying passengers.

Crop and renew holed section of the side shell, on the starboard side, transom IWO the corner post.

Replace wasted flex hose servicing the transmission oil cooling system IWO the Port MDE.

Grind and reweld the following cracks: Five (05) total welds on vertical stiffeners IWO the forepeak, Four (04) bottom welds IWO the Forepeak and one (01) top weld IWO the forepeak.

Grind and reweld one (01) cracked weld in 2nd bay, 3rd frame from the top, 3rd bay.

Visibly mark aft stairwell for a maximum of 200 passengers as per the stability letter dated December 22, 1992.

Grind out /weld rough edges IWO bow keel as discussed (approximate 1ft).

Clean out debris IWO screen plates Fire/bilge pump sea suction.

C/R aft stbd side rub rail corner.

Refasten rubber bumper retaining bolt (fwd main deck).

Replace bubbled stbd steering hydraulic hose (IWO stbd steering feed line).

Remove unused (old) anchor windlass. After removal restow anchor as required.

There is a tear through the hull plating on the starboard side aft corner. There are doubler plates and epoxy covering the tear at the 2nd transverse frame below the deck on the hull interior in the lazarette. Make permanent and proper repair prior to carrying passengers.

There is a cracked weld at the starboard hull Sampson post bracket, located in lazarette. Make permanent and proper repair prior to carrying passengers.

There is an inset on the starboard aft corner between deck and first transverse frame (in lazarette). Make permanent and proper repair prior to carrying passengers.

The HALON 1301 cylinder for the engine space fixed fire extinguishing system is low on pressure and gauge needle is positioned in "recharge" zone. Have HALON 1301 cylinder and fixed system serviced prior to carrying passengers.

Both air receivers located in the engine space are overdue for inspection (MAY 2007). Test and inspect both air receivers in the presence of USCG Marine Inspector prior to carrying passengers.

Provide repair proposal for items DB01, DB02, and DB03 for approval prior to making repairs.

Remove anti-freeze that has leaked into forepeak bilge and determine source of leak and repair.

Remove or properly enclose dead end wire located in cabinet in wheelhouse in vicinity of fixed fire system alarm panel.

Replace broken/damaged fire extinguisher bracket in wheelhouse.

Provide valid fixed firefighting system.

Properly terminate dead end wires underneath bridge console (port side)

Properly remove/terminate exposed dead - end wires stbd. quarter deck.

Provide updated fire control plan as per 46 CFR 116.530.
